AN ORDINANCE AMENDING SECTIONS 9 AND 10 OF ORDINANCE NO. 3241, BEING AN ORDINANCE ADOPTED FOR THE PRESERVATION OF THE HEALTH, SANITATION AND SAFETY OF THE PUBLIC BY PROVIDING FOR THE OOL- LECTION, REMOVAL AND DISPOSAL OF GARBAGE, TRASH AND RUBBISH WITHIN THE CITY OF FORT FORTH, TEXAS; FIXING SCHEDULES OF REA- SONABLE CHARGES TO BE MADE AGAINST OWNERS, OCCUPANTS, TENANTS AND LESSEES OF BUILDINGS AND PREMISES IN WHICH GARBAGE, TRASH AND RUBBISH ARE COLLECTED; PROVIDING A SAVINGS CLAUSE; REPEAL- ING ALL ORDINANCES IN CONFLICT HEREWITH; PRESCRIBING A PENALTY FOR THE VIOLATION THEREOF; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 9 of Ordinance No. 3241 shall be amended and, after be- ing so amended, shall read as follows: SECTION 9. Charges for collection and removal - Residential s and premises. The collection and removal of garbage and trash from houses, buildings and premises used for residential purposes shall be made three times each week. Fair and reasonable charges for this residential service shall be and are shown in terms of dollars and cents as follows: Rate For a single family residence $1.50 For a duplex apartment building 2.50 For a garage apartment unit 1.25 Group housing - 3 or more houses on same water meter or multiple family apart- ment building - For each house unit or apartment 1.25 For a trailer occupied as a housing unit 1.25 SECTION 2. That Section 10 of Ordinance No. 3241 shall be amended and, after be- ing so emended, shall read as follows: SECTION 10. Same - Business and ccumercfal buildings and premises. The collection and removal of garbage and trash from houses, buildings and premises used for commercial and business pur- poses shall be divided into sixteen classes. Class I to VIII, inclusive, shall embrace all commercial and business institu- tions from which garbage and trash are ordinarily removed six days each week. Class I-A to VIII-A, inclusive, shall comprise those ordinarily receiving this service three days each week. Charges for this commercial and business service, which are fair and reasonable, shall be as follows: Class I $15.00 Class IA $7.50 Class II 10.50 Class II-A 5.25 Class III 7.50 Class III-A 3.75 Class IV 6.00 Class IV-A 3.00 Class V 5.25 Class VA 2.65 Class VI 4.50 Class VI-A 2.25 Class VII 3.75 Class VII A 1.85 Class VIII 3.00 Class VIII A 1.50 After a careful survey and investigation, the business and commercial institutions in the City have been divided into fair and reasonable classifications. In the diagram or schedule hereinafter appearing, certain numbers are shown in the column under each class. SECTION 3. Should any part, section, subsection, paragraph, sentence, clause or phrase contained in this ordinance be held to be unconstitutional, such holding shall not affect the validity of the remaining portion thereof, but in all respects said remaining portion shall be and remain in full force and effect; and the City Council hereby declares that it would not have passed the unconstitutional part had it known it was invalid and that it would have passed the remaining part that is not invalid. SECTION 4. That this ordinance shall be cumulative of all provisions of all ordi- nances of the City of Fort Worth relating to the collection, removal and disposal of garbage, trash and rubbish, except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances, in which instances said conflicting provisions of other ordi- nances are hereby repealed. SECTION 5. Any person, firm or corporation violating any of the provisions of this ordinance shall be fined in any sum not to exceed Two Hundred Dollars ($200.00), and each day's violation shall constitute a separate offense. SECTION 6. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law.
