HomeMy WebLinkAboutContract 44744-T1 Date Received: Jul23,2019 City Secretary No.: 44744-T1 Time: 1:11 PM TERMINATION OF CITY SECRETARY CONTRACT NO. 44744 A MEMORANDUM OF UNDERSTANDING BETWEEN SUN VALLEY INDUSTRIAL PARK, L.P.AND THE CITY OF FORT WORTH This TERMINATION OF CITY SECRETARY CONTRACT NUMBER 44744 ("Termination"), is made and entered into by and between the City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas, acting by and through its duly authorized Interim Assistant City Manager, and Sun Valley Industrial Park, L.P. ("Developer"), a Texas limited partnership, acting by and through its duly authorized representative. WHEREAS, on August 21, 2013,the City and Developer entered into a Memorandum of Understanding relating to the design and construction of improvements to Marie Jones Road,Vesta Farley Road, and Kalternbrun Road to accommodate increased traffic and provide regional drainage improvements, City Secretary Contract Number 44744; and WHEREAS, during the design of the improvements contemplated by City Secretary Contract No. 44744 it was determined that the improvements could cause an increased risk of flooding for the area known as Sun Valley Industrial Park; and WHEREAS, the City entered into an agreement with Dunaway Associates, L.P. ("Dunaway"), City Secretary Contract Number 46506, for Dunaway to conduct a Sun Valley Regional Drainage Study to develop a conceptual regional storm water management solution for Sun Valley Industrial Park; and WHEREAS, Dunaway was retained by Empire, Texas Equities, Ltd. An affiliate of Developer, as the design consultant for Developer's proposed plan for future development in Sun Valley Industrial Park; and WHEREAS, City, Developer, and affiliated entities of Developer have entered into a Development Agreement, City Secretary Contract Number 52513, and a Community Facilities Agreement,City Secretary Contract Number 52536,related to the construction of a public regional detention pond and a private linear detention pond to address flooding in Sun Valley Industrial Park; OFFICIAL RECORD TERMINATION OF CITY SECRETARY CONTRACT NO.44744 CITY SECRETARY A MEMORANDUM OF UNDERSTANDING BETWEEN SUN VALLEY INDUSTRIAL PARK,L.P.AND FT. WORTH,TX THE CITY OF FORT WORTH NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, City and Developer agree as fol'ows: 1. The Recitals are true and correct and are incorporated herein by reference. 2. City Secretary Contract Number 44744 is hereby terminated in its entirety.
