HomeMy WebLinkAboutOrdinance 6075 ORDINANCE NO.AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF ARTHUR STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: PROJECT NO. 104-24000-187 1. ARTHUR STREET From the north line of Kansas Street to the south line of White Settlement Road, known and designated as Unit No. 1, Project No. 164-24000-187: a seven-inch thick hot-mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade on a 36-foot roadway, and five-inch thick concrete side- walks where specified. 2. N.W. TWENTIETH STREET From the west line of Francis Avenue to the west line of Prairie Avenue, known and desig- nated as Unit No. 2, Project No. 104-2/+000- 187: a six-inch thick hot-mix asphaltic con- crete pavement on a six-inch thick lime sta- bilized subgrade on a 30-foot roadway, and five-inch thick concrete sidewalks where specified. 3. BUFORD STREET From the east line of Haskell Street to 200' east, known and designated as Unit No. 3, Project No. 104-24000-187: a six-inch thick hot mix asphaltic concrete pavement on a six- inch thick cement stabilized subgrade on a 30- foot roadway. 4. BILAGKSTONE DRIVE From the east line of Isbell Road to the east end of Blackstone Drive (Cul-de-sac), known and designated as Unit No. 4, Project No. 104-24000-187: a six-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade on a 30- foot roadway. 5. YALE STREET From the north line of Roberts Cut-off to the south line of Columbia Avenue, known and designated as Unit No. 5, Project No. 104-24000-187: a six-inch thick hot mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade on a 30- foot roadway. 6. N.W. TWENTY-THIRD STREET From 65' south of the south line of Rock Island Street to the south line of McCandless Street, known and designated as Unit No. 6, Project No. 104-24000-187: a six-inch thick hot mix asphaltic concrete pavement on a six- inch thick cement stabilized subgrade on a 30-foot roadway. 7. LINCOLN AVENJE From the south property lines of Lot 3, Block 49, and Lot 19, Block 48, M. G. Ellis Addition, to the south line of N.W. Twenty- Eighth Street (Hwy. 183), known and desig- nated as Unit No. 7, Project No. 104-24000- 187: a six-inch thick hot-mix asphaltic con- crete pavement on a six-inch thick lime sta- bilized subgrade on a 30-foot roadway. 8. NORTH HOUSTON STREET From the north line of N.W. Thirty-Seventh Street to the south line of N.W. Thirty- Eighth Street, known and designated as Unit No. 8, Project No. 104-24000-187: a six-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade on a 30-foot roadway. 9. LA SALLE STREET From the east line of Sylvania Avenue to the west line of Baurline Street, known and desig- nated as Unit No. 13, Project No. 104-24000- 187: a six-inch thick hot-mix asphaltic con- crete pavement on a six-inch thick cement sta- bilized subgrade on a 26-foot roadway, and five-inch thick concrete sidewalks where specified. 14. FINLEY STREET From the east line of Baurline Street to 4841 east (dead end), known and designated as Unit No. 14, Project No. 104-24000-187: a six-inch thick hot mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade on a 30-foot roadway. 15. OHIO GARDEN ROAD From 100' west of the west line of Isbell Road to the West City Limits (11801 ), known and designated as Unit No. 15, Project No. 104-24000-187: a six-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade on a 36- foot roadway. 16. WEST BROADWAY AVENUE From the west line of Eleventh Avenue to the east line of Fifteenth Avenue, known and designated as Unit No. 16, Project No. 104- 24000-187: a six-inch thick hot-mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade on a 36-foot roadway. together with concrete curbs, gutters, driveways and incidentals to such improvements on ptoper 'grade -and line where sam� .are :got already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said' im- provements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; contract therefor has been made and entered into with AUSTIN ROAD COMPANY & WORTH CONSTRUCTION COMIFANY ; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of streets, avenues and public places hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting pro- perty and the owners thereof, are as follows, to-wit: 1. ARTHUR STREET From the north line of Kansas Street to the south line of White Settlement Road, known and designated as Unit No. 1, Pro- ject No. 104-24000-187. The estimated cost of improvements is $ 22,381.15 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $ 3.01 : the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $ 8.54 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for 4-foot wide concrete sidewalk is $ 2.54 the estimated amount per square foot to be assessed against abutting property and the owners there- of for 6-inch thick concrete driveway is $ .74 per square foot; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 14.09 plus the cost incurred for concrete driveway construction where specified. 2. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all awning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearingg shall be given and held on the 5th day of Mai , 19 69 , at 9:30 A.M. in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or cause to be given notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, emergency effective May 12, 1967. Such notice shall be by advertisement inserted at least three (3) times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least twenty-one (21) days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended. The City Secretary is further directed to give or cause to be given personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States Mail at least fourteen (14) days before the date of the hearing, postage prepaid, in envelopes addressed to all persons owning or claiming any interest in the respective properties abutting the high- ways, streets, avenues and public places or portions thereof to be improved, as the names of such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or portion or portions there- of which is to be improved is listed as "unknown" on the then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no notice need be mailed. In those cases where the owner is shown to be an estate, the mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be prepared and filed with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known addresses determined as aforesaid of the respective owners and those per- sons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties in said list whose address is shown on the then current rendered or unrendered tax rolls of the City of Fort Worth was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of each notice shall be attached to such certificate. The certificate of the City Secretary will be con- clusive evidence of the facts therein recited. - » w IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. "��Ir! sue■ �! ffIDWN F1-iiilY■EB n» A ��■t r� CITY OF FORT WORTH PUBLIC WORKS DEPARTMENT ENGINEERING DMSION ASSESSMENT PAVING AT 16 LOCATIONS NORTH SIDE PROJECT NO. 104-24000-187 A Neighborhood Meeting was conducted by the Engineering Division at 7:30 P.M. on March 24, 1969, at Circle Park Elementary School, 708 N.W. 21st Street. This meeting was for the purpose of acquainting the 45 property owners present with the improvements proposed for the assessment paving of 16 Locations on the North Side, Project No. 104-24000-187. Mr. Odell Schmidt, Assessment Paving Supervisor, opened the meeting by out- lining the procedures concerning owner participation in the cost of the pro- posed improvements. He explained the methods and policies used to determine assessments and the various payment schedules available to the property owners. In connection with the explanation concerning the street construction standards, Mr. Schmidt outlined the policy pertaining to the location and construction of sidewalks, which are proposed on three units of this project. The meeting was then opened for a question and answer period. Unit 1, Arthur Street: Mr. H. L. Harvey, 207 N.E. 21st Street, owner of Lots b-R and 1, Block 1 , and Lots 22 thru 26, Block 18, Evans Pearson Westwood Addition, explained that he was in the process of constructing a building on Lot 1, Block 14, and the contractor was supposed to put in curb and gutter, sidewalk and driveways during the construction. Mr. Harvey's question was: If this was completed before construction of the street began, would he be allowed credit against his assessment for these improvements? Mr. Schmidt assured him that if these improvements met city specifications, he would be given credit for them. He pointed out, however, that they would have to be completed before the work order for construction of Arthur Street was issued. Unit 2 N.W. Twentieth Street: Mr. Gillespie, representing the Faith Baptist Church, 1600 N.W. Twentieth, Lot 11, Block 17, Baker Heights Addition, ques- tioned the construction of sidewalk along the south side of the church building and commented that when it was finished there would be only two-three feet be- tween the building and the inside edge of the sidewalk. It was explained to him the sidewalk was being constructed at this point for two reasons: 1) to give the people a safe place out of the street to walk, and 2) to tie in with existing sidewalk. Unit 3, Buford Street: T. G. Leach, Administrator of Fort Worth Osteopathic Hospital, 1000 Montgomery Street, Lots 1 thru 5, Block 3, Zihlman's Addition and Tract 3, Montgomery and Pyle Survey, asked if it was possible for Buford Street construction to be done last since the hospital is in the process of constructing an addition to the hospital on the Buford Street side and quite probably the two construction schedules might conflict. Mr. Schmidt stated he would advise the Engineering Division and the contractor of this and see if this could be arranged. k Unit 4,, Blackstone Drive: Will Wright, 4415 Blackstone Drive, owner of Lot 22, Block 2, Brookside Annex Addition, asked about driveway approaches. He ex- plained that he had an asphalt double drive at the side of his property, which he shaxes with the owner of Lot 23, and wondered if the concrete approach would tie in to it. He further commented that this driveway was put in before he sold Lot 23 to the present owner and this was why they shared this driveway. Mr. Schmidt explained that it was shown on the plans to be a double drive approach and would be tied in to the existing asphalt. Mr. D. M. Wilks, 4325 Blackstone Drive, owner of Lot 19, Block 2, Brookside Annex Addition, asked why an 11' drive approach was being constructed when he had only an 8' wide driveway. It was explained that present construction stan- dards required single drives to be 11' wide and the approach would be tied in to his drive. Unit 5 Yale Street: Mr. J. T. Finley, 2109 Yale Street, owner of Lot 91 Block Castleberry Gardens Addition, stated that he had looked at the stakes set in his yard and wondered if the curb and gutter would set up above the yard level. He also stated he needs and wants a double drive and his letter showed he was being charged only for a single drive. Mr. Schmidt explained that as a general rule, the curb and gutter were not constructed above yard level, but if the opposite side of the street set higher, it was possible the curb and gutter might be constructed slightly higher than yard level to insure proper drainage. Mr. Schmidt also stated he would check on the driveway and let him know about it later. Unit 6, N.W. Twenty-Third Street: No questions or objections. Unit 7, Lincoln Avenue: No questions or objections. Unit 8 North Houston Street: Mrs. Raymond Gonzales, 3509 North Houston, owner of Lot 4, Block 2, Washington Heights Addition, asked why'she was being charged full rate for pavement when some of the other people on the street were given a cheaper rate. Mr. Schmidt explained the zoning of this block was industrial and only the property owners actually occupying a residence in this block were given the cheaper rate and since her property contained a rent house, she would have to pay full rate. Unit 9 North Crump Street: Waide D. Little, 3707 North Crump Street, owner of Lot 16, Block 15, Fostepco Heights Addition, was the spokesman for a group of property owners, all of whom were concerned about driveway widths, curb returns between drives, and policies pertaining to the construction of driveways. He stated that he and Mr. W. L. Petrey, 3709 North Crump, had shared a common driveway for a number of yeaxs and they did not understand why each was being given a single drive with a curb return between. Mr. Schmidt explained the usual procedure of constructing single drives on residential property with curb returns between, except where people had double garages and needed the wider driveways, but as a general rule the City did not like to construct double driveways abutting two lots unless they were commonly owned. After much dis- cussion about the matter, Mr. Schmidt stated it might be permissible to build such a drive, but not advisable. He further stated he would check into it further and get a ruling on it and asked that all the property owners interested in getting their driveways changed leave their names and addresses with the clerk and they would be notified at a later date about whether or not the changes could be made. Unit 10, North Crump Street: No questions or objections. Unit 11, Lulu Street: No questions or objections. Unit 12, Chenault Avenue: No questions or objections. Unit 13, La Salle Street: Allen Koontz, 2624 La Salle, owner of Lots 7 and 8, Block 2, Martindale Addition, appeared as the spokesman for a group of eight property owners - all of whom attended the meeting - and asked several ques- tions about the paving and other construction. The main focus of attention was again the construction of the driveways with particular emphasis on the narrow width of the street (26 feet wide) and the close proximity of the houses to the fronts of the lots. There was a question also about the side- walk being constructed on this unit. It was explained that the newly adopted City policy on sidewalk construction stated that sidewalks should be con- structed within two blocks in any direction from a school and this street was within the two block limit of an elementary school. Mr. Schmidt further stated that he would check into the driveway situation and let them know if some of the driveways could be combined. Unit 14, Finley Street: No questions or objections. Unit 15 Ohio Garden Road.: Lem J. Bray, 4513 Ohio Garden Road, owner of Lot 4., Tidwell Subdivision, asked why he was being charged for only 60, pave- ment when his lot is 80' wide. It was explained that the West City Limits of Fort Worth crossed the street in front of his property at a point 201from his west property line and therefore we could only charge him for the portion of paving inside the City Limits. C. E. Matheus, 4321 Ohio Garden Road., Lot 6, Block 79, Westside Acres Addition, and Charles Callaway, 4327 Ohio Garden Road, Lot 7, Block 79, Westside Acres Addition, asked if it would be permissible to have adjoining single drives be- tween the two lots without any curb returns between. Again Mr. Schmidt stated it might be permissible but not advisable to do this, but he would check with engineering and notify them of the decision. Unit 16, West Broadway Avenue: Mr. Charles Kyser, 1916 West Broadway, owner of Lot 22, Block 9, Crawford Addition, stated that approximately two years ago he had been approached by someone from the City Land Department about buying his lot, and the two adjoining lots immediately to the east of his which are owned by his brothers, and he felt that if the City still wanted to buy these lots that it was unfair for him and his brothers to have to pay any assessments for street improvements from which they would not benefit. Mr. Schmidt stated that he felt the City might still be interested in these lots for expansion of Water Department use, but he did not know this for a fact and referred Mr. Kyser to the Land Department and suggested he discuss the proposed assessments with them when he inquired about the possible purchase of these lots. A few additional general questions were answered, and after thanking those present for attending, the meeting was adjourned.
