HomeMy WebLinkAboutOrdinance 9673 ORDINANCE NO. 9G IS AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF COOKS LANE AND SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUITING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing thereon the following, to wit: COOKS LANE From I.H. 30 to John T. White Road, known and (UNIT III) designated as Project No. 30-023171-00, Unit III, a seven-inch thick reinforced concrete pavement with a seven-inch high attached concrete curb on a six-inch thick lime stabilized subgrade, so that the finished roadway will consist of two thirty-six feet wide traffic lanes with a twenty-eight foot wide median. Seven-inch thick reinforced concrete turn lanes and six-inch thick concrete driveway approaches will be constructed where required. -1- together with concrete curbs, gutters, driveways and incidentals to such improvements on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefore; contract therefore has been made and entered into with J.L. BMIP M CONSTRUCTION AND ENGINEERING, INC. , and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of streets, avenues, and public places hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: COOKS LANE From I.H. 30 to John T. White Road, known and designated as Project No. 30-023171-00, Unit III. The estimated cost of improvements is $401,170.96 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb is $2.55 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $ 58.41 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for -0- wide concrete sidewalk is $ 0.00; the estimated amount per square foot to be assessed against abutting property and the owners thereof for six-inch thick concrete driveway is $ 3.05 per square foot; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 65.55* , plus the cost incurred for concrete driveway construction where specified. *Includes Street Lights. . .. . . .. . . .$4.59 III. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the 5th day of August , 1986, at 10:00 a.m., in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or cause to be given notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, emergency effective May 12, 1967. Such notice shall be by advertisement inserted at least three (3) times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least twenty-one (21 ) days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended. The City Secretary is further directed to give or cause to be given personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States Mail at least fourteen (14) days before the date of the hearing, postage prepaid, in envelopes addressed to all persons owning or claiming any interest in the respective properties abutting the highways, streets, avenues and public places or portions thereof to be improved, as the names of such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or portion or portions thereof which is to be improved is listed as "unknown" on the then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no notice need be mailed. In those cases where the owner is shown to be an estate, the mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be prepared and filed with these proceedings a list of the properties to be assessed, the names of those person owning or claiming any interest in said properties to whom the notice was mailed, together with the last known addresses determined as aforesaid of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties in said list whose address is shown on the then current rendered or unrendered tax rolls of the City of Fort Worth was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of each notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. -3- IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. BACKGROUND On May 30, 1980, (M&C G--4548), the City Council approved the 1980-81 CIP and authorized the Transportation and Public Works Department to begin engineering design for street and storm drainage improvements, including the design of Cooks Lane from John T. White Road to Brentwood Stair. DATE REFERENCE SUBJECT: AWARD OF CONTRACT - COOKS LANE PAGE NUMBER 7-8-86 C- IMPROVEMENTS FROM I.H. 30 TO 20} 3 (UNITJOHN T_ WHIT ROAD II On August 18, 1980, (M&C C-5219), the City Council authorized the City Manager to execute a contract with Rady and Associates, Inc. , for design services (City Secretary Contract No. 11246). The cost of the right-of-way required for this project exceeded the original estimates and thus reduced the funds available for construction. Consequently, on April 24, 1984, (M&C C-8344), the City Council authorized the reorganization of the project for advertisement and construction in the following order as construction funds permitted: 1. Cooks Lane-I.H. 30 Interchange (Unit I) 2. Cooks Lane from Brentwood Stair Road to I.H. 30 Interchange (Unit II) 3. Cooks Lane from I.H. 30 Interchange to John T. White Road (Unit III) Unit II is complete, and Unit I is substantially complete. This M&C pertains to Cooks Lane from I.H. 30 Interchange to John T. White Road (Unit III) only. PROJECT DESCRIPTION ROADWAY R.O.W. STREET LIMITS WIDTH-FEET WIDTH-FEET Cooks Lane I .H. 30 Interchange 2-36' Lanes 120 (Unit III) to John T. White with 28' Median Road IMPROVEMENTS This segment of Cooks Lane will be improved with 7" thick reinforced concrete pavement with attached concrete curb and driveway approaches where required. Storm drains will be constructed as part of the street improvements. There will be two median openings (one standard and one directional) that have been re- quested as part of the street construction by the affected property owners. Their cost will be prepaid. In addition, required street lighting will be in- stalled in a future contract, possibly utilizing city crews; however, adjacent property owners will be assessed for the street lighting at this time based on the engineer's estimate. RECEIPT OF BIDS Bids for this project were received on May 22, 1986, after being advertised on April 10, 17 and 24, 1986, with 70 working days allotted to complete the project. Asphalt, Inc. $397,287.03 Marriott Construction Inc. $401,589.20 PROJECT COST AND FINANCING In accordance with the Standard City Policy in effect at the time the project was approved by City Council and the low bid unit price, the proposed assess- ment against adjacent property is $138,819.62, of which $126,617.11 is for paving and $12,202.51 is for street lights. This amount will be provided by a bond fund transfer from Special Assessments Fund 94, Project No. 009905-00, Special Assessments Unspecified (in which sufficient funds are available) to Project No. 02317100, Cooks Lane Unit III in the amount of $126,617.11 and to Project No. 03240-00, Cooks Lane Unit III Street Lights, in the amount of $12,202.51. Cost of the two median openings benefiting adjacent private property, $15,191.52, will be pre-paid by the property owners prior to con- struction. Cost to the City for street construction is approximately $241,810.33 which in- cludes $21,714.28 for estimated engineering inspections and administration costs. Sufficient funds are available in Street Improvements Fund 30, Account No. 023171-00, Cooks Lane, John T. White to Brentwood Stair Road, to provide for the City's share of street construction costs. Expenditures will be made from Index Code 680405. The cost for street light installation is estimated at $17,552.01, of which $12,202.51 is to be assessed against adjacent property. The property owner's share is to be transferred from the revolving fund to Project Account No. 30-032340-00, Cooks Lane, Unit III, Street Lights. Funding for the City's share of street light installation will be provided at the time of that contract award.
