HomeMy WebLinkAboutOrdinance 3382 ORDINANCE NO. �., AN ORDINANCE DEFINING AND ESTABLISHING SCHOOL ZONES; SETTING A MAXIMUM SPEED LIMIT OF TWENTY MILES PER HOUR IN SCHOOL ZONES; PROVIDING FOR EFFECTIVE HOURS OF SUCH SPEED LIMIT; PROVIDING A PENALTY CLAUSE; MAKING THIS ORDINANCE CUMULA- TIVE OF ALL OTHER ORDINANCES GOVERNING MOTOR VEHICULAR TRAFFIC; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, engineering and traffic investigations and studies have been made, and the City Council of the City of Fort Worth has determined, upon the basis of such engineering and traffic investigations and studies, that the speed limit in the City of Fort Worth is greater than is reasonable or safe under the conditions existing on highways, alleys and streets within Fifteen Hundred (1500') Feet of schools in the City of Fort Worth; NOW, THEREFORE.- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the area within the city limits of the City of Fort Worth which are within a distance of fifteen hundred (1500') feet from any school, public or private, be hereby designated as school zone. SECTION 2. No person shall drive or operate a motor vehicle upon any public street, alley or highway within any school zone within the corporate limits of the City of Fort Worth at a greater rate of speed than twenty miles an hour. SECTION 3. The foregoing section shall be applicable and in effect between the hours of 8:00 o'clock A.M. and 4:00 o'clock P.M. on all days and in all school zones when school is officially in session but shall be of no force or effect at any other time. SECTION 4. The Traffic Engineer of the City of Fart Worth is hereby directed to erect signs in all school zones to warn the operators of motor vehicles within such school zones of the speed limits in force therein. SECTION 5• Any person who shall violate any of the provisions of this ordinance or any rule or regulation made by the City Traffic Engineer pursuant thereto shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not to exceed Two Hundred ($200.00) DOLLARS. SECTION 6. This ordinance shall be cumulative of all other ordinances concerning highway traffic in the City of Fort Worth except in those instances where such ordinances are in conflict herewith, in which instances, the terms of this ordinance shall prevail. SECTION 7. Should any section, article, provision or part of this ordinance be declared to be unconstitutional and void by a court of competent jurisdiction, such decision shall in no way affect the validity of any of the remaining parts of this ordinance unless the part held unconstitutional or void is inseparable from and indispensable to the operation of the remaining parts. The City Council hereby declares that it would have passed those parts of this ordinance which are valid and omitted any parts which may be unconstitutional if it had known that such parts were unconstitutional at the time of the pass- age of this ordinance. SECTION 8. This ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as provided by law. APPROVED AS TO FORM: Ass stant City Attorney
