(Engineer) made and entered into City Secretary Contract No. 34081 (the Contract) which was authorized by the City Council by M&C C-21725 on the 26th day of September 2006; and WHEREAS, the Contract involves engineering services for the following project: Pavement Reconstruction and Water and Sanitary Sewer Replacement on Westcreek Drive (Medina Avenue to Bilglade Road and Bilglade Road to Westfield Avenue) 2004 CIP Contract 44 Project No. 00444, DOE No. 5407 WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly -authorized representatives, enter into the following agreement which amends the Contract. 1. Article I of the Contract is amended to include the additional engineering services and provide additional contract time as specified in a proposal letter dated November 30, 2007, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $20,887.75, 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $209,662.75. Consultants has been requested to provide additional engineering design services for the above referenced project. This request for additional services is not part of our existing contract and will exceed our current scope. Concept review comments by City staff recommend replacement of water and sewer in the west roadway of Westcreek Drive from Westfield Avenue south to Loop 820 Service Road. In addition, replacement of proposed 8" water lines crossing the existing channel will require additional detailing beyond our scope. City staff comments also requests replacement of existing concrete flumes with storm drain systems in addition to the 4 storm drain systems required by our drainage analysis. Additional drainage analysis of Westcreek Drive by DeOtte Engineering recommends the addition of 4-20' curb inlets in sump condition on the east roadway of Westcreek Drive between Westfield Avenue and Loop 820 Service Road. Purpose of the additional curb inlets is to alleviate excessive flooding at this location. The addition of the 4-20' curb inlets in sump condition requires reconstruction of the existing roadway. City staff also recommends combining storm drainage plans prepared by DeOtte Engineering into one set of plans for bidding and construction purposes. A.N.A. Consultants, L.L.C. is recommending that our current contract be amended to include these additional services as well as the corresponding fee adjustments. DISCUSSION: On September 26, 2006, (M&C C-21725) City Council authorized the City Manager to execute an engineering agreement with ANA Consultants, L.L.C., in the amount of $177,975.00 for the subject project. The agreement was subsequently revised by one previous amendment approved administratively by the City Manager in the amount of $10,800.00 (City Secretary Contract No. 35000, February 19, 2007) that provided for the geotechnical investigation and recommendations for the appropriate pavement design for the street in the design contract. Amendment No. 2 will provide for the following additional services: . Survey and design for replacement of deteriorated water mains and sewer lines adjacent to the project area and Texas Department of Transportation permit preparation; and . Survey and design for installation of storm drain facilities and street pavement within the project area ANA Consultants, L.L.C., proposes to perform the necessary design work for a lump sum fee of $20,887.75. City staff considers the fee to be fair and reasonable for the scope of services proposed. This project is located in COUNCIL DISTRICT 3, Mapsco 90N.
