HomeMy WebLinkAboutOrdinance 5276 ORDINANCE NO. �Z L ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF GRA1113M ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH WORTH CONSTRUCTTOF CO. FOR THE CONSTRUCTION CF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Worth Construction Co. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. Granbury Road; From Trail Lake Drive to Loop 21T Y.nown and designated as Unit No. 6, 4 WHEREAS,'by sundry proceedings heretofore.passed by the City Council of the City of Fort Worth, Texas, including Ordinance No, 4910 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4910 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in-evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tas Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. Work Order Issued: June 15, 1964 Date of Final Inspection and Approval: September 30, 1964 Working Time Bid: 60 Working Days Working Time Used: 46 Working Days Project Cost .and Financing: Bid Price: $93?�691,�8 Final Contract Cost: $99,741.52 Partial Payments Previously Made: 4 Mounts: $85,230.01 Final Payment Due: $14,511.51 Payment to be Made From Project No. 094-2300-103 Deviation from Bid Price: 1) In order to provide a grade which would smooth the flow of traffic, the subgrade was lowered, requiring additional street excavation, to control the crown properly in the interse4t�on at Trail Lake Drive. + $ 934.45 2) Existing sanitary sewer services were lowered to eliminate conflicts with street construction. + 805.94 3) To provide adequate transitions on side streets and the intersection of Trail Lake Drive, it was necessary to extend the base and hot-mix asphaltic concrete surface. + 3,575.00 4) Variations between estimated and measured quantities account for the additional dif- ference between contract cost and contract price. + 12056,95 Total Overrun $6,372.34 DATE REFERENCE SUBJECT: Final Payment, Granbury Road PAGE NUMBER Widening and Paving, Contract 2 2 11/2/64 FP-170 III, Project No. 094-23000-103 of Compliance With Specifications : Attached is a tabulation of paving test cores showing compliance' with specifications within acceptable construction tolerances. Tests made during construction of the sub-base, base, and pave- ment also show that the material used was in compliance with specifications.
