ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF WILBARGER STREET
AND PORTIONS OF SUNDRY OTHM STRUTS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WaRTH, TEXAS; ILCLARING THr CONTRACT WITH
AUSTIN ROAD COMPANY FOR THE CONSTRUCTION OF SAID
IMOV71•CENTS FULLY COMPIETED AND PERFORMED; DIRECTING THE ISSUANC$,
EXECUPION AND DELIVERY OF CERTIFICATES IN E'VIDE'NCE OF SPECIAL ASSESS-
MENTS LEVITI) AFTER GIVING EY1rTCT TO SUN-MY CREDITS EMPE'IN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSM'TNTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDI??ANCE BY COPYING THe CAP-
TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AMD EFP'I+'CTIVE DATE.
WIMEAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with AUSTIN ROAD COMPANY for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public places
in said City, to-wit:
UNIT 2: WILBARGER STREET From Wichita Street to 600' west of Miller
Avenue, known and designated as Unit 2,
Project No. 104-22000-121.

WHEREAS,-by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 6532 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 6532 , and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and perfozmmed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:
III.
When 'each of the certifiactes has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the. appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage. eeyyyy

PROJECT NO, 104-22000-121, UNIT 2: WILBARGER STREET FROM WICHITA STREET TO 600' WEST OF
MILLER AVENUE, to be improved with a seven-inch thick hot-mix asphaltic concrete pavement
on a six-inch thick cement stabilized subgrade, seven-inch high concrete curb and eighteen-
inch wide concrete gutter, so that the finished roadway will be approximately sixty feet
wide beginning at Wichita Street and decreasing to forty feet wide approximately 380' east
of Wichita Street, and by constructing six-inch thick driveways where specified.

Deviation from bid price: The final contract cost of this project is $3,327.63
under the revised bid price. The savings accrued because six inch metal pipe sub
drain was found to be unnecessary and variations between quantities estimated in
the contract documents and quantities measured and used at the job site.
Compliance with Specifications
Tests made during construction show that materials used and required thickness
was in compliance with contract specifications except for one minor area; and,
as provided in the contract specifications, the contractor was penalized.
Recommendations
It is recommended that the project described above be accepted by the adoption of
an ordinance and that final payment of $13,016.80 be authorized to Austin Road
Company.
