TO CITY SECRETARY CONTRACT No. 49554
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and
Associates, Inc. , (ENGINEER) made and entered into City Secretary
Contract No. 49544, (the CONTRACT) which was authorized M&C C-28333 on
the 15th day of August 2017 in the amount of $ 199, 500 . 00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $85, 000 which was administratively authorized on
July 9, 2018, and Amendment Number 2 in the amount of $30, 000, which was
authorized by M&C C-28948 on January 11, 2019,
WHEREAS, the CONTRACT involves engineering services for the
following project :
Update of Water and Wastewater Installation policy and Design
Criteria; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated July 10, 2019, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$80, 000. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $394,500._

All other provisions of the Contract, which are not expressly

amended herein, shall remain in full force and effect.

Amendment#3-Additional Services Request— Tapping Fee Policy

Dear Wendy:
Per our meeting with you on July 2, 2019, we are requesting your consideration to amend our
contract to allow for additional services related to assisting the Department with updating the City's
existing Tapping Fee Policy. In accordance with the associated tasks and subsequent language
provided in the original contract, Kimley-Horn will provide the following additional services:
Evaluation
Data collection will include existing tap fee policies from up to 10 entities within Texas. Once
received, data will be compiled into comparison tables for evaluation of fees and policies for the
various entities. Once compiled, Kimley-Horn will conduct one (1) review meeting with City staff to
review the data and establish benchmarks for presentation to stakeholders.
Recommendation
After meeting with City staff, Kimley-horn will analyze the evaluation data and review the City's
revised Utility Cut Ordinance related to its correlation to the tap policy recommendations for both long
and short service line lengths. Recommendations will be summarized for proposed tapping fees,
policy (both short and long services), and kill taps. Kimley-Horn will conduct one (1) review meeting
with City staff to review the recommendations for presentation to stakeholders.
Development
Kimley-Horn will prepare a draft of the new tapping policy. Kimley-Horn will conduct up to three (3)
review meetings with City staff to review the draft policy. Coordination with the City's legal team,
addressing their comments, and preparation of a final draft for adoption by City Council will be not be
included in this amendment and may be deferred to a subsequent amendment. City Council adoption
is anticipated in Spring 2020.
Concurrence
Kimley-Horn will prepare and present up to three (3) presentations to the City's Development Advisory
Committee (DAC) to convey the proposed changes to the Tapping Fees and Policy. Should a DAC

subcommittee be formed to assist with review of the policy changes, Kimley-Horn will attend up to
three (3) DAC subcommittee review meetings to discuss tapping fee policy recommendations.
Kimley-Horn will assist with preparation of one (1) presentation to City Council or Intermodal
Transportation Committee.
The additional amount requested for the outline additional services above is $80,000, and is
summarized below.
