AN ORDINANCE DECREASING THE UNDESIGNATED FUND BALANCE
OF THE GENERAL FUND OF THE CITY OF FORT WORTH FOR
FISCAL YEAR 1986-1987 BY $50 ,000 AND APPROPRIATING
SAID SUM TO ACCOUNT NO. 90-55-00 , CONSULTANT FEES ,
FOR THE PURPOSE OF PROVIDING FUNDS FOR THE MEDIATION
OF THE DISPUTE CONCERNING THE EXPANSION OF INTERSTATE
HIGHWAY 30 IN FORT WORTH; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the undesignated General Fund balance of the General
Fund of the City of Fort Worth for fiscal year 1986-1987 is hereby
decreased by appropriating $50 ,000 to Account No. 90-55-00 , consultant
fees , to provide funds for mediation of the dispute concerning the
expansion of Interstate Highway 30 in Fort Worth.
SECTION 2.
Should any portion, section or part of a section of this
Ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judg-
ment shall in no way impair the remaining portions , sections or
parts of sections of this Ordinance , which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
That this Ordinance shall be cumulative of Ordinance No .
9690 and all other ordinances and appropriations amending the same
except in those instances where the provisions of this Ordinance
are in direct conflict with such other ordinances and appropriations ,
in which instances said conflicting provisions are hereby expressly
repealed.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this Ordinance by copying the caption and
effective date of this Ordinance in the minutes of the City Council
and by filing the Ordinance in the ordinance records of the City.
SECTION 5 .
That this Ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so or-
dained.

_ RECOMMENDATION:
It is recommended that:
1'. The City Council adopt the attached supplemental- appropriation
ordinance appropriating $50,000 from the Fund Balance of the
General Fund to General Fund account 90-55-00, Consultant Fees,
and;
2. The City Council authorize payment of $50,566.91 to The Conflict
Clinic, Inc. for City participation in mediation of the I-30
expansion dispute.
BACKGROUND:
As the lack of concensus among both public and private interests
concerning the I-30 expansion became more pronounced, it became
apparent to the parties involved that the situation required a
creative approach to cooperative problem solving. A process known as
Negotiated Investment Strategy (NIS) had successfully been used in
similar disputes across the nation. NIS is a way to solve problems,
resolve conflicts, develop plans for joint action, and implement those
plans by involving all affected interests,, government agencies, and
public and private orgainizations in mediated negotiation.
The Conflict Clinic, Inc. is an independent not-for-profit corporation
working in collaboration with the Program on Negotiation at Harvard
Law School to improve the practice of conflict resolution in disputes
of public concern and is recognized as unique in the application of
dispute resolution strategies such as Negotiated Investment Strategy.
The Conflict Clinic was invited to participate in the I-30 dispute.
The Clinic's participation has been identified in three phases. Phase
I involved analysis of the conflict and development of the
negotiations process. The $22,217.30 in expenses for Phase I have
been paid for by the National Institute for Dispute Resolution. Phase
II covers meetings of the I-30 Working Group from 2/4/86 to 12/18/86.
The $50,566.91 in expenses for this phase is the amount of
participation provided by the City of Fort Worth. Phase III involves
the remaining expenses of services to the I-30 Working Group, through
August 31, 1987, and will be paid by the Texas Department of Highways
and Public Transportation. Reimbursement to the Conflict Clinic for
any expenses beyond August 31st will be included in a request for
extension of their agreement with the Highway Department.

Prior to the involvement of the Conflict Clinic, the interest of the
various parties seemed diverse to the extent that an amicable
resolution appeared unlikely. Now, after approximately a year and
a-half, the consensus of the various parties is that the Clinic has
fostered a sense of cooperation and mutual respect and that a
resolution will be reached to the benefit of all of Fort Worth's
citizens.
FINANCING:
To provide financing for the City's committment to resolving the I-30
dispute will require a supplemental appropriation of $50,000 from the
Unappropriated Fund Balance of the General Fund to General Fund
Account 90-55-00, Consultant Fees. After this appropriation the
amount of the Unappropriated Fund Balance will be $23,456,605.
