COUNTY OF TARRANT
WHEREAS, The City of Fort Worth and Freese and Nichols, Inc. (Architect) made and entered into City
Secretary Contract No. 35845 (The Contract) which was authorized by the City Council by M&C C-22341,
the 28th day of August, 2007; and
WHEREAS, further amendment is necessary to reimburse the Architect for including the design of the
temporary Citizen Drop -Off Station and the additional requirements of the new Urban Forestry Ordinance
as part of the design services agreement; and
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
Article 1.1, SECTION I —SERVICES OF THE ARCHITECT, a paragraph is added to read as follows:
"Provide additional design services to modify the site plan, paving, entrance, grading, drainage,
and site excavation and backfill for the new Citizen Drop -Off Station. The cost of the additional
services is $36,640.00, including reimbursable expenses up to $4,500.00. The scope of services
is more fully described in the Email from Jeff Arrington of Freese and Nichols, Inc., dated January
17, 2008, subject: Old Hemphill Drop -Off — Scope and Fee for Amendment, with attachment,
which is attached hereto as Attachment "A" and made a part of this Agreement."

Paragraph 1 of SECTION V -COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof small be a fixed fee of
$168,575.00 for the Citizen Drop -Off Station plus up to $15,900.00 for reimbursable expenses."
All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

DESIGN AND CONSTRUCTION DOCUMENT PREPARATION
SCOPE OF WORK FOR ADDITIONAL SERVICES
Description of Services —Design Modifications to Accommodate Gas
Pipeline EasellIVIR
Freese and Nichols with meet with the City and gas pipeline company
representatives to discuss impacts of the proposed pipeline to the Hemphill Drop -
Off Center. We will prepare a written description of impacts along with an
opinion of probable construction cost for the changes to the facility resulting from
the easement. Freese and Nichols will coordinate with City staff to address any
questions and concerns regarding the preliminary impact assessment and costs.
Anticipated design modifications include: additional pavement, new entrance
location, slope protection, revised grading and drainage plans, and details and
specifications for removal and replacement of spoil material. Freese and Nichols
will incorporate the proposed design changes into the construction plans and
specifications for the Drop -Off Center. We will address city comments .regarding
the desian chances.

RECOMMENDATION:
It is recommended that the City Council:

On A..g� Est 28, 2007, (M&C C-22341) the City Council authorized the execution of a professional services
agreement with Freese and Nichols, Inc., for an amount not -to -exceed. $131,000 for design and
construction administration services for the Citizen Drop -Off Station.
On October 9, 2007, (M&C C-22437) the City Council authorized the execution of a revised work order with
Job Order Contractor, Alpha Building Corporation, for an amount not -to -exceed $50,000, to construct a
temporary Citizen Drop -Off Station.
On December 11, 2007, (M&C L-14432) the City Council authorized the acceptance of $393,800 payment
from Texas Midstream Gas Services, LLC, as compensation for required site plan and site preparation
changes to the Environmental Management Drop -Off Station facility planned for this property to
accommodate the natural gas pipeline easements.
Amendment No. 1 ($16,976.00) was for additional design services for the temporary Citizen Drop -Off
Station and -the new Urban Forestry ordinance requirements.
Amendment No. 2 is for. additional design services to modify the site plan for the new Citizen Drop -Off
Station to accommodate the natural gas pipeline easement for Texas Midstream Gas Services, LLC. The
additional design services include modification to the site plan, paving, entrance, grading, drainage,
excavation, and backfill.
The revision costs for the design ($36,700.00) and construction (cost estimate of $357,100.00) have been
received from the Texas Midstream Gas Services, LLC.

attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of

FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING AMENDMENT NO. 2
TC CITY SECRETARY CONTRACT NO. 35845 WITH FREESE AND NICHOLS FOR THE
DESIGN OF THE CITIZEN DROP-OFF STATION AT 6250 OLD HEMPHILL ROAD;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Specially Funded Capital Projects Fund in the amount of $36,700 from available funds for the purpose
executing Amendment No. 2 to the City Secretary Contract No. 35845 with Freese and Nichols for the
design of the Citizen Drop -Off Station at 6250 Old Hemphill Road,
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prbr
ordinances and appropriations are hereby expressly repealed. -
SECTION
4.
This ordinance shall take effect upon adoption.
