HomeMy WebLinkAboutOrdinance 6875 ORDINANCE NO.kQC8qt5 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CON- SISTING OF 310 ACRES OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the Municipal Office Building of Fort Worth, Texas, on the 9th day of July, 1973, which date is not more than twenty (20) days nor less than ten (10) days prior to the institution of annexation proceed- ings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 27th day of June, 1973, which date is not more than twenty (20) days nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 390,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 233.33 square miles on January 1, 1973; and WHEREAS, the herinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the herinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 310 acres of land; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following described land and territory, lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: BEING portions of the A. Bradford Survey, Abstract No. 152, the A. Barnard Survey, Abstract No. 107, the W. Simpson Survey, Abstract No. 1459, the John W. Thomas Survey, Abstract No. 1522, the James J. Goodman Survey, Abstract No. 583, the V. J. Hutton Survey, Abstract No. 681 and the A. J. Huitt Survey, Abstract No. 684, situated about 17 miles northeasterly from the Courthouse of Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth and Euless common boundary line, at Texas Highway Department State Highway 183 Station 905+45, in the east pavement line of a proposed north-south future arterial street; said point of beginning being approximately 1,150 feet west and 160 feet south from the northeast corner of the A. J. Huitt Survey, Abstract No. 709. THENCE north 350 feet to a point for corner for the present north right-of-way line of State Highway No. 183. THENCE along and with the right-of-way line of Highway No. 183 as shown on Texas Highway Department plan, State Project No. R.W. 8002-1-4. THENCE north 89 degrees 57 minutes west approximately 690 feet to a point for corner, THENCE north 87 degrees 33 minutes east 98.22 feet to a point for corner. THENCE north 89 degrees 59 minutes west along and with the present Fort Worth city limit line 10,982 feet, more or less, to the place of beginning and containing approximately 310 acres of land. SECTION 2. THAT the foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. THAT if any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. THAT this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. City of Fort Worth, Texas AIM Mayor and Council Communication %W' .*4Q DATE REFERENCE SUBJECT: Proposed Annexation South of PAGE NUMBE►c 6/25/73 PZ-5�t Regional Airport Iof 1 XANCOC The City Plan Commission at its regular meeting on April 25, 1973, SILARDI recommended the annexation of approximately 310 acres of highway right-of-way south of and adjacent to the Regional Airport, as shown NUMAx on the attached map. History This right-of-way is available for annexation by Fort Worth as a-re- sult of a land exchange with the City of Euless (M&C PZ-471, November 22, 1971) . The land exchange settled a long standing boundary prob- lem between the two cities which had caused confusion to residents and property owners. In accordance with the boundary agreement, both cities deleted some land areas. Euless has annexed the areas deleted by Fort Worth and it is now proposed that Fort Worth annex this 310 acres which was deleted by Euless. Services The demand for Fort Worth services in the proposed annexation area will be minimal. The entire 310 acres is within the area being devel- oped by.the Texas Highway Department as a highway complex serving the Regional Airport, and most required installations will be furnished by the State. It will be necessary for Fort Worth to furnish police patrol, work accidents and install City Limit and other directory signs. The Public Safety Director reports that the necessary police patrol can be done by existing forces. Basis for Annexation With the opening of the Regional Airport scheduled for October 1973 and the completion of the highway complex, annexation of the area will give the City of Fort Worth jurisdiction over the south entrance to the airport. Recommendations It is recommended that the City Council: 1) Accept the recommendation of the Plan Commission that the area be annexed; 2) Set July 9 as the date for a public hearing; and 3) Authorize and direct the City Sectetary to publish notice of the hearing as required by State law.
