BE IT ORDIINSD BY THE CITY COUNCIL 07 THE CITY OF FORT WORTH, TXUSt SECTION I The following definitions of worts and terms are hereby specifical- ly adopted for the purposes of this Ordinance, such definitions beings "Meat Product" shall mean any edible part of the carcass of azw cattle, sheep, swine or goat which is not manufactured, cured, smoked, processed or otherwise treated. "Meat Food Products" shall mean any article of food or any ar- ticle which enters into the composition of food for haman consump- tion, which is derived or prepared, in whole or in part, from day portion of the carcass of any cattle, sheep, swine, or goat, if such portion is all or a Considerable and definite portion of the article, except such articles as organotherapentic substances, meat Juice, meat extract, and the like, which are only for medicinal purer poses and are advertised only to the medical profession. "Packing Plant" shall mean an official sisaghtering plant. Neat Canning Plant" shall mean a plant where meat products v or meat food products are canned. *Neat processing and Manufacturing Plant" shall mean a plant where, in addition to the custdms.ry meat cutting and processing, seat food products such as fraAkfurtars, vienna and bologna are processed and. manufactured. "Wholesale Meat Plant" shall mean a plant where carcass meat is processed into chili, ground meat, fresh saucage and/or into the various meat cuts for wholesale trade. 'Frozen food Locker Plant" shall mean a plant where carcass seat is processed and stored in refrigerated compartments. "Horse Meat" shall mean the meat or flesh of any animal of the equine genus. "Person" shall mean any natural person, firm, association of persons, organisation of persons, or corporation. *fiscal year of the City of Fort Worth" shall mean the period of time beginning on October 1 and ending at midnight the nest ensue• ing Septesi"er 30the S30TI0N II It shall be unlawful for any person to operate or engage in any of the occupations, vocations or businesses hereinabove defined as Packing Plants, Meat Canning Plant, Meat processing and Manufacturing Plant, Whole- sale Meat Plant, and frozen Food Locker Plant without first baying made ap- plication in writing to the Director of the Department of Public Health and Welfare for a permit so to do and receiving and holding a permit to operate or engage in such occupation, vocation or business. The application shall be made upon forms prescribed and furnished by the Department of Public Health and Welfare, and such application shall show the name of the appli- cant, the nature of the business, the location of the premises upon which the business is to be carried on and such other information as may be re- quired by the Director of the Department of Public Health and Welfare. ♦ written permit to engage in one or more of the hereinabove speci- fied occupations, as the case may be, shall be issued to the applicant when an applicant has complied with all applicable federal and state statutes, city ordinance% and rules and regulations of the Department of Public Health and Welfare governing sanitation and protection of public health, F and has furnished satisfactory proof of such compliance, together with satisfactory proof of future compliance for the term of the permit. ♦by permit granted hereunder shall remain in ititll force and effect until the end of the fiscal year of the Citj of fort Worth in which said permit is issued, ulless sooner revolved for cause, and a failure to cos- piy with atty ordinance of the City of fort Worth, or lrx of the State of sews, or rule and regulation of the Department of Public Health and Wel- fare concerning sanitation and public health shall be deemed cause for we- vocation of the permit. The Director of Public Health of the City of fort Worth shall have the full right and power to revoke any permit issued under the terms barw- of if the permitee shall have given cause for the revocation of such per- mit, A renewal permit shall be secured annually in like manner as the original. The fees hereinafter set out shall be charged for each permit and each renewal permit, and such fee shall be payable in full for any fraction of the fiscal year for Mich the permit is granted. Hach permit granted hereunder shall be nontransferable, and shall be displayed conspicuously at all times within the place of business for which the permit is granted. When a permit is issued by the Director of the Department of Public Health and Welfare under the terms of this ordinance, an official establish- ment number shall be assigned to the holder of said permit by the Director of the Department of Public Health and Welfare. BWCTION IT All packing plants. wholesale meat plants, seat canning pleats and meat processing and manufacturing plants shall be located in a building and the building, premises and equipment shall be constructed and main- tained in accord with the following requirementet 1. 1W roew used for the processing or handbag of seat products and meat food products shall be of a size to provide sufficient spews for all esrplayess,. egtpsent and storage of neat and meet food products so that the working areas are not crowded and the rocs can be operated in a sanitary manner. Walls and ceilings shall belie smooth, washable, light colored surfaces and shall be ]Dept clean. 2. Floors shall be constructed of concrete, the or other Imper- vious material and shall be properly graded to trapped floor drains. 3. All rooms shall be well lighted. 4. All rooms not refrigerated shall be well ventilated. Xschau- ical ventilation shall be provided when necessary to exhaust odere and to prevent condensation, s. toilet facilities and dressing rooms shall be provided on the premises for all smpleyses and shall be ample in Omber and also and conveniently located. the doors of all toilet rooms eball be self-closing. 'Toilet facilities and dressing rooms shall be ]Dept clean. 6. Convenient head washing facilities shall be provided, inciwd,. Lug wars. sannisg water, soap and approved sanitary tewols. the use of the cosemon towel is prohibited. Wash basins shall bo kept e2Ss3. 7. Wsildiaga shall be of rat proof censltotisa in accord with City Ordinance Ho.- 2181 and `mendments thereto and the build— ing or buildings and premises shall be maintained free of rats and mice. 8. Sinks of a size and design suitable for washing uteLails and equipment shall be provided and maintained in a sanitary con.- dition. Hot water at a temperature of 18001. or steam shall be prodded and shall be available in sufficient quantities to meet the needs of cleaning processes. 9. All openings into the cater air shall be effectively screened and doors shall be self—closing unless other effective mesas are prodded to prevent the access of flies. Control measures against flies and other insects shall be effectively carried out on the entire premises. 10. All plumbing shall be maintained in a sanits 7 manner in accord with the City Plumbing Ordinance and shall be connected to the city sanitary sewer. 11. trash and garbage oball be kept in covered containers in accord with citW ordinances. I+12. Proper utensils and equipment shall be provided and they shall be maintained in a sanitary manner and the following specifie provisions shall be complied with: a. Chili kettles shall be constructed of stainless steel or.similar noncorrosive metal and shall be constructed with a steam jacket and an outlet opening in the bottom. Valve on outlet shall be so constructed as to be easily cleanable. b. All tube, sausage trucks, tables, shelves and other equip. meat which comes in contact with most predncts and meat food products shall be. constracted of galvanized sheet steel, stainless steel or similar non-corrosive metal. All Joints shall be made smooth so sa to be readily clean. able. Outting boards and meat blocks shall be constructed of hard wood and shall be maintained fires of cracks. c, All grinders, saws, steak machines, knives, steels and other utensils mad equipment shall tie cleaned at least daily, and as often morel as is necessary to maintain them In a sanitary condition. 13. To person shall work in such establishments unless he is free of any communicable disease and has a valid 14alth certificate issued by the Director of Public Health and Welfare. All per- sons working in a meat cutting processing, or canning room shall wear"suitable head coverings. such as caps or hair nets, No person shall smoke in a meat cutting, processing or canning room. SBDTIOT V It shall be the duty of every person conducting, operating or mein- twining a meat products or meat food products establishment of any kind in the City of Fort Worth to keep the floor, side walls, -pillars. partitions. ceilinge, receptacles, refrigerators, Implements and machinery of every such establishment, and all cars, tracks and vehicles used for the trans- portation of food products closed and in a clean and sanitary condition; and for the purpose of this chapter, unclean and insanitary conditions shall be deemed to exist if the food in the process of production, proper- ation,manufacture, packing, storing, sale distribution or transportation is not securely protected from flies, vermin, dust. dirt, and from other foreign or injurious contamination, or if the refuse. dirt or waste pro- ducts subject to decomposition and fermentation are not removed 'daily, or if the trucks, trays, boxes, bucket or other receptacles. chutes, platforms, ranks, tables, shelves, knives, sera, cleavers and other utensils, or the machinery used in moving, handling, cutting, chopping, mixing, canning or other processes are not thoroughly cleaned daily, or if the clothing or hands of the operatives or other persons employed therein is unclean. SECTIOR VI Any meat product or meat food product sold in the City of Fort Worth which is of such character or so mall that it cannot be marked with a brand or stomp and which has been inspected and passed maybe packed in a Domestic most label. The domestic meat label shall show the contents of r the container and the U. S. D. A. establishment number or the name of the Plant and the City of Tort Worth establishment number. An meat products and moat foot products sold, offered for sale or stored in the City, of Port Worth shall either bear an inspectorls mark as required ig Section 17, Article 7, Ordinance 30. 1271 or shall be within a container which burs a domestic meat label as required herein, or shall be within a container which bears a meat label complying with the terms of the ordinance equivalent to this ordinance passed and enforced by the mad— cipality within which the establishment from which such meat products or meat food products originated. SETION 4II a. All meat oducts and meat food products sold or offered for sale in package form in the City of Tort Worth shall be labeled. A11-such labels @hall show the name and address of the manufacturer or distributor, the true name of the contealj,a 11et .of the ingredients of said contents shown in the order of their prominence, the net weight, and the inspection legend. b. 3o meat product or meat food product and no container thereof shall be labeled with ate false or deceptive name or wording, c. Sausage is a comminuted product made from most products seasoned with condimental proportions of coudimental substance@, provided, that if cereal, vegetable starch, starchy vegetable flour, soya flour, dried milk or dried skis milt is added, the label shall show the no of each such add- ad ingredients, as, for example, "ooreal aided", "soya flour added," etc. as the case may be, and if more than 3j% by weight of such added ingredients are added, the label shall plainly show the percent of added cereal or other allot edible Ingredients* d. If saasage As made from meat by-produots, the names of the by�- productss each as beef tripe, beef hearts, sheep livers, pork snouts, beef Imp, pork bywproducts and cow udders shall be plainly shown as ingredients on. the labol. o. When artificial coloring or artificial flavoring is added to W meat product or seat food prodnot, the label shall plainly show this fact. f. !rash ground meat shall consist of chopped fresh seat with or without seasoning. Such fresh ground meat msy be called "hsaWrd sr", "ground beef', 'ground chuck° or some similar name. When cereal or any other edible food is added to such ground most, the nature and mount of added food shall be plainly shown on the label, or in lieu of a label, a suitable placard may be displayed with the meat in the most counter so as to plainly inform the customer as to the ]rind and amount of added foods contained in the ground meat. g. The word °fresh" shall not appear on the label of any meat pro- duct or seat food product to which has been added aq9 preservative as per- mitted in this ordinance or to which has been added salt in preservative amounts. 830TION VIII All neat products and meat food products which we sold or offered for sale in the City of ?art Worth shall comply with the following regnire- sentst a. No preservatives of any kind shall be added to ground fresh meat except that not over one-tenth of one per vent (0.1%) of bemsosts of soda any be added, provided the label plainly shows this fact. b. It is unlwftal to use any sulfites, such as sodium sulfite, in any around seat, sausage or any other meat prodnat or seat food product intended for use by human oonsunption a. The use of sodium nitrite, potessima nitrite, sodium nitrate, or combination of nitrites and nitrates in curing processes shall not result in the presence of more than 200 psrts; per million in the finished seat foe&product. d. Water or ice may be used in the preparation of sausage which Is not 0006d in an amount not to exceed three per vent (3%) by weight of the total ingredients used. Sausage of the kind which is cooked after the water or ice is added may contain not more than ten per cent (10%) of added misture. OWTION u In addition to all other requirements of this ordinaaaa, Vrosen rood Lookers shall comply with the following specific requiresentat 1. No meat product or seat food product can be sold or offered • N for sale except that which hds been inspected and narked in accordance with Ordinance To. 1271 and this ordinance. 2. It shall be unlawful for any firm, person or corporation to store, process, handle or keep on the premises of a frozen locker plant any uninspectod meat unless the following rer quiresents are complied witht a. Zarb carcass or piece of carcass of meat shall be labelid with the name, address and telephone number of the owner. no mach carcass or piece of carcass of uninspected meat shall be stored in the cooler separate fro& inspected meat and protected so that the uninspected meat will not come in contact with inspected meat. o. Zpdyment and utensils used for processing uninspected meat shall be claimed and treated with steam or hot water at 18007. for one minute before such equipment and uten� oils are used for processing inspected seat* d, the manager, owner, or responsible person shall maintain r000rds sharing the weight and ownership of all uninspected seat received by the looker plant. 111 such records shall be available for inspection by the Director of the Depart— want of Pnblio Health and Welfare or his representative. SZOTION Z Anything to the contrary hersinabove contained notwithstanding, the provisions of this ordinance shall not apply to establishments operating under inspection by the United states Department, of Agriculture. Further, the provisions of this ordinance requiring inspection of the plant and setting out rogalatione for such plants shall not only to establishments located in a voicipality having a seat ordinance in effect which is at least the equivalent of this ordinance, if the Health Officer of said city Is enforcing such ordinance, but mast products and most food products pro— cessed in such an establishment and sold or offered for sale in the City of Fort Worth shall beer the inspection legend of the hiealth Department of the City vhorsis such establishment is located and shall in all respects oosply with Sections 6, 7 and 8 of this ordinance. ' V SICTIOX ZII It shall be anlavful for say person, firm or corporation to keep, store, displq, or offer for sale any horse meat in any refrigerator, meat cooler, or cold storage facility of any type in which there is also ]rapt, stored, displayed or offered for sale any food for human consumption. SACTIOt 2111 this ordinance shall be and is hereby declared k be c atUtive of all other ordinances of the City of ?ort Worth, and shall not operate to repeal or affect any such ordinances or ordinance cmept insofar as the provisions of such ordinances or ordinance are inconsistent or in conflict with the provisions of this ordinance, in which Instance or instances such conflicting provisions in said other ordinance or ordinances shall be and are hereby repealed. • SECTION ZIT If any section, sub-section, sentence, clause, or phrase of this or• dinsaee is for sny reason held to be unconstitutional., such decision shall not affect the validity of the remaining portions of this ordinance, and all the remainder of this' ordisimas not so declared to be invalid shall continue to be in fall force and affect. The City Council of Port Worth, Tezas, hereby declares that it mould have passed this ordinance and each section, sub-section, sentence, clause, or phrase thereof irrespective of the fact that any one or more sections, sub-sections, sentences, e14nre4. or pkxmsse be declared unconstitutional.
