WHEREAS, the City of Fort Worth (City) and Dunaway Associates, L.P., (Engineer)
made and entered into City Secretary Contract No. 34093, (the Contract) which was
authorized by the City Council by M&C C-21712 on the 26`h day of September 2006; and
WHEREAS, the Contract involves engineering services for the following project:
Engineering Design Services: Street Reconstruction, Storm Drain Design on College
Avenue (Page St. to W. Capps St.), Orange Street (Stanley Avenue to Townsend
)r.), Lipscomb Street (W. Capps St. to W. Berry St.) and Wayside Avenue (N. Dead
End to W. Cantey St.), 2004 CIP Year 4 & 5, Contract 53, Project No. 00455; DOE
No. 5411
WHEREAS, it has become necessary to execute Amendment No. 4 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly -
authorized representatives, enter into the following agreement which amends the
Contract:
1.
Article I of the Contract is amended to include the additional engineering services
as specified in a proposal letter dated October 2nd5 2008, a copy of which is attached
hereto and incorporated herein. The cost to City for the additional services to be
performed by Engineer total $24,750.
2.
Article II of the Contract is amended to provide for an increase in the maximum fee to be
paid to Engineer for all work and services performed under the Contract, as amended, so
that the total fee paid by the City for all work and services shall not exceed the sum of $
2085357 + $ 15,510 (Amendment No. 1) + $ 4,440 (Amendment No. 2) + $ 105570

Dear Ms. Johnson:
Dunaway Associates, L.P. is pleased to present this Amendment No. 4 for additional
engineering design services requested by the City that are beyond our original scope of
services. The general scope of these additional services is as follows.
Task 1 —Work within BNSF RR ROW on Lipscomb Street
Our scope of services currently calls for ending roadway pavement design at the RR ROW
line on Lipscomb Street. Based on comments from the 90% City review, it was requested
that we continue the design of improvements through the RR ROW. This effort involved the
following additional work items.
1. Coordination Meetings
2 coordination meetings are anticipated; one at the project site with City staff and
BNSF representatives and one in-house meeting with City TPW and DOE staff.
2. Roadway and drainage design
a. Design of the street profile grade within the BNSF ROW and redesign of the
Lipscomb profile grade outside the RR ROW to create smooth transitions.
b. Design of sidewalk crossing RR ROW
c. Drafting of proposed RR ROW improvements on roadway plan/profile sheet
d. Assistance in preparation of 2 RR Permit applications (1 —Utility crossing, 1-
Work Within RR ROW (roadway)).
e. Preparation of an "Exhibit A" for the RR Permit
f. Addition of pay items to laid Proposal
g. Additional quantity take -off and construction cost estimate items
h. Addition of Special Work in RR ROW notes to plan and contract documents

Task 2 — Redesign of Orange Street Profile (approximately 9b0 LF)
Our scope of services currently calls for design of sidewalks on both sides of Orange Street.
Plans were prepared and submitted for 90% review with street profiles and driveway
connections designed for the construction of sidewalks. Because sidewalk construction
would result in conflicts with existing structures encroaching into the street ROW, and
because the resulting street cross -slopes would be excessive due to the amount of curb -split
necessary to create smooth connections to existing driveways, the City instructed that new
sidewalks should not be constructed in this segment of street where there are no existing
sidewalks.
This request is for the additional effort involved in eliminating the sidewalks from the
construction plans:
a. Redesigning the profile grade lines to fit existing driveways without the sidewalk.
b. Redrawing the plan/profile sheets with the revised profiles and eliminating the
proposed sidewalks.
c. Revising the quantity take -off and construction cost estimate
d. Revising the Bid Proposal
Task 3 —Preparation of Addenda Documents (Up to four)
This task included the preparation and distribution of multiple addenda to address changes to
the City's standards with regards to the "Green Cement" policy and Traffic Control Plan
requirements.
This request involves the following tasks:
a. Coordination with City addendum content.
b. Preparation of the addendum document.
c. Preparation of fax sheet with all of the plan holders
d. Distribution of addendum documents.
e. Confirmation calls to follow up with each plan holder receipt of addendum.
Task 4 —Preparation of Traffic Control Plans for utility construction at the intersection of Beny
and Lipscomb St only per Special Condition D-8.
This request will involve the following tasks:
a. Site visit to determine existing pavement joint patterns, pavement markings and lane
widths.
b. Preparation of a detailed traffic control plans including advance warning signs.
c. One meeting with the TPW Traffic Engineering Department.
d. Prepare Quantity Estimate.
e. Reproduction of Plan sheets for distribution.

Sanitary Sewer Main Replacement on College Avenue, Orange Street, Lipscomb Street and
Wayside Avenue
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 4 to City
Secretary Contract No. 34093 with Dunaway Associates, L.P., in the amount of $24,750.00 to provide
additional engineering services and plan preparation for street reconstruction and water and sewer
replacement on College Avenue, Orange Street, Lipscomb Street and Wayside Avenue, thereby increasing
the contract amount to $263,627.00.
DISCUSSION:
The 2004 Capital Improvement Program (CIP) includes funds for reconstruction of neighborhood streets
including College Avenue, Orange Street, Lipscomb Street and Wayside Avenue.
On September 26, 2006, (M&C C-21712) the City Council authorized the City Manager to execute an
engineering agreement with Dunaway Associates, L.P., in the amount of $208,357.00 for street
reconstruction and water and sanitary sewer replacement on College Avenue, (Page Street to West Capps
Street), Orange Street (Stanley Avenue to Townsend Drive), Lipscomb Street (West Capps Street to West
Berry Street) and Wayside Avenue (North Dead End to West Cantey Street).
The contract has previously been amended three times to provide additional services not included in the
original contract as follows:
Amendment No. 1 $15,510.00 - Geotechnical Services
Amendment No. 2 $4,440.00 -Additional Storm Drainage Design
Amendment No. 3 $10,570.00 -Additional Water Lines
Total Amount $30,520.00
Amendment No. 4 to the project consists of the preparation of additional plans and specifications for the
street and sidewalks design, a railroad crossing, a Railroad Permit Application and Traffic Control
Plans. All of the requested items are beyond the limits defined in the initial Project Scope. The railroad
crossing, a 100-foot width crossing of two tracks in the Burlington Northern Santa Fe (BNSF) Railroad
right-of-way at Lipscomb Avenue, was not included in the original CIP Project. During design of the project,
it was determined that the deteriorated condition of the crossing, combined with the need to extend the
sidewalk across the tracks, warranted its replacement. BNSF agreed to furnish and install aconcrete-panel
crossing at the location. In conjunction, the City of Fort Worth agreed to construct the hot -mixed -asphaltic -
concrete infield between the tracks and the pavement interface at each end of the crossing as part of the

CIP Project. To be compliant with ADA, the west sidewalk had to be extended across the BNSF right-of-
way. The work within the railroad right -of way, not anticipated in the 2004 CIP Project, requires a permit
from BNSF. In addition, the requirement for a more comprehensive Traffic Control Plan for the
neighborhood streets was added to the project immediately prior to advertisement.
Dunaway Associates, L.P., proposes to perform the additional necessary work for a lump sum fee of
$24,750.00. City staff considers this fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount $5,198.00 is required for project management by the Transportation and
Public Works Department.
This project is located in COUNCIL DISTRICT 9, Mapsco 76U, 76V, 76Z and 90B.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital budget,
as appropriated, of the Street Improvements Fund.
