HomeMy WebLinkAboutOrdinance 10374 ORDINANCE NO. /Cl/ AN ORDINANCE AMENDING SECTIONS 35-57 (a) AND 35-57 (b) , OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH ( 1986 ) , AS AMENDED, BY REVISING CERTAIN RATES AND CHARGES ; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1 . That Section 35-57 (a) of Chapter 35 of the Code of the City of Fort Worth ( 1986 ) , as amended, be and the same is hereby amended and, after having been amended, shall be and read as follows : "Sec . 35-57 . Connection charge. (a) A minimum charge per month, or fraction thereof, shall be made for each connection with the water mains or sewer mains of the city waterworks . This charge shall be based on the size of the meter through which water is furnished regardless of source and shall be as follows : SCHEDULE A. WATER SERVICE ONLY The minimum monthly charge shall be equal to and be the same as the monthly service charge contained in section 35-56 (b) of this chapter. - 1 - FIRE LINE SERVICE Connection Monthly size (inches ) Charge 4 and under $ 16 . 95 6 25 . 50 8 33 . 95 10 56 . 40 12 105 . 10 ( 1) Fire line meters . The monthly charges for connections to unmetered, automatic sprinkler system, or other fire lines installed and used for fire protection shall be as set out in the chart under Schedule A above. Charges for sizes larger than twelve ( 12 ) inches will be determined by the Director of the Water Department. When it is determined that water has been or is being used through or from an unmetered automatic sprinkler system for purposes other than for fire fighting, the consumer shall pay the full cost of a meter installation on the fire line. All fire protection systems used exclusively for fire-fighting purposes and provided with outlets other than standard closed sprinkler heads shall be provided with detector-type check valves at customer's cost before connection with the water mains of the city. In the event it is determined that water is used through such detector check valves for purposes other than for fire fighting, the detector check valve installation shall be replaced with a standard meter with the consumer paying the full cost of the meter installation. ( 2 ) Meter sizes . Only one ( 1) five-eighths-inch by three-fourths-inch meter shall be attached to and served by a three-fourths-inch tap. No more than two ( 2 ) five-eights-inch by three-fourths-inch or one ( 1) one-inch meter shall be attached to and served by a one-inch tap. Not more than one ( 1 ) one - and - one - half - inch or three ( 3 ) five-eighths-inch by three-fourths-inch or three ( 3 ) one-inch meters shall be attached to and served by a one-and-one-half-inch tap. Not more than one ( 1) two-inch, four (4 ) one-inch or six ( 6 ) five-eights by three-fourths-inch meters shall be attached to and served by a two-inch tap. - 2 - ( 3) Seasonal meters . Customers using a separate water meter for one ( 1) or more seasonal purposes (such as lawn watering, but not being limited thereto) shall pay the minimum monthly charge prescribed in this section for each meter throughout the year, whether such service is active or not. If such service is disconnected at the request of the customer and the customer requests that the service be reconnected within the next twelve ( 12 ) months , a reconnection charge shall be paid equivalent to the monthly minimum charge times the number of months that such service has been disconnected. " SECTION 2 . That Section 35-57 (b) of Chapter 35 of the Code of the City of Fort Worth ( 1986) , as amended, be and the same is hereby amended and, after having been amended, shall be and read as follows: " (b) A charge shall be made by the city water department for each tap made to a water main for a connection, which charge shall be determined by the size of the connection and the character of the surface of the street in which the connection is to be located. For each 1-inch branch, add $110 . 00 . Any water connection larger than two (2 ) inches shall be made under contract between the customer and the city. Total material and installation costs of the tap and meter or meters, including multiple meter settings instead of a three-inch or larger meter setting , shall be paid by the customer . Payment shall be based on the cost estimated by the water department, acting by and through the director of the water department . Developers will pay the full cost of all water service taps constructed by contract in new developments . All water meters connected directly to the city ' s water system on and after the effective date hereof shall be the property of the city. A property owner may request that the water meter providing service to the owner ' s property be reduced in size. A charge shall be made by the city water department for each reduction of size of the water meter. The charge to be made for water meter reduction shall be based on the following schedule , and the charge shall be payable in advance: WATER METER REDUCTION Size Reduction Charge ( inches) 1 to 3/4 $40 . 00 1-1/2 to 3/4 70 . 00 1-1/2 to 1 70 . 00 2 to 1-1/2 90 . 00 2 to 1 90 . 00 When requested to do so, city forces may install building sanitary sewer taps and sewer service laterals which are intended for connection to the city sanitary sewer system, and the requesting party shall be required to pay a fee for such installation according to the schedule provided below. Fees are based on the size of the connection and the character of the surface of the - 4 - street in which the connection is located, and shall be payable when application for installation is made. Preinstallation plans must be approved by the water department . Such approval shall include approval of any contractors who intend to perform the installations . The water department shall provide the applicant with a written description or sketch showing the approximate location of the sanitary sewer serving the property. All installations must be approved by the water department before connection to the sanitary sewer system is made. The city maintains in part of the downtown area a separate sanitary sewer system to serve the basements of the buildings located in that area. The separate system is referred to as the deep sewer. The construction of the sewer tap and/or the sewer service lateral shall be done by the city forces, provided that where the sewer service lateral can be constructed without cutting the surface of the public street , the plumber or person holding the permit may be permitted by the plumbing inspector to construct the sewer service lateral in accordance with requirements of the city plumbing code and all other applicable ordinances of the city, subject to the approval of the plumbing inspector . Any work done by city - 5 - forces in making a deep -sewer connection shall be paid for by the plumber or other person holding a plumbing permit relating to such deep sewer connection. The above charges shall be in addition to the applicable fee or fees provided for in the city plumbing code. No plumbing permit for work which involves the construction of the sewer tap and/or sewer service lateral shall be issued until the charges have been paid and receipt evidencing such payment is presented to the person issuing the plumbing permit. " SECTION 3 . This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas ( 1986 ) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4 . It is hereby declared to be the intention of the City Council that the sections , paragraphs, sentences, clauses and phrases of this ordinance are severable , and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases , clauses , sentences, - 6 - paragraphs and sections of this ' ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5 . The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 6 . That this ordinance shall become effective and be in full force and effect from and after its passage; provided, however, that the increased rates specified herein shall apply to fireline service statements sent by the City of Fort Worth and all water and sewer tapping fees charged on or after October 1, 1989, and it is so ordained.
