HomeMy WebLinkAboutOrdinance 8473 ORDINANCE NO. 94 71 AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING VARIOUS EASEMENTS IN THE HIGHLAND PARK TOWNHOMES ADDITION, SAID EASEMENTS BEING THE 10 FOOT BY 30 FOOT UTILITY EASEMENT IN LOT 6, BLOCK 1, THE 10 FOOT BY 13 FOOT UTILITY EASEMENT IN LOT 8, BLOCK 1, THE 10 FOOT BY 15 FOOT UTILITY EASEMENT IN AND BETWEEN LOTS 20 AND PART OF 38-C, BLOCK 1, A 10 FOOT BY 5 FOOT UTILITY EASEMENT IN LOT 37, BLOCK 1 AND THE 10 FOOT BY 9 FOOT UTILITY EASEMENT IN LOT 10, BLOCK 2; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the below described easements be and the same are vacated, abandoned, permanently closed and extinguished for easement or other similar purposes: A. The 10 foot by 30 foot utility easement in Lot 6, Block 1, Highland Park Townhomes Addition. B. The 10 foot by 13 foot utility easement in Lot 8, Block 1, Highland Park Townhomes Addition. C. The 10 foot by 15 foot utility easement in and between Lots 20 and part of 38-C, Block 1, Highland Park Townhomes Addition. D. The 10 foot by 5 foot utility easement in Lot 37, Block 1, Highland Park Townhomes Addition. E. The 10 foot by 9 foot utility easement in Lot 10, Block 2, Highland Park Townhomes Addition. SECTION 2. That the fee to the lands in the above described vacated utility easements is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. The subject utility easements, acquired by dedication, are platted but contain n utility facilities. The subject vacation request is made in order to expand the building area and provide more usable yard space. Reviewing City departments and private utility companies have raised no objec- tions to this request. Recommendation It is recommended that an ordinance be adopted vacating the subject utility easements in Lots 6, 8, 20, Part of 38-C and 37, Block 1, and Lot 10, Block 2, Highland Park Townhomes Addition.
