AN ORDINANCE VACATING, ABANDONING AND CLOSING THE 5 FOOT UTILITY EASEMENT ALONG THE SOUTH LINE OF LOT J, McCARTHY ADDITION, A LENGTH OF 100 FEET, AND PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORD- INANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the 5 foot utility easement along the South line of Lot J, McCarthy Addition to the City of Fort Worth, said easement being 100 feet in length, be and the same is hereby extinguished, vacated, closed and permanently abandoned as an easement for public utilities. SECTION 2. That the fee to the land in the above described easement is hereby released and will revert to the adjacent owners as provided by law, save and except that an easement is reserved therein for any and all existing utilities. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Graves, Jr. , owner of Lot "J", McCarthy Addition, and the western AM"" portion of Lots 4, 5 and 6, Mt. Vernon Place, has requested that the City vacate the 5' utility easement along the south line of Lot "J", McCarthy WALLS Addition, a length of 100 feet, as shown on the attached map. LME Subject easement, acquired by dedication, is not in use and contains no pub- lic facilities. Reviewing City Departments and private utility companies have no objections to this request. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject easement as requested. A satisfactory replat of the property has been submitted to City Staff. Recommendation It is recommended that an ordinance be adopted vacating subject easement as recommended.
