AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF MONY STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: UNIT 1: MONY STREET From Pharr Street to east property line of Lot 1, Block 1, Ford Addition, known and designated as Unit 1, Project No. 104-24000- 253, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed concrete curb on a forty foot roadway. Six- inch thick concrete driveways will be cony- structed where specified. UNIT 2: PHARR STREET From 10' west of the southeast corner of Tract 1-B, William H. Little Survey to West Service Road of I-35, known and designated as Unit 2, Project No. 104-24000-253, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed concrete curb on a forty foot roadway. UNIT 4: PHARR STREET From Gilvin Street to 223' west, known and de- signated as Unit 4, Project No. 104-24000- 253, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed curb on a forty foot roadway. P. together with concrete curbs, gutters, driveways and incidentals to such improvements on proper grade and line where same are not already so constructed, together with storm sewers/ and drains and other necessary incidentals and appurtenances; all of said im- provements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; contract therefore has been made and entered into with AUq TTN ROAD COMPANY ; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT; I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of streets, avenues, and public places hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting pro- perty and the owners thereof, are as follows, to-wit: UNIT 1; MONY STREET From Pharr Street to east property line of Lot 1, Block 1, Ford Addition, known and designated as Unit 1, Project No. 104- 24000-253. The estimated cost of improvements is $ 167, 887.50 the estimated amount per front foot to be assessed against abutting property and the owners thereof for superimpose' concrete curb HOWM E is $ 1.06 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $ 26.78 the estimated amount per front foot to be assessed against abutting property and the owners thereof for -0= wide concrete sidewalk is $ -0- ; the estimated amount per square foot to be assessed against abutting property and the owners thereof for six-inch thick concrete driveway is $ 1.59 per square foot; the total estimated amount per front foot to be as against abutting property and the owners thereof is $ 27.84 plus the cost incurred for concrete driveway construction where specified. III, A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the 4th day of November , 19 74 , at 9:30 in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or cause to be given notice ,of the time and place of such hearing and of other 'matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session.of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, emergency effective May 12, 1967. Such notices shall be. by advertisement inserted at least three (3) times in a newspaper published in the -City of Fort Worth, Texas, the first publication to be made at least twenty-one (21) days before the date of said hearing: Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended. The City Secretary is further directed to give or cause to be given personal notice of the time and place of such hearing to all owning or claiming any property abutting on" said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States, Mail at least fourteen (14) days before the . date of the hearing, postage prepaid, in envelopes addressed to all persons owning or claiming any interest in the respective properties abutting the high- ways, streets, avenues and public places or portions thereof to be improved, as the names bf such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to ,such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or portion or portions there- of which is to be ,improved is listed as "unknown" on the then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax rolls but no address for such owner is shown,- no notice need be mailed. In those cases where the owner is shown to be an estate, the mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be prepared and filed with these proceedings a list of the_ properties to be a4sessed,, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known addresses determined as aforesaid of the respective owners and those per, sons owning or claiming any interest in said property. a The City Secretary shall certify that each of the parties in said list whose address is shown on the then current rendered or unrendered tax rolls of the City of Fort Worth was mailed a copy .of the notice of hearing and shall further certify the date or dates, on which said notice' was mailed. A copy of each notice shall be attached to such certificate, The certificate of the City Secretary will be con- clusive evidence of the facts therein recited. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. In addition to this work, bids were also received for improvement of Pharr Street from the west frontage road of I-35W west for two blocks to Gilvin Street and from the east frontage road of I-35W east approximately 700 feet to an intersection of the proposed Greenway Park Drive which has not yet been platted by the owners of the undeveloped property abutting Pharr Street on the north. Greenway Park, owned by the City of Fort Worth, abuts Pharr Street on the south. Bid plans and bid documents provided for the submission of bids in four units. Unit I is Mony Street from Pharr Street north approximately 1,100 feet and then east approximately 1,200 feet to an intersection with the west frontage road of I-35W. The Mara Corporation property is located on the north side of Mony Street where it makes a right angle turn to the east as shown on the attached map. The McLean Trucking Company building is presently under construction on this site with the scheduled completion date for early in 1975. In order to provide paved access to this trucking terminal, it is necessary as a minimum to improve that portion of Mony Street from Pharr Street northward 1,100 feet. Unit II provides for the improvement of Pharr Street from the west frontage road of I-35W to Mony Street; Unit III provides for improvement of Pharr Street from the east frontage road of I-35W to the proposed future Greenway Park Drive; and Unit IV provides for the improvement of Pharr Street from Mony Street to Gilvin Street adjacent to the C R I & G Railroad. Bids received for this work are as follows: Unit Austin Road Company Texas Bitulithic Company I $ 271,737.62 $ 289,408.60 II 64,426.92 69,505.34 III 58,022.46 64,162.90 IV 26,142.41 28,743.22 i Total $ 4209029.41 $ 451,820.06 Deletion of a Portion of Unit I Subsequent to the execution,, of the Community Facilities Contract and during the design of the project, it was determined by the7Department of'Public Works that the consulting engineer's proposed alignment and cost estimate of the proposed drainage system to serve the section of Mony Street located east of the Mara property was insufficient. The bid price for the relocated storm DATE REFERENCE SUBJECT: Award of Contract - Assessment PAGE NUMBER 10/7/74 C-2936 Paving and Storm Drain, Ford Addition 2 orb_ drain, which is required to cross under I-35W is approximately $70,000, as opposed to the original cost estimate of $11,715. It is proposed to delete from the contract the construction of approximately 820 feet of..Mony Street from the east property line of the Malja Corporation.to I-35W including the drainage facility. The City is not involved in a contract with the owners of the property adjacent to the proposed deletion. In addition, the deleted section is not required to serve the Malja Corporation who entered into a Community Facilities Contract although somewhat better access would be provided. The proposed deletion has been discussed with representatives of Malja Corporation and they agreed to the deletion provided construction work could proceed without delay on the remainder of Mony Street. Additionally, during the evaluation of the higher cost of draining the portion of Mony Street located east of the Malja Corporation property, it was learned by the staff that multiple ownership of the adjoining property did not exist in fact at the time of Council authorization of the Community Facilities Contract and therefore, this section of Mony Street was not eligible for assessment paving under the City Council adopted policy for such projects. Unit III, Pharr Street from East Frontage Road of I-35W to Proposed, Greenway Park Drive The Council was advised in M&C C-2846 (June 28, 1974) that the Brants Company has requested by letter the paving of Pharr Street east of I-35W based on anticipated plans for the development of the abutting property. At this time, however, no final plat has been submitted to the City by the Brants Company nor has any community facilities contract relative to the proposed development of this property been executed. Unless and until the Brants Company is in fact developed, the improvement of this portion of Pharr Street will serve no useful public purpose, and it is therefore proposed that award of contract on this section be deferred pending further discussions and negotiations with the Brants Company relative to their future plans. Summary of Recommended Award Unit Amount Unit I - from Pharr Street to east property line of Marja Corporation property $ 152,625.00 Unit II - Pharr Street from west frontage road of I-35W to Mony Street 64,426.92 Unit IV - Pharr Street from Mony Street to Gilvin Street 26,142.41 Total $ 243,194.33 This is a reduction of $177,135.08 from the total bid received from all four units. DATE REFERENCE SUBJECT: Award of Contract - Assessment PAGE NUMBER 10/7/74 C-2936 Paving and Storm Drain, Ford Addition 3 or 4 Project Cost and Financing Based on the recommended award, approximately $128,954.63 will be assessed against abuting properties under standard policy, to be provided for by a Bond Fund transfer from the Revolving Fund Unspecified Account, total construction, design engineering, inspection engineering, admin- istration and miscellaneous costs to the City is approximately $158,915, which will require a Bond Fund transfer of $99,000 from the 104-24000-901 Unspecified Assessment Paving Account to supplement the approximately $60,000 in project Account No. 104-24000-253.
