HomeMy WebLinkAboutOrdinance 7975 ORDINANCE NO. 2 J AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEY IN BLOCK 7, BOAZ SUMMIT ADDITION, A WIDTH OF 20 FEET AND A LENGTH OF 200 FEET, FROM THE SOUTH RIGHT-OF-WAY LINE OF EAST BROADWAY STREET; PROVIDING FOR THE REVERSION OF THE FEE OF SAID LAND SAVE AND EXCEPT AN EASEMENT COINCIDENT WITH SAID RIGHT-OF-WAY IS RETAINED FOR EXISTING AND PROSPECTIVE UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the Alley in Block 7, Boaz Summit Addition, a width of 20 feet and a length of 200 feet, from the south right-of-way line of East Daggett Street to the north right-of-way line of East Broadway Street, be and the same is hereby vacated, abandoned and permanently closed as a right-of-way for alley purposes. SECTION 2. That the fee to the land in the above described vacated alley right-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT an easement coincident with said right-of-way is retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Shadle, owner of Lots 1-4, 6 and 7, Block 7, Boaz Summit Addition, with the consent of all abutting. property owners, has requested that the City vacate the alley in Block 7, Boaz Summit Addition, a width of 20' and a length of 200' , from the south right-of-way line of East Daggett Street to the north right-of-way line of East Broadway Street as shown on the attached map. The subject alley rightwof-way$ acquired by dedication, is open on the ground, unimproved, and contains -public utility facilities. Reviewing City departments and private utility companies have raised no objections to this request provided the vacated alley right-of-way is replatted with the abutting property and retained as a utility easement. A satisfactory replat has been submitted. The City Plan Commission. has reviewed this request and recommends .that the subject alley right-of-way be vacated. Recommendation It is recommended -that the alley right-of-way be vacated as -recommended by the City Plan Commission.
