HomeMy WebLinkAboutOrdinance 5876 ORDINANCE NO. _5 76 AN ORDINANCE ORDERING A SPECIAL ELECTION OF THE QUALI- FIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, TO BE HELD ON TUESDAY, THE 5TH DAY OF DECEMBER, A.D. 1967, IN THE CITY OF FORT WORTH, TEXAS, ON THE QUESTION OF THE ADOPTION OF A ONE PER CENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY; DESIGNATING THE DATE OF THE ELECTION; PROVIDING THAT SAID ELECTION BE HELD IN CERTAIN PLACES AND APPOINTING PRESIDING JUDGES FOR EACH PRECINCT; PROVIDING FOR ABSENTEE VOTING; PROVIDING FOR THE USE OF VOTING MACHINES AND PRESCRIBING OFFICIAL BALLOTS THEREFOR; ORDERING AND DIRECTING THE CITY SECRETARY TO PREPARE AND ISSUE OFFICIAL BALLOTS FOR ABSENTEE VOTING AND OFFICIAL BALLOTS FOR VOTING MACHINES; PROVIDING FOR NOTICE OF ELECTION AND CONTAINING OTHER PROVISIONS PERTAINING TO SAID ELECTION. WHEREAS, Article 1066, Revised Civil Statutes of the State of Texas, authorises the City Council of the City of Fort Worth to call an election for the purpose of adopting a local sales and use tax within the City of Fort Worth; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a special election be held in the City of Fort Worth, Texas, on Tuesday, the 5th day of December, A. D. 1967, at the polling places hereinafter described, between the hours of 7:00 o'clock, A.M. , and 7:00 o'clock, P.M. , at which election there shall be submitted to the resident qualified voters of the City of Fort Worth for their action thereon the following propositions: "FOR adoption of a one per cent (1%) local sales and use tax within the City. "AGAINST adoption of a one per cent (1/) local sales and use tax within the City. " SECTION 2. That said election shall be held at the following places with the following named persons appointed presiding judges of said election, to-wit: SECTION 3. That said election shall be held under the provisions of the Charter of the City of Fort Worth, Texas, and the Constitution and laws of the State of Texas insofar as same may be applicable, and all duly qualified resident electors of the City of Fort Worth, Texas, shall be allowed to vote upon said propositions, and all electors shall vote in the election precinct of their residence, or as provided by law. SECTION 4. That absentee voting shall be on paper ballots and such ballots shall conform to the requirements of Section 2, Sub-section G of Article 1066c, Revised Civil Statutes of the State of Texas and to the requirements of the Election Code of the State of Texas, as amended, and the language to be printed thereon shall include the following: "OFFICIAL BALLOT INSTRUCTIONS: Place an "X" in the square beside the statement indicating the way you wish to vote. F1FOR adoption of a one per cent (1%) local sales and use tax within the City. AGAINST adoption of a one per cent (1 ) local sales and use tax within the City." SECTION 5. That with respect to the absentee paper ballots, election judges are directed to comply with Article 6.06 of the Election Code of the State of Texas, as amended, which provides that a square shall be placed beside each proposition in which the voter is instructed to place an "X" or other clear mark to indicate the way he wishes to vote) but which also provides that failure of a voter to mark his ballot in strict conformity with the directions on the ballot shall not invalidate the ballot, and the ballot shall be counted if the intention of the voter is clearly ascertainable, except where the law expressly prohibits the counting of the ballot. It is specifically provided that the election officers shall not re- fuse to count a ballot because of the voter's having marked his ballot by scratching out the statement or proposition for which he does not wish to vote. SECTION 6. That voting machines approved by the Commissionexs' Court of Tarrant County, Texas, shall be used at the special election on the 5th day of December, A. D. 1967, in strict compliance with the applicable provisions of Article 7.14 of the Election Code of the State of Texas, as amended, and other applicable provisions of such Election Code. SECTION 7. That the official ballot to be used in voting machines shall be in compliance with the applicable provisions of Article 7.14 of the Election Code of the State of Texas and shall have written or printed thereon the following: "FOR adoption of a one per cent (1%) local sales and use tax within the City. "AGAINST adoption of a one per cent (1%) local sales and use tax within the City. " SECTION 8. That the City Secretary is hereby ordered and directed to prepare and issue ballots for absentee voting and for voting machines and to stamp same "Official Ballot," on which ballots shall be printed the propositions hereinabove set forth. SECTION 9. That the City Secretary of the City of Fort Worth shall furnish election officials said ballots and voting machines together with any other forms, blanks or instructions in accord- ance with the Charter of the City of Fort Worth, Texas, and the laws of the State of Texas insofar as same are applicable. SECTION .10. That this ordinance shall, constitute the election order for such special election, a substantial copy of which shall serve as the notice of election required under the Constitution and laws of the State of Texas. SECTION 11. That the City Secretary is hereby authorized and directed to cause notice of said election to be given by posting a sub- stantial copy of this election order in each of the election precincts of said City and also, at the City Hall not less than twenty (20) days prior to the date set herein for said election. That this notice of said election shall also be published on the same day in each of two (2) successive weeks in a newspaper of general circulation published within said City; the date of the first publication to be at least twenty-one (21) days prior to the date set for said election, and the City Secretary shall 0 see that proper publication is made and proper notice of this election is given in full conformity with the Charter of the City of Fort Worth and the Constitution and applicable statutes of the State of Texas. SECTION 12, That the way and manner of holding this election, the notice to be given therefor, the polling places, the personnel and the officers who are to hold same, and all details connected with the holding of the election shall be provided fox and arranged by the City Secretary; that the proper notice and publication of the notice, proclamation and ordinance shall only be cumulative of and in addition to the statutory notice of said election as herein provided; and that any omission or irregularity in the publication of such notice and proclamation or in the signing of same shall not in any way affect or invalidate such election. SECTION 13, That this ordinance, election order and notice shall take effect and be in full force and effect from and after the date of its passage and it is so ordained.
