WORT!!, M ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF TRINITY STREET, MONTGOMERY STREET AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS, DECLARING THE CONTRACT WITH TEXAS B TTULITHIC COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED, DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPORIATE ORDINANCE RECORDS OF S AID CITY WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Texas Bitulithic Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. TRINITY STREET: From the southerly line of West Freeway (also known as West Rosedale) to the southerly line of Rutledge Street, known and designated as Unit No. 4. 2. MONTGOMERY STREET: From the south line of Seventh Street to the north line of Camp Bowie known and designated as Unit No. 5 WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including ordinance No. 4356, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues, and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4356; and, WHEREAS, the street improvements hereinabove mentioned have been com- pleted upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: 1. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. -1- U. The Player bo, and he is heretV, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owners thereof for s,ch improv rents, and the City Secretary is directed to attest same and impress hereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against whirl^ the assessm=nt has been levied, shall, where known, state the name or names of the true own,rs of the respective parcels of property assessed and shall be issued in as amount equal to the difference between the principal amount of the assessment and the amounts of any cre it issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any, which are hereby authorized, granted and allowed against the principal amount of seme one or more of the assess- ments heretofore levied, and the principal amount for which eac' certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and item- ized as follows: III. When each of the certificates have been duly executed as hereinabove provided, same shall be delivered to Texas Bitulithic Compa1w as part pgrment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City.
