(rj ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF DILLARD STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH AUSTIN ROAD COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with AUSTIN ROAD COMPANY , for the making and construction of certain street improvements on "e hereinafter described portions of streets, avenues and public places in said City, to-wit: UNIT 1: DILLARD STREET From Pinson Street to Ramey Avenue, known and designated as Unit 1, Project No. 104- 24000-204. UNIT 2: SUNSHINE DRIVE From Johnson Street to Marlin Street, known and designated as Unit 2, Project No. 104- 24000-204. UNIT 3: COTTEY STREET From Village Creek Road to Dillard Street, known and designated as Unit 3, Project No. 104-24000-204. UNIT 4: DRAPER STREET From Walker Street to Marlin Street, known and designated as Unit 4, Project No. 104- 24000-204. UNIT 5: CHARLENE STREET From Dillard Street to 625' east, known and designated as Unit 5, Project No. 104-24000- 204. UNIT 6: ANDERSON STREET From Dillard Street to Stalcup Road, known and designated as Unit 6, Project No. 104- 24000-204. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Port Worth, Texas, including Ordinance No.6552 & 6563, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, W=I AS, the City Council of the City of Port Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6552 & 6563, and WHMEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor: NOW, TH.t37FORE, BE IT ORDAI`734D BY THE CITY COUNCIL OF T?0 CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, to.-ether with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: r . f ' PROJECT NO. 104-24000-204, UNIT 1: DILLARD STREET FROM PINSON STREET TO RAMEY AVENUE, to be improved with six-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade, seven-inch high concrete curb and eighteen-inch wide concrete gutter, so that the finished roadway will be thirty feet wide, and by constructing four-foot wide concrete sidewalks and six-inch thick concrete driveways where specified. Deviation from Bid Price: The final contract cost of this project is $20,834.31 under the revised contract price. The major portion of the savings, $12,600, resulted because 6" metal pipe subdrain was found to be unnecessary and a savings of $3,619.45 was realized because it was not necessary to adjust as many utilities as anticipated. The remaining cost difference, $4,614.86 or 1.2%. of the revised bid price, is attributed to minor variations between quanti- ties estimated in the contract documents and quantities measured and used at the job site. Compliance with Specifications Tests made during construction show that materials used and required thicknesses were in compliance with contract specifications. Recommendations It is recommended that the project described be accepted by the adoption of an ordinance and that final payment of $36,027.78 be made to Austin Road Company.
