ORDINANCE NO. 7,5 -7 lv AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE STREET RIGHT-OF-WAY ON BELLAIRE DRIVE SOUTH IN THE 3400 BLOCK A WIDTH OF APPROX- IMATELY 60' AND A LENGTH OF 300' FROM THE WEST LINE OF LOT 3, BLOCK 2, BELLAIRE ADDITION, EAST- WARD TO THE WEST LINE OF STADIUM DRIVE AND TO VACATE THAT PORTION OF THE CUL-DE-SAC ADJACENT NORTH OF THIS PORTION OF BELLAIRE DRIVE SOUTH; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described street right-of-way in the 3400 Block of Bellaire Drive South, a width of approximately 60' and a length of 300' from the west line of Lot 3, Block 2, Bellaire Addition, eastward to the west line of Stadium Drive and that portion of the cul-de-sac adjacent north of this portion of Bellaire Drive South, be and the same are hereby vacated, aban- doned and permanently closed as a right-of-way for street purposes, said abandoned right-of-way being more particularly described as follows: Being apart of a surplus City of Fort Worth, Texas, owned property out of the James Smith Survey and the Thomas B. Taylor Survey near the Southwest corner of West Berry Street and Stadium Drive and being more particularly described by metes and bounds as follows: Commencing at the Northeast corner of Block 2, Lot 8, Bellaire Addition to the City of Fort Worth by plat recorded in Volume 204, Page 77, Plat Records, Tarrant County, Texas, said reference point being the point of intersection of the South right-of-way line of Bellaire Drive South and the west right-of-way line of Stadium Drive (formerly Edgevale Road) ; Thence N. 89 degrees 44 minutes 00 seconds W. with the North line of said Block 2, same being the south right- of-way line of Bellaire Drive South 309.61 feet to a point for corner; Thence N. 00 degrees 16 minutes 00 seconds E. across Bellaire Drive South 58.60 feet to the Point of Beginning, said point lying in the North right-of-way line of said Bellaire Drive South; Thence in a Northeasterly direction with the arc of a curve to the left having a radius of 40.00 feet and a central angle of 68 degrees 38 minutes 11 seconds, 47.92 feet to a point for reverse curve; Thence in a Northeasterly direction with the arc of a curve to the right having a radius of 40.00 feet and a central angle of 27 degrees 24 minutes 16 seconds, 19.13 feet to a point for corner in the Southerly right-of-way line of West Berry Street; Thence in an East-Northeasterly direction with the Southerly right-of-way line of West Berry Street along an arc of a curve to the left having a radius of 503.00 feet and a central angle of 05 degrees 17 minutes 55 seconds, 46.52 feet to a point for corner; Thence in a South-Southeasterly direction with the arc of a curve to the right having a radius of 50.00 feet and a central angle of 82 degrees 45 minutes 02 seconds, 72.21 feet to a point for corner in the above mentioned North right-of-way line of Bellaire Drive South; Thence N. 89 degrees 44 minutes 00 seconds W. with the North right-of-way line of said Bellaire Drive South, 123.31 feet to the POINT OF BEGINNING and containing 4,297.268 square feet or 0.099 acres of land, more or less. AND All that certain lot, tract and parcel of land out of the James Smith Survey and the Thomas B. Taylor Survey at the Southwest corner of West Berry Street and Stadium Drive and being more particularly described by metes and bounds as follows: Commencing at the Northeast corner of Block 2, Lot 8, of Bellaire Addition to the City of Fort Worth by plat recorded in Volume 204, Page 77, Plat Records, Tarrant County, Texas, said point of beginning being the point of intersection of the South right-of-way line of Bellaire Drive South and the West right-of-way line of Stadium Drive (formerly Edgevale Road) ; Thence N. 89 degrees 44 minutes 00 seconds W. with the North line of said Block 2, same being the South right-of-way line of Bellarie Drive South 103.60 feet to a point for corner; Thence N. 0 degrees 16 minutes 00 seconds E. across Bellarie Drive South 58.60 feet to the Point of Beginning, said point lying in the North right-of-way line of said Bellaire Drive South and the South line of a tract of land conveyed to the City of Fort Worth by deed recorded in Volume 4523, Page 513 Deed Records, Tarrant County, Texas, and being more particularly described as follows: Thence in a Northeasterly direction with the South line of said Fort Worth tract along an arc of a curve to the left having a radius of 57.36 feet and a central angle of 72 degrees 22 minutes 44 seconds, 72.46 feet to a point for corner; Thence N. 17 degrees 07 minutes 30 seconds E. with the Easterly line of said Fort Worth tract 44.73 feet to a point for corner in the West right-of-way line of the aforementioned Stadium Drive; Thence S. 31 degrees 54 minutes 00 seconds E. with said West right-of-way line of Stadium Drive 2.50 feet to a point for curvature to the right, said curve having a radius of 258.16 feet and a central angle 19 degrees 28 minutes 00 seconds; Thence in a South-Southeasterly direction with the arc of said curve to the right and the South line of said Stadium Drive, 87.71 feet to a point for corner at the intersection point of the South line of said Stadium Drive with the North right-of-way line of the aforementioned Bellaire Drive South; Thence N. 89 degrees 44 minutes 00 seconds W. with the North right-of-way line of said Bellarie Drive South 102.28 feet to the Point of Beginning and containing 2,390.964 square feet or 0.055 acres of land, more or less. SECTION 2. That the fee to the land in the above described street right-of-way is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing utilities including water, telephone and drainage facilities as well as a 20' access easement is specifically retained (as shown on replat filed of record) with driveway approaches at either end. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. The subject right-of-way, acquired by dedication, is open and partially improved and contains water and telephone facilities. Additional City property, adjoining the subject right-of-way to the north, has been purchased by the applicant. Reviewing City Departments and private utility companies have reviewed this request and have no objections to the request provided that: 1. The vacated property is replatted with adjoining properties; 2. Drainage easements are provided as requested. 3. Utility easements are provided as requested; 4. A 20' emergency access easement is provided through the parking area, and driveway approaches at either end are provided and left unencumbered; 5. Drainage is handled via appropriate design to be approved by the Public Works Department. A satisfactory replat has been submitted to staff. The City Plan Commission has reviewed this request and recommends that subject right-of-way be vacated as requested. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as requested.
