COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("City") and Dunaway Associates, L.P. ("Engineer") made and entered into City Secretary Contract No. 29019 (the "Contract") which was authorized by City Council via M&C C-19701 on the 12t" day of August, 2003; and WHEREAS, the Contract involves engineering services for the following project: Water Main Extensions to Serve Walsh Ranch, Phase I. WHEREAS, it has become necessary to execute Amendment No. 5 to said Contract to increase the scope of services and/or the maximum fee. NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement that amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in the Engineer's proposal letter dated December 4, 2007 and attached hereto. The cost to City for the additional services to be performed by Engineer total $93,071.80. Article I.I�£f n 2. Contract is amended to provide for an increase in the maximum fee to be -1- � ORIGINAL paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of 4),1,457,589.25. 3. On March 5, 2007 CDM was notified of a conflict between the ground storage tank and an existing electrical manhole. It was deternnined that the elechi%Wu manhole was conshucted approximately 11 to 12 feet further north than indicated on the plans for the Unit 4 project resulting in the conflict. ,DM worked with the staff of the Fort Worth Water Department to develop and evaluate alternatives for resolving the conflict. CDM attended two meetings with the Owner, made one construction site visit, conducted numerous telephone calls with field persomiel, and prepared a draft and final memo summarizing the tank -manhole conflict. The revised schedule indicated a completion date of October 17, 2007 which is 47 days later than the contract completion date of September 1, 2007. As of November 26, 2007, the construction activities are anticipated to continue for approximately one more month. The construction completion has been delayed beyond the original date. titre have and will incur additional costs to continue to provide resident project representative and general construction phase services. We request additional compensation for extended construction phase services beyond the original completion date in the amount of $65,448. The amounts for resident project representative and general construction phase services are broken down as follows. We request additional compensation for our construction phase services in the amount of $6,380.00. DISCUSSION: On August 12, 2003, (M&C C-19701) the City Council authorized an Engineering Agreement with Dunaway Associates, Inc., in the amount of $965,406.95 for Walsh Water Main Extension, Phase 1. The agreement provided for the design of 31,000 feet of 30 and 24-inch water line and a ground storage tank. The agreement was subsequently revised by four amendments totaling $399,060.50 as follows: • Amendment No. 1 (M&C C-19940, January 20, 2004) in the amount of $42,605.00 for the design of an additional 3,500 feet of water line. • Amendment No. 2 (City Secretary Contract No. 29588) administratively approved by the City Manager on February 277 2004 in the amount of $247302.50 for additional services necessary to acquire an alternate parcel of land for the proposed ground storage tank. • Amendment No. 3 (M&C C-20561, March 8, 2005) in the amount of $125,377.00 for the design of an additional 1,500 feet of water line and ground storage tank site due to the change in location of the ground storage tank site. • Amendment No. 4 (M&C C-21256, January 19, 2006) in the amount of $206,826.00 for the preparation of separate plans and specifications for the ground storage tank and revisions to the plan sheets to delay the tank construction until an investigation into the failure of a similar tank could be completed. This amendment also included construction management and inspection services for the ground storage tank construction. The proposed Amendment No. 5 extends the construction phase services, including additional on site representation, construction administrative services and additional meetings. Also included are additional engineering services to resolve utility conflicts on the tank site and an evaluation of the use of groundwater for construction test water. Dunaway Associates, Inc,, proposes to provide the necessary additional services for a lump sum fee of $93,071.80. Dunaway Associates, Inc. is in compliance with the City's MWBE Ordinance by committing to an additional http://apps.cfwnet.org/council packet/Reports/mc_print.asp 4/23/2008 Page 2 of 2 33 percent MWBE participation on the Amendment No. 5 The City's goal on the amendment is 30 percent.
