AN ORDINANCE REXUTING THE HOURS FOR THE TRANSACTION
OF BUSINESS OF PAViNBROKPRS, SECONMAND DEALERS AND
dUM DEALERS IN TIM CITY OF FORT WORTH, TEXAS; DEFIN-
ING "PAWNBROKERS", "SECONDHAND r ALERS- AND "IM
DEALERS"; FIXING PEMA.LTM FOR THE VIOLATION OF THIS
ORDINANCE; PROVIDING A SAVING CLAUSE; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
F3rSERC�?CY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
NORTH, TEXAS:
SECTION I.
Hereafter, it shall be unlawful for any person, firm or cor-
poration to engage in the business of a pawnbroker, secondhand dealer or
Junk dealer between the hours of six-thirty o'clock p. m. and eight o'clock
a. m., except during the month of December of each, and on Saturdays such
persons, firms and corporations may engage in such business between the
hours of eight o'clock a. m. and seven o'clock p. m.
SECTION II.
(a) A "pawnbroker", as used herein, is any person, firm, part-
nership, corporation, or association who pursues the business of lending
money upon interest and receiving upon deposit any personal property as
security for the payment of such loan and interest.
(b) A "secondhand dealer", as used herein, is used in its
ordinary and usual trade acceptance meaning, and shall also mean and include
any person or persons, firm, partnership, corporation, or association en-
gaged in any of the following: collecting, handling, buying, trading, sell-
ing, or engaging in the sale or traffic of any of the following: used and/or
secondhand wearing apparel consisting of hats, shoes, overcoats, raincoats,
and any and all kinds of clothing; used and/or secondhand watches, jewelry,
diamonds, luggage, musical instruments, shotguns, rifles, revolvers, and
all other kinds of firearms; and any and all kinds of used goods, wares and
merchandise which are handled by pawn brokers and secondhand dealers in
the usual course of trade.
(a) The term "Junk dealers" is herein used in its ordinary and
usual acceptance meaning, and shall also mean and include any person or
persons, firm, partnership, or corporation engaged in any of the following:
collecting, handling, buying, and selling of scrap iron or serap tin or
scrap brass or scrap copper or scrap lead or scrap zinc and all other scrap
metals and their alloys, and bones, rage, cloth, rubber, rope, tin foil,
used bottles, old cotton, secondhand mechanical and garden tools and utensils,
used or secondhand plumbing fixtures, appliances, fittings, pipes and supplies,
used or secondhand electrical fixtures, fieings,appliances and supplies,
used or secondhand gas fixtures, fittings, appliances and supplies, used or
secondhand water heaters, fixtures, fittings, pipes and supplies, and used
or secondhand lawn hose or harness, used or secondhand doors, window sash
or glass, mantels or parts thereof, used or secondhand automobiles purchas-
ed for the purpose of being dismanteled, and all automobile parts and acces-
sories, and used or secondhand automobile tires and tubes.
SECTION III.
Any person, firm, partnership, corporation or association violat-
ing any of the provisions of this ordinance, or failing or refusing to com-
ply with any of the provisions hereof, shall be guilty of a misdemeanor and
upon conviction thereof shall be fined in any sum not less than Ten Dollars
($10.00) and not more than Two Hundred Dollars 4200.00), and each day-s
violation of any of the provisions hereof shall be deemed a separate offense.
SECTION IV.
The holding or adjudication of any section or subdivision of any
section, or any part of any subdivision of a section of this ordinance to
be invalid, shall not affect the validity of any other section, subdivision
of a section, or a part of a subdivision of a section thereof, but all other
sections, subdivisions of sections and parts of subdivisions of sections,
shall be and remain in full force and effect.
SECTION V.
That all ordinances and parts of ordinances in conflict here-
with are hereby expressly repealed.
SECTION VI.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage and publication as required by law.
