HomeMy WebLinkAboutOrdinance 677 -. rt ORDINANCE N0. r AN ORDINANCE GRANTING TO THE ST.LOUIS SOUTHWESTERN RAILWAY COMPANY OF TEXAS THE RIGHT TO /CONSTRUCT, MAINTAIN, 0 AND OPERATE A LINE OF TRACK ON NORTH HOUSTON STREET IN THE CITY OF FORT WORTH, TEICAS, FROK THE NORTHWESTERLY LINE OF NORTH SECOND STREET AND EXTENDING THENCE NORTHWESTERLY UPON AND ALONG SAID NORTH HOUSTON STREET AND ACROSS ALL INTEBSEM6 ING STREETS AND ALLEYS TO THE SOUTHERLY LINE OF TRINITY AVENUE, AND WITH THE FURTHER RIGHT TO CONSTRUCT, MAINTAIN a AND OPERATE SIDE' TRACKS, SWITCH AND SPUR TRACKS CONNECTING WITH SAID TRACK TO BE CONSTRUCTED ALONG SAID NORTH HOUSTON STREET AND ACROSS ALL INTERSECTING STREETS, AND EXTENDING TO THE EASTERLY AND WESTERLY BOUNDARIES OF SAID NORTH HOUSTON STREET AND ACROSS ALL INTERSECTING STREETS AND ALLEYS. BE IT ORDAINED BY THE COMUSSIONERS OF THE CITY OF FORT WORTH; SECTION is The St. Louis Southwestern Railway Company of Texas is hereby granted the right, privilege and franchise to construct, maintain and operate a certain line: of track be- ginning at the Northwesterly line of North Second Street, sad extending thence approximately along the center of North Houston Street and across all intersecting streets and alleys in a northwesterly direction to the Southerly line of Trinity Avenue, and with the further right, privilege and :franchise on the part of the St.Louis Southwestern Railway OompazW of Texas, to con» struot, maintain, and operate side tracks and switch and spur tracks on both sides of said North Houston Street, connecting with said track to be oonstrwoted approximately along tEe central line thereof, and to be constructed, maintained and operated across all intersecting streets and alleys and to the masterly and Westerly boundary lines of said North Houston Streets a blue print of which such street to be so occupied by said track is hereto attached, marked " Exhibit A " and made a part of this ordinance. ^ SECTION 23 It is provided that: (a) the rails and m ..� � 2 equipment used in the construction of all of amid tracks on, across or along said streets shall be of standard quality, and the construction shall be satisfactory to the City Engineer, the Board of Commissioners of the City of Fort Worth. (b) St* r r Louis Southwestern Railway Comparq of Texas shall maintain the space between the rails of all said tracks, and for eighteen inb'lres on each wide thW `d6—MI <""as may-t@ with the taps of any such tracks, and the same shall be oonstraoted and maintained so as not to unnecessarily obstroot or endanger travel on said streets, or any portion thereof: and the construction, maintenance, and operation of said tracks, and of the streets between the rails, and for eighteen inches outside of such rails, shall be satisfactory to the City Engineer of the City of Fort Worth,p and the Board of Commissioners of the City of Fort Worth. r SECTION 3: The said St.Louis Southwestern Railway Company of Texas, its stw000soro and assigns, shall at it or their ova cost and exposse, pave and repave or otherwise surface and re- surface and keep in good order and condition the space between the rails of all of said tracks, and for eighteen inches on each side thereof, with the same material with which the streets are paved and surfaced, and shall conform its or their tracks, or any part thereof, to the proper grade of said streets, and change the grade thereof as often and whenever the grade of said streets are ohanged, so that all parts of said tracks shall always be kept at the duly established grade line, or as near thereto as the surface of the grade of the streets will permit. SECTION 4: Said St.Louis Southwestern Railway Company of Texas, its saooeesors, and assigns, do agree to indemnify and save the City of Fort Worth harmless from anyy and all dwagos, claims, judgment, and other costs and expense recovered against or paid by the said City of Fort Worth, by reason of injuries either to persons or property approximately paused by or arising from or out of the .construction, maintenance and operation of said tracks, upon and along said streets; provided said RaLlwaiy CompazW is notified by said City of Fort Worth of the claim, so • � 3 made or the suit brought against said City and approved the settlement of the elaim or is permitted to pertioipate in the -defense+of any suit brought thereon.
