CONTRACT BETWEEN
TEXAS STATE UNIVERSITY — SAN MARCOS
Texas School Safety Center/Institute for Criminal Justice Studies
(hereinafter referred to as University)
AND
City of Fort Worth, by and through the City of Fort Worth Police Department
(hereinafter referred to as Contractor)
Entered into this 2nd day of May 2008
That in consideration of the Contractor's promise to:
(1) Reimburse the University $7000.00 for a minimum of 20 participants at 350.00 each enrolled in course. Fort
Worth PD will pay $350 for each additional officer from FWPD.
(2) Provide adequate meeting space with movable tables and chairs that can be arranged to enhance active -learning
activities for a minimum of 36 participants that may be arranged in groups not to exceed 6 participants from
group.
(3) Provide podium or speaker's table and projection screen with multi -plug power .
(4) Training attendance will be open to outside Law Enforcement agencies for any space left available up to 36
officers. The University will be responsible for all registration activities.
II. The University through the Texas School Safety Center and the Institute for Criminal Justice Studies agrees to:
(1) Provide the following training package: 40 hour School Based Law Enforcement Officer Training, August 11 - 15,
20081 in Fort Worth, Texas, consisting of 40 hours of credit in compliance with Texas Commission on Law
Enforcement Officer Standards and Education Rules and Regulations, allowing for breaks and orientation;
(2) Provide all course materials and handouts necessary for successful completion of the courses;
(3) Provide certificates for all participants who attend the full 40 hours and successfully complete the course;
(4) Provide TCLEOSE report of training; and
(5) Provide online registration to contract participants and participants not from contract agency.
III. Miscellaneous provisions and conditions:
(1) Either party may terminate this contract at any time by giving two weeks' written notice to the contractor or
University at the following addresses:

(2) This contract contains the entire agreement between the parties relating to the rights herein granted and the
obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no
force or effect excepting a subsequent modification in writing, signed by the parties or their representative and
attached hereto.
(3) This contract constitutes the only agreement of the parties and supersedes any prior understanding or written or
oral agreement between the parties respecting the within subject matter.
(4) This contract shall be construed under and in accordance with the laws of the State of Texas, and all
obligationgwofili-d parties.

P) It is expressly understood and agreed that in the execution of this contract, neither party waives or
shall be deemed hereby to waive any immunity. The parties agree that nothing in this contract waives
any immunity, protection, right, limitation or cap on damages, as recognized in the Texas Tort Claims
Act as to either of the parties, or as to any third party.
(6) Each party shall operate hereunder as an independent contractor and not as an officer, agent, servant
or employee of the other party.
(7) No waiver by the parties hereto of any default or breach or the failure to insist upon the performance
of any term, condition, provisions or covenant of this contract shall be deemed to be a waiver or
relinquishment to any extent of any other breach of the same or any other term, condition, provision,
or covenant herein or the right of the parties to assert or rely upon any such term.
(8) The undersigned officers and/or agents of the parties hereto are the properly authorized officials and
have the necessary authority to execute this contract on behalf of the parties hereto.
