ORDINANCE NO. y
AN ORDINANCE MAKING CERTAIN FINDINGS; FIXING THE BOUNDARY LIMITS OF
THE CITY OF FORT WORTH. PROVIDING FOR ALTERATION OF THE BOUNDARY
LIMITS OF THE CITY OF FORT WORTH; DISCONTINUING TERRITORY FROM
WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT WORTH; PROVIDING
THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR SEVERABILITY
AND NAMING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth and the City of Benbrook have heretofore
approved a joint resolution to apportion unincorporated territory and estab-
lish a common boundary line between the two cities, and
WHEREAS, in furtherance of the terms of the agreement it is necessary
that the City of Fort Worth discontinue the hereinafter described territory
from its corporate area, and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS
SECTION 1
That the hereinafter described territory within the corporate limits of
the City of Fort Worth be and the same is hereby discontinued as a part of
the City of Fort Worth; said territory being described by metes and bounds
as follows:
PARCEL NO. 1
Situated about 12 miles southwesterly from the Courthouse of Tarrant
County, Texas, lying in the L. B. Creswell Survey, Abstract No. 367; Heirs
of T. G. Zachary Survey, Abstract No. 1759; and J. F. Elliott Survey, Abstract
No. 493, and being more particularly described as follows:
BEGINNING at a point in the present City of Fort Worth City Limit Line
in the north line of Benbrook Cardinal Chaplin Road (County Road No. 1040),
30 feet west of the intersection of said City Limit Line with the east line
of the L. B. Creswell Survey produced north.
THENCE south along a line parallel to and 30 feet west of the east line
of the L. B. Creswell Survey to its intersection with the north line of the
T. G. Zachary Survey, and continuing south along said line produced to its
intersection with the middle of Mary's Creek.
THENCE east along the middle of Mary's Creek to its intersection with
the west line of the D. P. Dean tract in the T. G. Zachary and J. F. Elliott
Surveys.
THENCE south along the west line of the D. P. Dean tract to its south-
west corner in the J. F. Elliott Survey.
THENCE southeasterly along the southerly line of the D. F. Dean tract to
its intersection with the east line of the J. F. Elliott Survey.
THENCE south along the east line of the J. F. Elliott Survey to its
easterly southeast corner in the north line of the D. H. Dickson Survey,
Abstract No. 443.
THENCE west along the north line of the D. H. Dickson Survey to its
intersection with the easterly right of way line of proposed Interstate
Highway I-820, as said proposed right of way appears on a map on file with
the Fort Worth office of the Texas Highway Department.,
THENCE northwesterly along the easterly right of way line of proposed
Interstate Highway I-820 to a point which stands 50 feet north of and
perpendicular to the south line of the J. F. Elliott Survey.
THENCE east along a line parallel to and 50 feet north from the north
line of the D. H. Dickson Survey to a point 50 feet west from the east line
of the J. F. Elliott Survey.
THENCE north along a line 50 feet west of and parallel to the east line
of the J. F. Elliott Survey to a point 50 feet south of the south line of
the D. P. Dean tract in the T. G. Zachary and J. F. Elliott Surveys.
THENCE west along a line 50 feet south of and parallel to the south.
line of the D. P. Dean tract to a point which is 50 feet west of the west
line of the Dean tract produced south.
THENCE north along a line 50 feet west of the west line of the Dean
tract produced south, and 50 feet west of the Dean tract, to a point 50 feet
south from the middle of Mary's Creek.
THENCE westerly along a line 50 feet southerly from the middle of Mary's
Creek to a point 80 feet west from the east line of the L. B. Creswell Survey
produced south.
THENCE north along a line 80 feet west from the east line of the L. B.
Creswell Survey produced south, and 80 feet west from the east line of the
L. B. Creswell Survey, and 80 feet west from the east line of the L. B.
Creswell Survey produced north to a point in the north right of way line of
Benbrook Cardinal Chaplin Road (County Road No. 1040).
THENCE easterly along the north right of way line of Benbrook Cardinal
Chaplin Road (County Road No. 1040) to the place of beginning and containing
approximately 11 acres.
PARCEL NO. 2
Situated about 12 miles southwesterly from the Courthouse of Tarrant
County, Texas, and lying in the D. H. Dickson Survey, Abstract No. 442, and
the Watson Survey, Abstract No. 1667, and being more particularly described
as follows:
BEGINNING at the intersection of the south line of the D. H. Dickson
Survey, Abstract No. 442 with the northeasterly right of way line of State
Highway No. RM 2871,

THENCE east along the south line of the D. H. Dickson Survey to the
southwest corner of the Watson Survey, Abstract No. 1667; and continuing
east along the south line of the Watson Survey to its southeast corner.
THENCE north along the east line of the Watson Survey to the middle
of Walnut Creek.
THENCE northwesterly, up the middle of Walnut Creek to a point which
stands 50 feet west from and perpendicular to the east line of the Watson
Survey.
THENCE south along a line 50 feet from and parallel to the east line
of the Watson Survey to a point 50 feet north from the south line of the
Watson Survey.
THENCE west along a line 50 feet north from and parallel to the south
lines of the Watson and D. H. Dickson Surveys to a point in the northeasterly
right of way line of State Highway No. RM 2871.
THENCE southeasterly along the northeasterly right of way line of State
Highway No. RM 2871 to the place of beginning and containing approximately
3 acres.
PARCEL NO. 3
Situated about 12 miles southwesterly from the Courthouse of Tarrant
County, Texas, lying in the J. Spilman Survey, Abstract No. 1377, and being
more particularly described as follows:
BEGINNING at the northwest corner of the J. Spilman Survey, Abstract
No. 1377.
THENCE east along the north line of the J. Spilman Survey to its inter-
section with the middle of the Clear Fork of the Trinity River.
THENCE southwesterly along the middle of the Clear Fork of the Trinity
River to a point which stands 50 feet south of and perpendicular to the north
line of the J. Spilman Survey.
THENCE west along a line 50 feet south from and parallel to the north
line of the J. Spilman Survey to a point 50 feet east of the west line of
said survey.
THENCE south along a line 50 feet east from and parallel to the west
line of said survey to the middle of the Clear Fork of the Trinity River.
THENCE southwesterly along the middle of the Clear Fork of the Trinity
River to the west line of the J. Spilman Survey.
THENCE north along the west line of the J. Spilman Survey to the place
of beginning and containing approximately 2 acres.

SECTION 2
That this ordinance shall and does amend every prior ordinance in
conflict herewith, but as to all other ordinances or sections of ordinances
not in direct conflict herewith this ordinance shall be and is hereby made
cumulative.
SECTION 3
That if any section, subsection, clause, sentence, phrase, or word of
this ordinance is for any reason held void or unconstitutional, by a court
of competent jurisdiction, such invalidity shall not affect the validity
of the remaining sections, subsections, clauses, sentences, phrases, or words
except as the same are inseparable from and indispensable to the remaining
portions of the ordinance.
SECTION 4
That this ordinance shall become effective and shall be in full force
and effect from and after its passage and it is so ordained.

On September 16, 1968, the City Council approved a joint resolution with the
City of Benbrook providing for the adjustment of the common boundary and
apportioning certain extraterritorial jurisdiction areas (M&C PZ-298) .
The joint resolution was approved by the City of Benbrook on October 3, 1968,
and Ordinance No. 245 of the City of Benbrook was adopted on October 17, 1968,
disannexing all of the property formerly within the City of Benbrook as re-
quired in the joint resolution. On November 25, 1968, 'the Fort Worth City
Council initiated annexation on a new strip or corridor around Benbrook follow-
ing the proposed common boundary. The annexation of this new corridor was
completed January 27, 1968, by the adoption of Ordinance No. 6036.
As a next step by the City of Fort Worth in implementing the realignment, -Fort
Worth must de-annex those portions of the present strip as required by the
joint resolution. `
The proposed de-annexation consists of three tracts which are portions of the
former corridor around lying within the area apportioned to Benbrook by the
joint resolution adopted on September 16, 1968, and shown on the attached map.
Recommendation
It is recommended that an ordinance be adopted discontinuing territory from
within the corporate limits of the City of Fort Worth in accordance with the
joint resolution adopted by the City of Benbrook and the City of Fort Worth.
