Q� AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING THE 700 BLOCK OF DENNY STREET, A 20 FOOT WIDE PUBLIC STREET RIGHT-OF-WAY, FROM INTERSTATE HIGHWAY 35 WEST (SOUTH FREEWAY) EASTWARD TO MISSOURI AVENUE; PROVIDING FOR RETENTION OF EASEMENTS FOR UTILITIES; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 700 Block of Denny Street, a 20 foot wide public street right-of-way, from Interstate Highway 35 West (South Freeway) eastward to Missouri Avenue, be and the same is vacated, abandoned, and permanently closed and extinguished as a public street right- of-way. SECTION 2. That the fee to the land in the above described vacated public street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full farce and effect from and after the date of its passage, and it is so ordained. The subject vacation request is made in order to replat the vacated right-of—way with adjacent property, thus expanding the building area and providing more usable yard space. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated right-of-way being replatted with adjacent property, and being retained/dedicated as a .ow utility easement for the existing utilities. A satisfactory replat, which retains and dedicates the necessary and appropriate easements, has been submitted. Since the subject vacation request was submitted on June 1, 1983, it is not subject to the recently adopted remuneration policy. Reviewing City departments and private utility companies have raised no objections to this request. The City Plan Commission has reviewed this request and recommends that the subject street right-of--way be vacated, as requested. Recommendation It is recommended that an ordinance be adopted vacating the 700 block of Denny Street as recommended by the City Plan Commission.
