ORDINANCE NO. Z-2g AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A STREET RIGHT-OF-WAY, HOMEACRES ADDITION, TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the easterly segment of Wilkes Drive, from Carey Road to Wilbarger Street, approximately 50 feet wide by 328 feet in length, and containing 16, 400 square feet lying south of Lots C, 13, 14, and 15, Block 7, Homeacres Addition, as recorded in Volume 388A, Page 10, Plat Records of Tarrant County, Texas, and north of the Freedom Baptist Church, Tracts 33 and 33A and F, as recorded in Volume 6764, Page 1917, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. 'SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: The Transportation and Public Works Department of the City of Fort Worth, as a result of a land swap transaction with Freedom Baptist Church for Wilbarger Street widening, has, on behalf of Freedom Baptist Church, requested that Wilkes Drive (formerly Bowman Springs Road), as described above, be vacated to facilitate building expansion by the Freedom Baptist Church. The street portion to be vacated, as acquired by dedication, contains water, sewer, gas, cable and electric facilities. Reviewing City departments and public utility companies have raised no objection to this request, and provisions have been made for incorporating the necessary utility easements within a previously submitted replat of the properties in question. The adjacent property owners have either relinquished their rights of acquisition, or have agreed to acquire said street. This request is located in COUNCIL DISTRICT 5. FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that a one dollar ($1.00) fee satisfies the interests of the City.
