HomeMy WebLinkAboutOrdinance 3574 ORDINANCE No. J40' !V AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 44 R, SEMINARY HILL ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED AND THAT THAT PORTION OF MCCART STREET LYING AND BEING BETWEEN THE EASTERLY LINE OF THE NEW McCART STREET AND THE WESTERLY LINE OF BLOCK 43-R, SEMINARY HILL ADDITION, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IhKOIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley in Block 44-R, Seminary Hill Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever; and that that portion of McCart Street lying and being between the easterly line of the new McCart Street and the westerly line of Block 43-R, Seminary Hill Addition, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. SECTION 2. That the fee to the land in said alley and street is hereby released and will revert to the adjacent owner as provided by law. SECTION 3• That all ordinances or parts of ordinances in conflict herewith are hereby repealed.. SECTION 4. Davis Re: McCart St. R.O.W. south of Covert St., City Manager Street and Alley Closing, Blocks 44-R Building and Lk3-R, Seminary Hill Addition. Dear Sir: Attached is a letter dated October 17, 19560 signed by Mr. Jack D. Howell with the Southwestern Investment Co. of Fort Worth, requesting steps be taken to realign and widen McCart Street right-of-way south from Covert Street as per plat attached and as per tentative agreement. In order to realign and widen McCart Street through Blocks 43-R and 44-R, Seminary Hill Addition, it was necessary for certain changes to be made in the two blocks. We have had an agreement with Mr. Howell that if he would resubdivide the land and provide the 70 ft. right-of-way for McCart Street as shown on the attached plat that we would recommend that the City deed to the Southwestern Investment Co. of Fort Worth the remaining portion of Lot 15, Block 44.-R which the City now owns. Mr. Howell has had the Plat prepared for Plan Commission approval. The Plan Commission feels that the Council should take action closing the portion of McCart Street that is no longer needed and for closing the alley in Block 44-R. We see no reason why the closing should not take place since neither the alley nor the street has ever been opened for public use. Our recommendation is that authority be granted for the conveyance of Lot 15, Block 4 -R, Seminary gj7l :addition, to the Southwestern Investment Co. of Fort Worth, and the closing of the alley in Block 44-R, Seminary Hill Addition, and the closing of that portion of McCart Street lying and being between the easterly line of the new McCart Street and the westerly line of Block 43-R, Seminary Hill Addition, for and in consideration for the new 70 ft. right-of- way of McCart Street between Blocks 44.-R and 43-R, Seminary Hill Addition. Thelin Director Public Works Gity of Fort Worth Fort Worth, Texas Dear Mr. Thelin: We have finally replatted Blocks 43 and 44 Seminary Hill to conform with your proposed rerouting of McCart Street. As you will recall, we were to receive a deed from the City for Lot 15 Block 44 Seminary Hill and in return we would replat the two blocks providing the additional width for McCart Street under its new location. The City Plan Commission has approved this plat; however, they feel that the City Council should take such action as is necessary to close that portion of McCart Street outside of the new right-of-way and the alley in Block 44. As soon as this has been done and Lot 15 conveyed to this company, we will place the plat of record. We are enclosing for your use -aa — plat showing the new location of McCart Street.
