AN ORDINANCE APPROVING Tlr REPORT OF TAE DEPARTI)MIT OF PUBLIC WORKS: AWARDING THE CONTRACT FOR THE IMPROVE011T OF A PORTION OF DEXTER ASI= IN THE CITY OF FORT WORTH, TEXAS, AND AUTHORIZ-' ING ITS EXECUTION: 11AKING APPROPRIATION FOR THE INDEBTEDNESS IN- CURRED THEREBY: AND DIRECTING THE CITY ENGITT= TO PREPARE ESTI- MATES. WHEREAS, on the 16th day of June, 1949, by Ordinance passed and ap- proved by the City Council of the City of Fort Worth being Ordinance No. 2543, the City determined the necessity for and ordered the improvement of a portion of Dexter Avenue, to-wit: DEXTER AVENUE from the easterly line of Clover Lane to the westerly line of Sutter Street. MMItEAS, subsequent to the passage and approval of said ordinance, plans and specifications for said improvements were submitted by the City Engineer and said plans and specifications were approved and adopted by the City Council; and, WHEREAS; notice to bidders was given as required by the City Charte'r, and, I WHEREAS, the bid of Brown & Root, Inc., was found to be the lowest and best bid for the making and construction of said improvements, to-wit, ex- cavating present street, placing thereon a 3 inch compacted gravel, founda- tion course, and paving with 12 inches of Hot Mix Asphaltic Surface on 32* of Hot Mix Asphaltic. Concrete Base with combined concrete curb and gutter, together with incidentals and aopurtenanees, all as provided by said plans and specifications; NOW, THRBEFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the work of making and constructing such improvements and con- tract therefor is hereby awarded to Brown & Root, Inc., at and for the prices stated in the proposal of the said company and as reported and re- commended by the Department of Public Works, The Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City there- on, the said Contract embracing therein, among other things, the prices for the work. SECTION 2. That to provide for the payment of the indebtedness incurred by the City of Fort Worth by said Contract, there is hereby appropriated out of available funds which have been set aside for said purpose, an amount sufficient to pay said indebtedness so incurred. SECTION 3. That the City Engineer of the City of Fort Worth be and he is hereby or- dered and directed to file with the City Council estimates of the costs of such OR improvements in accordance with the terms of the powers and provisions of Chap— ter 106 of the acts of the First called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon?s Civil Statutes of the State of Texas, Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth.
