HomeMy WebLinkAboutOrdinance 6975 ORDINANCE NO. 7 AN ORDINANCE PROVIDING THAT MARGARET STREET FROM WEST VICKERY BOULEVARD NORTH TO THE ALLEY IN BLOCK 3, BROOKLYN HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND THE ALLEY IN SAID BLOCK 3 FROM MARGARET STREET WEST TO LANDERS STREET BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE RE- VERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EF- FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Margaret Street from West Vickery Boulevard north to the alley in Block 3, Brooklyn Heights Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. SECTION 2. That the alley in Block 3 of Brooklyn Heights Addi- tion from Margaret Street west to Landers Street be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 3. That the interest of the City of Fort Worth in the fee to the land in said street and alley is hereby released and shall revert to the adjacent owners of the fee as provided by law, save and except that easements are reserved for any and all existing utility facilities. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. The subject alley and street rights-of-way, acquired by dedication, are not open for vehicular use. Curbing along the north line of Vickery Boulevard has been built across the south end of Margaret Street. A sanitary sewer line and gas main are located in the subject alley and a storm drain is located in the subject street. The reviewing City departments and private utility companies have no objection to this requested vacation provided easements are retained for all existing utility facilities and the vacated rights-of-way are replatted with adjoining property. The City Flan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject rights-of-way as requested. A satisfactory replat has been prepared by the staff. Recommendation It is recommended that an ordinance be adopted vacating subject rights-of-way as recommended by the City Plan Commission.
