AMENDMENT NO. 1

COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth, a municipal corporation situated in Tarrant
County, Texas hereinafter called"City" and Kellogg Brown and Root Services, Inc.,here
after called"Engineer" made and entered into City Secretary Contract No. 31217 (the
Contract) which was authorized by the City Council by M&C C-20422 on the 301h day of
November 2004.
WHEREAS, the Contract involves engineering services for the following project:
Energy Management Project at
Water and Wastewater Treatment Plant Sites
Project Number PS46-070460300170
WHEREAS, it has become necessary to execute Amendment No. 1 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement,which amends the
Contract:
1.
Article I, of the Contract is amended to include the additional engineering
services specified a proposal letter dated August 17, 2007, copies of which are both
attached hereto and incorporated herein. The cost to City for the additional services to be
performed by Engineer total $ 41,978,00.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to the Engineer for all work done and services performed under the
Contract, as amended, so that the total fee paid by the City for all work and services shall
not exceed the sum of$123,108.00.
3.
All other provisions of the Contract which are expressly amended herein shall
remain in full force and effect. l l m?'

Dear Ms. Rafalko:
Over the course of the project the Fort Worth Water Department has had a variety of needs with respect to
Energy Management at Village Creek.Attached is the original scope of work,including breakdown of hours and
cost.We have completed Task 1 the Brain-storming Workshop.We have completed Task 2 including assistance
with negotiations for the landfill gas and review and development of gas lease terms.We have submitted both the
frac water disposal memorandum and the energy management report for your review under Task 3. Our sub-
consultant,Multatech Engineering, has completed Task 4 the Engineering Services for CFW/Rends
Environmental Contract.
In addition to these contracted tasks,upon request of city staff,we have completed a manufacturers testing visit
for vibration testing of the generator in March of 2005.These costs are summarized in Task 106 in the table
below. Upon request of city staff in May of 2006,we have submitted a fuel gas connection standard detail for your
review.These costs are summarized in Task 107.Task 108 is work to address site conditions and other wording
required for the lease proposal for Village Creek.
Summarized in Task 201 thru 204,we are submitting an estimate for work discussed at our meeting on June 20,
2006.Task 201 is work relating to accepting frac water for disposal at Village Creek.Task 204 is for consulting
services for the overhaul of the generators.Tasks 201 thru 204 are available for minority participation.We expect
to achieve 12%participation based on the total of the change order.See attached scope.

Authorize Amendment No. 1 to City Secretary Contract No. 31217 an Engineering Agreement with
Kellogg Brown & Root, Inc., for the Energy Management Project at Water/Wastewater Treatment
Plants
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City
Secretary Contract No. 31217 an engineering agreement with Kellogg Brown and Root, Inc., for the Energy
Management Project at Water and Wastewater Treatment Plants, increasing the total contract cost by
$41,978.00 from $81,130.00 to $123,108.00.
DISCUSSION:
On November 30, 2004, (M&C C-20422) the City Council authorized an Engineering Agreement with
Kellogg Brown and Root, Inc., (KBR) for the Energy Management Project at Water and Wastewater
Treatment Plants.
The proposed amendment includes additional compensation for continued evaluation of gas well water
disposal issues, including the impact of accepting gas well water for disposal at Village Creek Wastewater
Treatment Plant. Also included is compensation for the design of a connection detail for receiving natural
gas in-kind at Village Creek Wastewater Treatment Plant for emergency power generation or other plant
uses.
The project is located in COUNCIL DISTRICT 5.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Sewer Capital Projects Fund.
