AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A FIVE FOOT (5) WIDE UTILITY EASEMENT TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the utility easement measuring 5 feet in width and containing 2679.68 square feet in area as recorded in Volume 388-199, Page 95, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Being a 5' utility easement as recorded in Volume 388-199, page 95, Plat Records, Tarrant County, Texas, situated within Lot 1,Block 2, Cityview Addition to the City of Fort Worth, Tarrant County, Texas, said easement abandonment being more particularly described as follows: Beginning at the northwest property corner of Lot 1, Block 2, Cityview Addition, said corner also being in the east R.O.W. line of Bryant Irvin Road; THENCE North 83° 48' 08" East, a distance of 198.00 feet; THENCE South 05° 16' 06"East a distance of 152.72 feet; THENCE South 34' 06' 08"West a distance of 209.70 feet; THENCE North 500 43' 54" West a distance of 5.02 feet; THENCE North 34° 06' 08" East a distance of 207.48 feet; THENCE North 050 16' 06" West a distance of 145.85 feet; THENCE South 83° 48' 08"West a distance of 194.13 feet to the West R.O.W. line of Bryant Irvin Road. DISCUSSION: Cityview Partners L.P., owner of the subject property, has requested that the City vacate the above described utility easement. The subject easement, acquired by dedication, contains no utility facilities. Reviewing City departments and private utility companies have raised no objections to this request. A replat is not required for this request. This request is located in COUNCIL DISTRICT 3. FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the interest of the City of Fort Worth in this request.
