ORDINANCE N0. AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 1.0289 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the Eighth day of July, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the Twenty-Sixth day of June, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 391,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 197.590 square miles on January 1, 1967, and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS,`Ehe h$r.8inafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 0.000024 square miles (1.0289 acres); NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wits PARCEL NO. 1 Being a portion of the James Rogers Survey, Abstract No. 1265, located about 7-1/2 miles southwesterly from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at the westerly corner of Lot 3, Block 2, Ridglea Country Club Estates, a subdivisLon in Tarrant County, Texas; Thence N500091E along the northwesterly line of said Lot 3 a distance of 59.3 ft. to a point in the existing East Boundary Line of the City of Benbrook and the West Boundary Line of the City of Fort Worth; Thence S8003' E along the boundary line between said cities, 112.6 ft. to a point in the southwesterly line of said Lot 3; Thence N390511W along said lot line a distance of 95.7 ft. to the place of beginning and containing 0.065 acre. -2- PARCEL NO. 2 Being a portion of the James Rogers Survey, Abstract No. 1265, located about 7-1/2 miles southwesterly from the Courthouse of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at the northwest corner of Lot 54, Block 3, Ridglea Country Club Estates, a subdivision in Tarrant County, Texas; Thence S800471E along the north line of said Lot 54 a distance of 22.8 ft. to a point in the existing East Boundary Line of the City of Benbrook and the West Boundary Line of the City of Fort Worth; Thence S80031B along said boundary line between said cities, across Lot 54, Block 3, and Serrano Drive a distance of 200.4 ft. to apoint in the north line of Lot 2 in Block 3, Ridglea Country Club Estates, and the south line of Serrano Drive; Thence along said lot and street line northwesterly along a curve to the left, a distance of 5.2 ft. and N83wff a distance of 87 ft. to the northwest corner of said Lot 2; Thence N240131 E a distance of 62.8 ft. to the southwest corner of said Lot 54 in Block 3; Thence N70E along the west line of said Lot 54 a distance of 134.5 ft. to the place of beginning and containing 9968 square feet, 0.229 acre. PARCEL NO. 4 BEGINNING at a point in the northwesterly right-of-sway line of Ridglea Country Club Drive, said point being 326.4 ft. northeasterly of the most southerly southwest corner of Block 6, Ridglea Country Club Estates, an addition in the cities of Fort Worth and Benbrook, Tarrant County, Texas; Thence northeasterly along said northwesterly right-of-away line of Ridglea Country Club Drive a distance of 47.6 ft. to a point for corner, said point being in the common boundary line between the Cities of Benbrook and Fart Worth; Thence N80031W along said common boundary line a distance of 238.8 ft. to a point for corner; Thence S50009tW a distance of 173.4 ft. to a point for corner; Theme S390511E a distance of 203 ft. to the point of beginning and containing 0.5149 acres. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rats part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. w -3- SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. (M&C PZ-2$1) As the first step in annexation by Fort Worth of the area released by Benbrook, it is necessary that a resolution be adopted setting a public hearing to be held not less than ten nor more than twenty days prior to institution of annexation proceedings. Attached is a time table of annexation setting forth the dates of Council action to complete the proposed annexation. NUMBER Between the Cities of Fort 1 nnH ui'403/68 PZ-281 Worth and Benbrook I or BUS Wit KES The Cities of Fort Worth and Benbrook have been requested by the developer to realign the common boundary line which extends thru Ridglea Country Club Estates in order to eliminate the division of residential lots by the corporate boundary. The boundary line in Block 6, zoned for apartment use and on which apartments are under construction, also needs to be realigned so that each building in the com- plex is wholly within one municipality, either Fort Worth or Benbrook. The Fort Worth Plan Commission has reviewed this matter and recommends to the City Council that the common boundary be realigned as shown on the attached plat. The City of Benbrook concurs in t`.e proposed realignment. To implement the City Plan Commission's recommendation for annexation, it will be necessary that: 1) The Fort Worth City Council adopt a disannexation ordinance for the parcels which Fort Worth is releasing; 2) The City of Benbrook adopt a disannexation ordinance for the parcels which Benbrook is releasing; 3) The Fort Worth City Council set a public hearing to consider the proposed annexation and authorize publication of notice of such public hearing to be published one time, not less than 10 nor more thar. 20 days prior to such public hearing, in the official newspaper of the City of Fort Worth; 4) A full and complete public searing be held and closed; The Fort Worth City Council, not less than 10 nor more than 20 days after such public hearing is held and closed, institute annexation proceedings by the adoption on first reading of an annexation ordinance and that such ordinance be published one time in the City of 7 Fort Worth- The Fort Worth City Council adopt the annexation ordinance on second and final reading, not less than 30 days after publication, nor more than 90 days after the first reading.
