HomeMy WebLinkAboutOrdinance 2974 ORDINANCE NO. � AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 5, J. P. SMITH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. WHEREAS, it appearing to the City Council of the City of Fort Worth that the alley in Block 5, J. P. Smith Addition to the City of Fort Worth, Tarrant County, Texas, has never been used by the public and that it is to the best interest of the public that said alley be closed, abandoned and vacated as a public thoroughfare and the fee to the land in said alley revert as provided by law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley in Block 5, J. P. Smith Addition to the City of Fort Worth, Tarrant County, Texas, from Henderson Street to Florence Street, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the fee to the land in said alley above described is hereby released and will revert to the owners as provided by law, save and except that an easement is reserved for all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and ef- fect from and after the date of its passage. Jones Re: Request for Closing the alley City Manager in Block 5, J. P. Smith Addition. Building Dear Sir: You will find attached a petition signed by Mr. V. M. Monticue, Financial Secretary of the First Methodist Church of Fort Worth, and the other adjacent owners requesting the closing of the alley in Block 5, J. P. Smith Addition. We are attaching a plat which shows the location of this alley. There is an existing 611 sanitary sewer main and an existing 4" gas main in the alley. However, this alley has never been open for public use. The Church people have purchased a tract on the north side of the alley and one on the south side of the alley and plan on using this tract of land for a parking lot. They make the statement that they have no intention of building over the alley and if they should build over the alley, at some time in the future, they would make arrangements to replace the existing sanitary sewer with a cast iron line under the building. Our recommendation is that the alley in Block 5 of the J. P. Smith Addition from Henderson Street to Florence Street be closed as requested and that an easement for all existing util- ities be retained. Yours very truly, I C. M. Tones, City Manager City of Fort Worth City Hall Fort Worth, Texas Dear Sir: The First Methodist Church of Fort Worth, Texas is purchasing from 0. W. Conditt a tract of land out of the Northeast corner of Block 5 of the 1. P. Smith Addition to the City of Fort Worth, Tarrant County, Texas facing 100 feet on Second Street and 110 feet on Florence Street. They are also purchasing a tract immediately South of this tract facing 50 feet on Florence Street and running back 100 feet. There is a ten-foot alley running between these two tracts which is desired on the part of the undersigned, to be closed. For your information the two tracts are to be used as a parking lot for the Church, and the Church has no present intention of erecting improvements on the proper- ty. Accordingly, the undersigned, being all of the owners of the property adjacent to and near the alley, request that this alley be vacated by proper ordinance of the City Council of the City of Fort Worth. It is our understanding that a sanitary sewer runs down this alley, and in the event it should become necessary to erect improvements on any part of the property now designated as an alley the undersigned property owners agree to pay for the installation cost of an iron pipe to replace the present sewer pipe that may run under any building or such improve- ments placed thereon, or to prorate the expense of relocat- ing said sewer. We would appreciate your efforts in our behalf in se- curing the vacation of the alley as herein set out at the earliest possible date.
