AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING THE 15 FOOT WIDE EAST/WEST UTILITY EASEMENT LOCATED ACROSS LOT 14-R-1, BLOCK 1, LUTHER'S CREEK ADDI- TION; RETAINING AN EASEMENT FOR SANITARY SEWER PURPOSES; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 15 foot wide east/west utility easement located across Lot 14-R-1, Block 1, Luther's Creek Addition, from the east boundary line of a 10 foot wide north/south utility easement, the centerline of which is the common property line between Lots 14-R-1 and 15-R-1 of the aforesaid addition, eastward 100 feet to the west boundary line of a 15 foot wide north/south sanitary sewer easement located in Lot 14-R-1 of the aforesaid addition, be and the same is vacated, abandoned, and permanently closed and extinguished as a utility easement, PROVIDED, however, that an easement is retained for sanitary sewer purposes along and across the here inbe fore-des cribed 15 foot wide east/west easement property. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that an easement is retained for any and all existing and prospective sanitary sewer facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. The subject vacation request is made in order to remove the possibility that other utility facilities may be installed within the subject utility easement by deleting its designation as a •- utility easement and redesignating said easement as a sanitary sewer easement. It is the opinion of the Real Property Department that the rights and interest of the City in the utility easement denoted in this request has no monetary value, if vacated._ Other reviewing City departments and private utility companies have raised no objections to this request, provided the subject ease- ment is retained and redesignated as a 15' wide sanitary sewer easement. Recommendation It is recommended that an ordinance be adopted vacating the 15' wide east/west utility easement in Lot 14-R-1, Block 1, Luther's Creek Addition.
