HomeMy WebLinkAboutOrdinance 5574 i ORDINANCE AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 8.21 SQUARE MILES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexa- tion of the following described territory: BEING a tract of land situated about 7 miles northeast from the Courthouse of Tarrant County, Texas, and lying in the M. Johnson Abstract No. 858, A.Beard Abstract No. 137, David Odum Abstract No. 1184, J.M. Robinson Abstract No. 1345, 1. N. Stapp Abstract No. 1422, W.E. Dewees Abstract No. 396, J.H. Walker Abstract No. 1707, D.E. Norton Abstract No. 1168, A. Smith Abstract No. 1419, J.A. Walker Abstract No. 1738, R. Morris Abstract No. 1036, J. McComas (North) Survey 300 feet to the place of beginning and containing approximately 8.2 square miles. was held at the City Council Chamber in the City Hdll of Fort Worth Texas, on the 2nd day of May, 1966, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circula- tion in the City of Fort Worth, Texas, and in the above described territory on the 21st day of April, 1966, which date was not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas is 391,000 inhabitants; and WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the territory above described lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory above described contains 8.21 square miles more or less; and WHEREAS, a petition has been signed by owners of land in the above described territory requesting the annexation of such territory by the City of Fort Worth, Texas, and such petition has been filed with the City Council, now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas is hereby added and annexed to the City of Fort Worth, Texas and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: BEING a tract of land situated about 7 miles northeast from the Courthouse of Tarrant County, Texas, and lying in the M. SECTION 2 The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3 That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4 If any section, subsection, clause, sentence, phrase, or word of this ordinance is f9r any reason held void or unconstitutional by a court of competent jurisdiction, smch invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words, except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5 This ordinance shall be in full force and effect from and after the date of its, passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVI11 of the Charter of the City of Fort Worth and it is so ordained. APPROVED AS TO FORM AND LEGALITY: r ""ity of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Annexation Request - North Side PAGE 4/18/66 NUMBER ' °� PZ-182 Industrial Development Area 3 A petition has been received from Great Southwest Corporation, owners of a 1000 acre tract in the vicinity of Loop 820 and Interstate 35, requesting annexation of the tract and provision of municipal services by the City of Fort Worth. Rcvi, w of the eco•ionitc potential of entire industrial area, future growth patterns and area-wide utility service needs indicates that the City should also consider annexation and orderly extension of services into the 8.21 square mile area shown on the attached map. interstate high- way construction and trunk water and sewer extensions into the area are either underway or are presently financed for future construction as property owners request service in the aria. Nature of Existing Development The area under consideration is predominantly vacant at this time, with some agricultural uses, and one small residential development in poor con- dition called Melody Hills, located just east of Interstate 35 and north of Odom Road. Growth patterns and adjacent uses in the area within the city limits indicate prime industrial development potential, all of which would be dependent upon the City of Fort Worth for essential utilities and services. Major topographical features in the area include the Big and Little Fossil, ' . Creeks. There is extensive sand and gravel mining in progress along the Big Fossil in the northeast portion of the area proposed for annexation. The Melody Hills subdivision now consists of 96 lots each with 12,00 square feet and served by a private well water system and septic to , There is mixed usage of permanent housing in the $4,000 to $6,000 ,���i� with some house trailers on various lots between the existing hou Nelodv Hills. Water Main Extensions ��ill�/� There are existing City water mains in Terminal Road just west of Deen `�• Road and in Beach Street in the western portion of the area under considera- tion. Extensions are proposed and were financed in the 1965 water bond improvement election to provide for the needs of any development that will occur in the area. It is proposed to extend a main from Terminal Road northward along the Old Denton Road to and beyond Loop 820 when needed, and make extensions northward along the Beach Street alignment to Loop 820 and then westward to Interstate 35 when needed to serve development. Both water main alignments are shown on the attached map. Sanitary Sewer Service Funds are now available for the City's share of extending the Little Fossil Creek Collector from the 90 inch Outfall Collector Sewer to serve the pro- posed industrial area. Negotiations are well advanced with Haltom City, through which the line must pass, and which may use a portion of the capa- city of the collector main. Work on the collector sewer will proceed as rapidly as possible. In accordance with the master sewerage plan developed for the area and ap- proved by the City Council, sanitary sewer service can be provided to the Big Fossil Creek drainage basin contained in the annexation proposal by construction of a combination lift station and force main which would discharge into the Little Fossil Creek Collector system on an interim basis until the Big Fossil Collector system is constructed. Highway. Street Storm Drainage and Lighting Deeds The City's share of development costs in accordance with standard policies for the installation of community facilities are available from the 1965 bond improvement election. The Texas Highway Department has reported that Interstate 35 from 28th Street to Loop 820 will be opened by the end of April. Loop 820 between North Beach Street and Interstate 35 will be opened by August of 1966. Extension of Interstate 35 northward to the Watauga-Smithfield Road will be completed early in 1967 and Loop 820 will be extended westward, but no firm schedule is now available. Waste Disposal. Fire and Police Services Waste disposal service would be provided either by container pickup or by packer truck. Waste pickup would be ex:ended to the existing Melody Hills residential area. Fire protection would be extended from existing Northside and Riverside stations. Future industrial development in this area and in other northside industrial parks will eventually require a fire station relocation or additional fire stations and equipment. Police protection can be extended to this area subject to realignment of beat coverage and additional manpower and equipment as development in the area progresses. Need for Annexation The Great Southwest Corporation is prepared to proceed with early develop- ment of planned industrial sites in a sizeable portion of the area proposed for annexation. Quick development of the Great Southwest acreage depends upon immediate annexation and the prompt initiation of plann d con- struction of utilities to serve the tract. Some encroachments of incompatible uses already exist along the freeway and extreme care should be exercised as the interstate system is completed to protect property owners from invasion or expansion of uses which would hamper the development of the area as industrial sites. If assistance is provided by the City through annexation and zoning, utility services can be planned, scheduled, and completed to meet the demands of industry that may wish to locate in the area. The street patterns, now un- defined, can be planned in cooperation and coordination with property owners to serve the entire area efficiently in accordance with an orderly and over- all street plan. Recommendation Because the Great Southwest Corporation has requested annexation and ex- tension of municipal services for a large tract near the intersection of Loop 820 and Interstate 35, and because it is feasible and highly desirable to plan and extend municipal services on an orderly basis to the overall 8.2 square mile '.North Fort Worth industrial area, it is recommended: 1) That a hearing on the requested annexation be set for May 2, 1966; and, 2) That the admiuisLrstive staff be instructed to prepare necessary de- scriptions and annexation ordinances for final City Council action after the hearing and other necessary legal steps have been taken.
