AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
Dallas Avenue
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
UNIT I: DALIAS AVENUE From E. Lancaster Ave. to Canton Dr., known
and designated as Unit I, Project No. 104-
22000-145, a seven-inch thick reinforced concrete
pavement on a six-inch thick lime stabilized
subgrade with seven-inch high concrete curb on
a thirty foot roadway. Six-inch thick concrete
driveways will be constructed where specified.
UNIT I-A: DALLAS AVENUE From Canton Dr. to I.H. 820, known and designated
as Unit I-A, Project No. 104-22000-145, a seven-
inch thick reinforced concrete pavement on a
six-inch thick lime stabilized subgrade with
seven-inch high concrete curb on a forty foot
roadway. Six-inch thick concrete driveways will
be constructed where specified.
UNIT II: SOUTH HAMPSHIRE BLVD. From Weiler Blvd. to Canton Dr., known and
designated as Unit II, Project No. 104-22000-145,
reconstructing a six-inch thick hot-mix asphaltic
concrete pavement on a six-inch thick lime
stabilized subgrade with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a
thirty-six foot roadway. Six-inch thick concrete
driveways will be constructed where specified.
together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewersiand drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with Tarrant Paving Corp. and Haws & Garrett Gen Con., Inc.
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
UNIT I• DALLAS AVENUE From E. Lancaster Ave. to Canton Dr., known
and designated as Unit I, Project No.
104-22000-145.
The estimated cost of improvements is $ Included in Unit I-A the estimated amount
per front foot to be assessed against abutting property and the owners thereof for superimpose

amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ 1.18 per square foot; the total
estimated amount per front foot to be as against abutting property and the owners
thereof is $ 21.25 plus the cost incurred for concrete driveway construction
where specified.
III,
A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any interest in any such pro erty. Such hearing shall be
given and held on the 13`th day of Augus f 19 73 , at 9:30 A.M,
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice ,of the
time and place of such hearing and of other 'matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May 12, 1967. Such notice shall be.by advertisement -inserted
at least three (3) times in a newspaper published in the pity of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing; Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States, Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names bf such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to ,such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be ,improved is listed as "unknown" on the then. current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown,' no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared -and filed with these proceedings a list of the_
properties to be as,sessed,, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed,' together with the last
known addresses determined as aforesaid of the respective owners and those per4
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy ,of the notice of hearing and shall further certify
the date or dates , on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con-
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

concrete curb and gutter is $ 3.08 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ -0- ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- _ wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ 1•18 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the

On Monday, June 25, 1973, a Neighborhood Meeting was conducted by the Engineering Division
of the Public Works Department at the West Handley Elementary School; for the Assessment
Paving at Dallas Ave. and S. Hampshire Blvd.
Procedures concerning proposed improvements, owner participation in cost and methods of pay-
ment were explained by Odell Schmidt to the twenty-seven property owners present.
After this explanation, the meeting was opened for questions and answers.
Unit Is Dallas Avenue from E. Lancaster Avenue to Canton Drive.
Mr. Halaire Rutowski, owner of Lot W92.6-11, Block 1, West Handley Addition and Tract 9, G.N.
Butts Survey,rinquired about the benefits to his property on Lot W92.6-1, Block 1, West
Handley Addition. Mr. Schmidt answered there would be no benefit and therefore no assess-
ment has been levied.
Mr. J. W. Patterson, owner of Lots 3 and 4, A.J. Wilkinson Addition, inquired about the curb
ad 'gutter on his properties and where it began on the West end. Mr. Schmidt explained the
c and gutter began at the west side of Lot 4.
Unit I-Ao ba�s Avenue from Canton Drive to I.H. 820.
A representative for Mrs. Elizabeth Pierce, owner of hots 3 through W20-6, Block 3, West
Handley Addition, inquired about the independent appraisal report and wanted to know if the
report was available for view before the council received it. Mr. Schmidt explained the
report is privileged information prior to the Benefit Hearing. However, information as to
adjusted assesbments will be available in the Assessment Paving office two weeks before the
Benefit Hearing.
Mx�. H.E. Farrell, representing his mother, Mrs. W. S. Farrell, owner of Lots 2 through 5,
Block 5, West Handley Addition, asked why the land was being taken off of the north side
of the street when the south side would profit more from the paving. Mr. Schmidt explained
that the land on the north side was decided on because of location of existing buildings
along the right-of-way. Mr. Farrell also wanted to know how the land being bought would be
valued. Mr. Schmidt explained that the land appraisal would be unbiased and fair market
value would be paid for the required R.O,W. Mr. Farrell asked if there was any way to stop
the traffic from cutting across their property to get to E. Lancaster Ave. from the service
road of I.H. 820. Mr. Schmidt suggested to him to contact the Traffic Engineering Department
and he (Mr. Schmidt) would also bring it to the attention of Public Works and Traffic Engin-
eering.
Mrs. Louise Firmin, owner of E76-Tract 21-C, G.N. Butts Survey, asked if there was any land
being taken off the south side. Mr. Schmidt said there was some land to be bought and the
owners will be paid fair market value.

Unit II: South Hampshire Blvd.
Several of the property owners inquired about the assessment on the driveways. Mr. Schmidt
explained that they would only be charged for the difference of their existing driveways,
and the wider ones to be constructed to meet current driveway requirements.
After a brief general discussion, the meeting was adjourned.

The 1973-75 Capital Improvements Program (page A-27) provides for the
improvement of Dallas Avenue from East Lancaster Avenue to IH 820.
Included in this project is an extensive storm drain system and the
reconstruction of South Hampshire Boulevard from Weiler to Canton.
IMPROVEMENTS
The improvements will consist of widening Unit I, Dallas Avenue, East
Lancaster to Canton Drive, to a 30-foot width and Unit I-A, Dallas
Avenue, Canton to Iti 820 to a 40-foot width by construction of 7"
thick reinforced concrete pavement, with 7" high concrete curb, on a
6" lime stabilized subgrade, along with 6" thick concrete driveways
and necessary storm drain appurtenances. Unit II, South Hampshire,
Weiler to Canton, will be reconstructed by construction of 6" thick
hot-mix asphaltic concrete pavement, 7" high concrete curb and 18"
wide concrete gutter, on a 6" lime stabilized subgrade, along with
6" concrete driveways and necessary storm drain appurtenances.

PROPOSED ASSESSMENTS AND ENHANCEMENT APPRAISALS
Adjacent to Unit I and I-A (Dallas Avenue) , there are several
unusual conditions as related to assessment costs to adjacent
benefitted property. The zoning and use of properties is mixed,
with a number of parcels being vacant. Consequently, an indepen-
dent land appraiser has been employed to determine the enhancement
as a result of the above improvement. The appraiser's report will
be available at the Benefit Hearing as well as the appraiser.
There is no question of enhancement to properties adjacent to
Unit II (Hampshire Boulevard) , since the only assessments prepared
are for curb, gutter and driveways where none now exist.
PROJECT COST AND FINANCING
Based on the low bid and in keeping with standard policy, approxi-
mately $76,440.48 will be assessed against abutting property owners,
to be provided for by a bond fund transfer from Revolving Fund
Unspecified. However, the assessments are subject to change based
on appraisals by the independent land appraisers. Sufficient funds
in the amount of $328,000 are available in Project No. 104-22000-145
for the City's share of street and storm drain construction costs,
right-of-way expenses, inspection engineering and administrative
salaries and miscellaneous expenses, which amount to approximately
$211,114.04. Of this amount $92,844.66 is for street improvements
and $118,269.48 for storm drain construction. The remaining balance
in the project account is for right-of-way acquisition.
