AN ORDINANCE AMENDING ORDINANCE NO. 17395-02-2007;
ORDINANCE NO. 17411-02-2007; AND ORDINANCE NO. 17430-03-2007
ORDERING A GENERAL ELECTION BY THE QUALIFIED VOTERS
OF THE CITY OF FORT WORTH, TEXAS, ON SATURDAY, THE 12TH
DAY OF MAY, 2007, FOR THE PURPOSE OF ELECTING THE MAYOR
AND COUNCIL MEMBERS FOR THE CITY OF FORT WORTH TO
CHANGE AND ADD EARLY VOTING LOCATIONS AND TIMES
WHEREAS, the City Council adopted Ordinance No. 17395-02-2007 on February 6,
2007 ordering a general election be held on May 12, 2007, for the purpose of electing the Mayor
and the City Council Members for the City of Fort Worth;
V'VHEREAS, the City Council adopted Ordinance No. 17411-02-2007 on February 20,
2007 ordering a general election be held on May 12, 2007, for the purpose of electing the Mayor
and the City Council Members for the City of Fort Worth to add early voting locations and times
and change and add voting day polling locations;
WHEREAS, the City Council adopted Ordinance No. 17430-03-2007 on March 6, 2007
ordering a general election be held on May 12, 2007, for the purpose of electing the Mayor and
the City Council Members for the City of Fort Worth to change and add additional voting day
locations;
WHEREAS, the city desires to change and add early voting locations and times.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:

SECTION 1.
In compliance with the Charter of the City of Fort Worth and in accordance with the
Constitution and laws of the State of Texas, the City Council hereby orders that an election be
held on Saturday, May 12, 2007, as authorized by Section 41.001 of the Texas Election Code, at
which all qualified voters may vote for the purpose of electing a Mayor at large and eight
Council Members from their respective districts.
SECTION 2.
Candidates may file an application for a place on the election ballot commencing
February 10, 2007, in the City Secretary's Office, located in the Municipal Building, 1000
Throclcmorton, Fort Worth, Texas. The filing deadline is 5:00 p.m. on March 12, 2007.
SECTION 3.
That the City Secretary of said City shall ensure that ballots are prepared to be used in
said elections, on which ballots shall be printed the names of the candidates for the at-large
position of Mayor and the names of the candidates from the respective single member districts
for the position of Council Member. The places of the different candidates shall be designated
on the official ballot as Mayor and Member of Council Districts 2, 3, 4, 5, 6, 7, $, and 9,
respectively. The ballots shall be printed in English and in Spanish for use in said election.
SECTION 4.
In the event that there are two or more candidates for the office of Mayor or two or more
candidates from the same single member district for membership on the City Council, the order
in which the names of such candidates are to be printed on the ballot shall be determined by a
drawing to be conducted by the City Secretary; that three (3) days prior to the date on which the
drawing is to be held, the City Secretary shall post a notice in the City Hall of the time and place

of the drawing and shall also give personal notice to any candidate who makes written request
therefore and furnishes to the City Secretary aself-addressed stamped envelope; and that each
candidate involved in the drawing or a representative designated by him or her shall have a right
to be present and observe the drawing.
SECTION 5.
(a) Steve Raborn, Tarrant County Elections Administrator, shall serve as the early

(b) Marty Hendrix, City Secretary of the City of Fort Worth, shall serve as chief
deputy early voting clerk.
(c) Applications for ballots by mail shall be mailed to Steve Raborn at the address set
out in subsection (a). Applications for ballot by mail must be received no later than the close of
business on May 4, 2007.
SECTION 6.
(a) Early voting by personal appearance of Fort Worth Residents that reside in
Tarrant County shall be conducted beginning April 30, 2007, and continuing through May 8,
2007. Such early voting shall be conducted at the following locations:

SECTION 7.
(a) An electronic voting system, as defined in Chapter 121 of the Texas Election
Code, shall be used for voting at the regular polling places at said election and for counting the
ballots and the tabulation of the results. The conduct of the election and the use of the electronic
voting system shall be in accordance with the Texas Election Code.
(b) The Office of the Tarrant County Elections Administrator, Tarrant County
Courthouse, 2700 Premier, Fort Worth, Texas, is hereby established as the Central Counting
Station for the ballots cast in said election.
(c) An individual, having knowledge and experience in the conduct of elections with
the electronic voting system for which the Central Counting Station is established, and being a
registered voter of the City of Fort Worth, shall be hereby appointed by Tarrant County as the
Manager of the Central Counting Station. The Manager shall be in charge of overall
administration of the Central Counting Station and the general supervision of the personnel
working at the Station.
(d) An individual being trained in the operation of the automatic tabulating
equipment installed at the Central Counting Station, shall be hereby appointed by Tarrant County

as Tabulation Supervisors. The Tabulation Supervisors shall be in charge of the operation of the
automatic tabulating equipment.
(e) An individual shall be appointed by Tarrant County as Assistant to the Tabulation
Supervisor. Such assistant shall assist the Tabulation Supervisor in the operation of the
automatic tabulating equipment as directed by the Tabulation Supervisor.
(f) An individual shall be appointed by Tarrant County as Presiding Judge of the
Central Counting Station. She shall maintain order at the Central Counting Station and shall
have such authority as maybe prescribed by the Texas Election Code.
(g) The polling places, on election day, shall be kept open on May 12, 2007, from
7:00 a.m. to 7:00 p.m., and that due return shall be made to the City Council showing the number
of votes cast for the office of Mayor and for membership on the Fort Worth City Council.
(h) The locations of the polling places for the election, except insofar as they may be
changed by the City Council, are set forth on Exhibit "A" attached hereto and made a part hereof.
SECTION 8.
That the City Secretary of the City of Fort Worth shall be responsible for conducting the
election, and shall furnish the election officials said ballots and voting equipment, together with
any other forms, blanks or instruction in accordance with the laws of the State of Texas, insofar
as same are applicable, and with the provisions of this resolution.
SECTION 9.
Any candidate receiving a majority of all the votes cast for the office for which he or she
is a candidate shall be elected to such office. In the event of a tie or in the event that no
candidate receives a majority of all votes cast for the office sought, the Mayor, on the first day
after the completion of the official tabulation and canvass of the returns, shall issue a call,

proclamation and notice for a second election, as required by law, to be held on June 16,2007, to
fill that place, at such second election, the two candidates receiving the highest number of votes
for any such office or offices, as the case may be, in the first election, at which no one was
elected by receiving a majority of all votes case for all candidates for such office or offices, shall
be printed on the ballot and shall again be voted for.
SECTION 10.
This ordinance shall constitute the proclamation, call, notice and ordinance calling and
ordering said elections.
SECTION 11.
That notice of said elections shall be given by: (1) publishing a copy of this ordinance, in
English and in Spanish, at least once, not earlier than the 30th day or later than the l Oth day before
election day in a newspaper published in said City; and (2) not later than the 21St day before
election day, posting a copy of this ordinance, in English and in Spanish, on the City's board
used for posting notices of the meeting of the Fort Worth City Council.
SECTION 12.
That the way and manner of holding said elections, the notice to be given therefore, the
polling places, the personnel and the officers who are to hold same, and all details connected
with the holding of the elections shall be provided for and arranged by the City Secretary; that
the proper notice and publication of this notice, proclamation and ordinance shall be only
cumulative of and in addition to the statutory notice of said elections as herein provided; and that
any omission or irregularity in this notice or in the publication or posting of this notice,
proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate
such election.

SECTION 13.
That in all respects, said elections shall be conducted in accordance with the Texas
Election Code and the City Charter of the City of Fort Worth.
SECTION 14.
That it is hereby officially found and determined that the meeting at which this ordinance
was adopted and said elections were called was open to the public and public notice of the time,
place and purpose of said meeting was given, ail as required by Chapter 551 of the Texas
Government Code.
SECTION 15.
That this ordinance, election order, proclamation and notice shall take effect upon
adoption.
