AN ORDINANCE PROVIDING THAT THE WEST TWENTY- FIVE FEET OF RIGHT-OF-WAY OF HAYNIE STREET BETWEEN EAST LANCASTER AVENUE AND HANDLEY ROAD BE VACATED, ABANDONED AND CLOSED; PRO- VIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEAL- ING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the west twenty-five (25) feet of right-of-way of Haynie Street between East Lancaster Avenue and Handley Road be and the same is hereby closed, abandoned and perma- nently vacated as a street or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. G. Kell, owner of all abutting property,-has- requested--the City to 81 "-1vacate the west twenty-five (25) feet of right-of-way of Haynie Street -� between East Lancaster and Handley load as shown on the attached maps. If this request is granted, the applicant intends to utilize the vacated right-of-way for additional building area. Subject portion of the right- of-way, acquired by dedication, is more than 10 feet behind the existing curb and is extra right-of-way. City departments and private utility companies have reviewed this request and have no objection, provided the applicant plats the vacated right-of- way with adjoining property. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested subject to the conditions recommended above by the City departments and the private utility companies. The Applicant has submitted a replat as requested by the City Plan Commission.
