AN ORDINANCE AUTHORIZING THE FORT WORTH TELEPHONE COMPANY, A
CORPORATION, TO GRANT, SELL, CONVEY AND DELIVER TO THE SOUTH-
WESTERN TELEGRAPH & TELEPHONE COMPANY, A CORPORATION, ALL THE
UNDERGROUND CONDUITS AND CONDUCTORS OF THE FIRST NAMED C011PANY,
TOGETHER WITH ALL LATERALS AND DISTRIBUTING POLES OWNED BY SAID
COMPANY CONSTRUCTED AND MAINTAINED IN, UNDER AND ABOV�HETY � Tt�TIIHET '__
ALLEYS AND HIGHWAYS OF THE CITY OF MT I=Mr.;-
Be it ordained by the Board of Commissioners of the City of
Fort Worth, Texas:
Section 1. That the Fort Worth Telephone Company, a corporation
organized under the laws of the State of Texas, be,
and it is hereby authorized and empowered to grant,
sell, convey, assign and deliver, upon such con-
sideration as it may determine, to the Southwestern
Telegraph & Telephone Company, a corporation, all
and singular the telephone conduits, laterals, con-
ductors, manholes and all distributing poles here-
tofore constructed, and now owned by said Fort Worth
Telephone Company, existing in, under and upon the
streets, alleys and highways of said City of Fort
Worth.
Section 2. That upon the sale of said conduits, manholes,dis-
tributing poles, etc. , by the said Fort Worth Telephone
Company, the said Company shall thereby be held to
have abandoned and forfeited its franchise rights
and privileges by it owned and held to con6truct,
maintain and operate a telephone system upon the
streets, alleys, highways, eto., of the said City
of Fort Worth, Texas, so far as such rights mpy
have been conferred by ordinance, or resolution,
of the governing authorities of said City.
Section 3. It is further provided that the acquisition of
the foregoing property by said Southwestern Telegraph
do Telephone Company shall not be construed as the
grant of an additional franchise, but shall be held
and taken as part of the existing privileges it now
enj.oye in the City of Fort Worth and subject to. the
obligations and responsibilities which are now or
may hereafter be imposed by law.
Section 4. This ordinance shall take effect from and after its
final passage and approval as provided by the pro-
visions of the City Charter of the said City of Port
Worth, Texas.

To the Honorable Board of Commissioners of the City of
Fort Wort' i
Your petitioner, the Fort Worth Telephone:.CQmpaky,
would represent and show unto Your Honorable Body that it has long
since ceased to do business in the City of Fort..Worth; that its
plant has been dismantled and its property, save and except cer-
tain underground conduits to which this petition relates, swept
away by decree of foreclosure in the Distriot Court of Tarrant
County, Texas.
Your petitioner would further show that all ids-�ro- Cr-
was included in the aforesaid sale under foreclosure except certain
conduits whose position and location are indicated by the blue
prints that accompany this petition. •
Your petitioner would further show that said conduits
are of no value to the City of Fort Worth, but in the event of
their sale by petitioner would add an element of taxable. value
to the holdings of any Company purchasing same.
Your petitioner would further show that it has an
opportunity now of selling said conduits to the Southwestern
Telegraph & Telephone Company, which Company has offered to pur-
chase same from petitioner, and in the event of such sale it will
obviate the necessity on the part of said purchasing Company of
tearing up and otherwise excavating into the streets for the pur-
pose of laying such conduits for its own wires and lines of com-
munication.
Your petitioner further shows that it expects to ut&lize
the proceeds of such sale, to the extent that same may be appli-
cable in the payment of arrears of taxes it is owing the City of
Fort Worth. In this connection your petitioner would show that it
has no other way of raising money for such purposes than by the
sale of such conduits, and unless permitted to do so such taxes
will perhaps remain existent as an unpaid obligation on its part.
WHEREFORE, petitioner prays that it be granted permis-
sion and authority to make such sale and that the ordinance which
has been framed and hereto attached,be passed and enacted by your
Honorable Body.
