AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF IMPROVING THE FOLLOWING STREET AND PORTIONS THEREOF, TO-WIT: GAMBRELL STREET FROM THE EASTERLY LINE OF JAMES STREET TO THE WESTERLY LINE OF SOUTH ADAMS STREET, KNOWN AND DESIGNATED AS UNIT NO. 2$ IN THE CITY OF FORT WORTHS TARRANT COUNTY1 TEXAS: AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL, ASSIGNABLE ASSESSMENT CERTI- FICATES TO BROWN & ROOT, INC. THE CONTRACTOR PERFORMING SAID WORK, AND PR64IDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE AND APPROVAL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTHS TEXAS9 DULY ASSEMBLED: 1. That the work of improving the following street and portions thereof in the City of Fort Worth, Texas, to-wit: Gambrell Street, from the Easterly line of James Street to the Westerly line of South Adams Street, known and designated as Unit No. 2, by raising, grading, filling, widening, paving, repaving, or re- pairing same, and by constructing, reconstructing, or realigning concrete curbs and gutters where determined necessary by the Director of Public Works, and by constructing such other drains, incidentals, and appurtenances thereto as deemed necessary and adequate by the Director of Public Works, and as provided for by the Plans and Specifications for such improvements; said paving consisting of the construction or reconstruction of a base levelling up course and the construction or reconstruction of a 1*" asphaltic concrete surface course, all of the materials, types, and widthw as shown on and provided for in the Plans and Specifi- cations, and all of same having been performed and completed in full accordance with all of the terms and provisions of the con- tract dated July 23, 1947, between said City of Fort Worth, Texas, and Brown & Root, Inc., approved by Ordinance of the City Council of said city, dated August 6, 1947, and said Plans and Specifica- tions therein contained; and said Director of Public Works having measured, examined and caused to be tested the finished improve- ments by the means and in the manner provided by the terms of said contract and the Plans and Specifications therein contained, and said Director of Public Works, having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said Plans and Specifications, and said Director of Public Works having approved and accepted said work and improvements and having heretofore issued his Certification of Completion and Final Acceptance, and so certified to the City Manager and to said City Council and recommended that said City Council accept and receive said work and the improvements as con- structed and completed by said Brown & Root, Inc. , and said work and improvements having been found by the City Manager of said City of Fort Worth, Texas, to have been performed and completed in full compliance with said contract and said Plans and Specifica- tions therefor, and having been accepted by said City Manager, said work and improvements are hereby found by said City Council to have been performed and completed by said Brown & Root, Inc. in full compliance with the terms and provisions of said contract and said Plans and Specifications therefor,and same are hereby accepted and received by said City Council of the City of Fort Worth, Texas. 2. That the Mayor and City Secretary of the City of Fort Worth, Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc. special assignable assessment certificates evidencing the assessments levied against the properties improved abutting upon the above described street and against the real and true owners thereof, which, by the terms of said Contract, the City of Fort Worth, Texas has agreed and obligated itself to issue and deliver to said Brown & Root, Inc. in accordance with the provisions of the Final Assessment Ordinance and other proceedings heretofore had and adopted by said City Council; said Special Assessment Certi- ficates shall be executed in the name of said City by its Mayor and City Secretary, and impressed with the seal of said City, and dated as of the date hereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said City, and deliver same to said Brown & Root, Inc. 3• This Ordinance shall take effect and be in full force from and after its passage.
