AN ORDINANCE PROVIDING THAT A STRIP OF LAND EXTEND- ING FROM THE EAST SIDE OF HEMPHILL STREET IN AN EASTERLY DIRECTION A HALF BLOCK IN LENGTH TO A TWENTY FOOT ALLEY, SAID STRIP BEING KNOWN AS MILL STREET AND LYING BETWEEN THE SOUTH LINE OF LOT 20, BLOCK 31, AND THE NORTH LINE OF LOT 1, BLOCK 40, IN SOUTH FORT WORTH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described strip of land be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever: A strip of land extending from the east side of Hemphill Street in an easterly direction a half block in length to a twenty (20) foot alley, said strip being known as Mill Street and lying between the south line of Lot 20, Block 31, and the north line of Lot 1, Block 40, South Fort Worth Addition to the City of Fort Worth, T&rrant County, Texas. SECTION 2• That the fee to the land in said street is hereby released and will revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and ef- fect from and after the date of its passage. AP ROVED AS TO Pq.9istant City Attorney S R F 4 g Z PETITION TO CLOSE STREET 41�q<<9zl TO TIM HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF FORT WORTH: �-kr1 We, the undersigned, Welex Jet Services, Inc., a corpor- ation, and Texas Steel Company, a corporation, respectfully pe- tition the City Council of the City of Fort Worth to close, aban- don and vacate and by ordinance to declare closed, abandoned and vacated as a street or public thoroughfare of any kind, the fol- lowing described strip of land in the South Fort Worth Addition to the City of Fort Worth, Tarrant County, Texas, to-wit: Lying between the South line of Lot No. Twenty (20) , Block No. Thirty-one (31) and the North line of Lot No. One (1), Block No. Forty (40) in the South Fort Worth Addition, extending from the South side of Hemphill Street in an Easterly dIr`ection, a half block in length, to a twenty (20)-ft. alley running North and South and bounded on the East by the property of the Texas Steel Company. This strip of land is la- beled "Mill Streets on that certain ub-Division Plat recorded in Volume 204, Book 1, Plat 3ecords, Tarrant County, Texas. Said strip of land "dead ends" on the ..eat at Hemphill Street and on the East at the said alley, which alley is bounded on the Ea3t 'o';- said propert` of the Texas Steei Company. Welex Jet Services, Inc. owns and occupies all o£ the land abutting and adjacent to the above described strip of land. Welex owns and occupies said Lot No. One (1) , as well as Lots Nos. Two (2) and Three (3) in Block No. Forty (40) , South Fort Worth Addition, and Welex owns and occupies said Lot No. Twenty (20) , as well as Lot No. Nineteen (19) in Block No. Thirty-one (31) in said South Fort Worth Addition. The above described property now owned and occupied by said Welex was formerly owned by Texas Steel Company, who sold and conveyed it to the present owner. Said "Mill Street" as above described is not now beir_g used as a street or passage- way by the public, and it has never been so used. Travel there- on and use thereof has been confined solely to the undersigned owners of the property abutting and adjacent thereto, and their predecessors in title, and such strip of land does not and cannot M1 -• 4 � r K provide access to any other property and it can never be used as a public street or thoroughfare. There are no gas, water or sewer mains, telephone or electric lines, or any other public utilities property of any kind on, in or under said strip of land; nor or there any franchises or easements of any kind covering or affecting said strip of land. The City of Fort Worth has never performed any services or expended any money in improving or maintaining such strip of land as a street or public thoroughfare, and it is not in the general public interest that the City of Fort north do so, as the City would be legally responsible for doing unless said area is closed, vacated and abandoned as a street or public thoroughfare. At the present time, the general public is getting no benefit from said strip of land as a street or public thoroughfare and t__e City of Fort Worth recei i.es no revenue therefrom. On the other hand, when the said area is closed, vacated and abandoned as a street or public thoroughfare of any kind, and the fee title to said area is released and quit- claimed to the abutting owners by the City of Fort Worth, said area, together with any improvements erected thereon, will be- come taxpaying property. WHEREFORE, in and for the best interests of the general public, petitioners request that by City Ordinance the above described strip and area, be declared closed, vacated and aban- doned as a street or public thoroughfare of any kind, and that the fee title in said area be released and qi.f tclaimed° '-t- the City of Fort north to Welex Jet Services, Inc., a corporation, the legal owner of all the property abutting and adjacent there- to. 4 Respectfully submitted, AT-'EST: WELEX JET SERVICES, INC.
