CEAKDERLIN-AMIRGTON HEIGHTS SECOND FILING, AN ADDITION TO THE CITY OF FORT WORTH, TA,RRAL+7`P COUNTY, TEXAS, BE VACATED, ASUMONED AND (`ZSED7 RAOVIDING rOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT NORTH IN SAID LAND? REPEALING ALL ORDINANCES IN COK- FLICT HERENITH7 AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECT ION 1. That Kenley Street from the south line of Donnelly Street south to Geddes Street be and the same is hereby closed, abandoned and persanently vacated as a street or public tboroughfare of any kind or character whatever and that the allays in Blocks 2 and 3. Chamberlin-,Arlington Heights, Second Filing, an addition to the City of Fort Korth, Tarrant County, Texas, each being a width of sixteen (16) feet and a length of five hundred (SOO) feet, be and the same are hereby vacated, closed and pernmaently abandoned as allays or public thoroughfares of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street and alleys is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordiramce shall take effect and be in full force and effect from and after the date of its passage. Subject rights-of-way were acquired by dedication. Donnelly Street is open on the ground and paved, but Kenley Street and the alleys are not open on the ground. If this request is granted, the Applicant will plat the vacated rights- of-way with adjoining property in order to provide for united usage of its land, City departments and private utility companies have reviewed this request and have no objections regarding vacation of Kenley Street and the alleys, provided a replat is submitted and easements are shown thereon for all existing utility and drainage facilities. However, the Traffic Engineering and Public Works Directors believe that Donnelly Street should not be closed, because it is the first of only two paved east-west streets for a distance of approximately 2000 ft. south of the West Freeway Frontage Road (one-way, east bound) that provide direct access to Hulen Street and Arlington Heights High School. Diaz, the second street, is located approximately 600 ft. south of Donnelly: but, because of the north bound traffic on Hulen coming up over the crest of a hill, the intersection at Hulen Street and Diaz is unsatisfactory. The Fort Worth Independent School District, by letter dated March 18, 1970 (copy attached) opposes the closing of Donne.iiy Street. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating all of the public rights-of-way as requested. The City has received a satisfactory replat submitted by the Applicant. Recommendation It is recommended that an ordinance be adopted vacating Kenley Street from Donnelly Street to Geddes Street and the alleys in Blocks 2 and 3, Chamberlin Arlington Heights, 2nd Filing, and that the request for closing of Donnel- ly Street be denied and referred to the Plan Commission and the administrative staff for study of possible alternative solutions' to the problem. With West Rosedale one way East and numerous other streets closed by the Lena Pope Home grounds, even with the present use of Donnelly we are forced to travel many blocks out of the way in order to reach our homes. Should Donnelly be closed, our next possible route (several blocks to the South) would be still further and more dangerous because it crosses Sanguinet on a hill with an obstructed view of traffic from the North. With the acres and acres of unused property which Lena Pape Home already holds, we respectfully request your opposition to the closing of the street with additional hardship to area residents.
