AN ORDINANCE AMENDING SECTION 29-70 OF CHAPTER 29
OF THE FORT WORTH CITY CODE (1964) WHICH CHAPTER
REGULATES PLUMBING IN THE CITY OF FORT WORTH,
BY PRESCRIBING REGULATIONS FOR THE CONNECTION
OF CERTAIN SUBSURFACE DRAINAGE FACILITIES TO
SANITARY SEWERAGE LINES; PRESCRIBING APPLICABLE
RATES FOR SUCH CONNECTIONS; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY
CODE IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 29-70 of Chapter 29 of the Fort Worth
City Code (1964) is hereby amended and, after being so
amended, same shall hereafter read as follows:
"Sec. 29-70. Unauthorized Sewer Connections.
Building sewers shall not be connected
to any sanitary sewer manhole or clean-out
stack without the prior written permission of
the Director of the Water Department of the
City of Fort Worth or his authorized represen-
tative.
No rainwater downspout or area, yard,
street or gutter drains shall be connected
directly or indirectly to any sanitary sewer.
Subsurface drainage facilities that discharge
to the surface material which would be in-
jurious to the public health or safety may be
connected to the sanitary sewer system but only
after such connection has been specifically
approved in writing by the Director of the
Water Department and the Chief Plumbing In-
spector or their authorized representatives.
Application for approval for the connection
of such subsurface drainage facilities to
the sanitary sewer system must be made to the
Chief Plumbing Inspector upon forms furnished
by said inspector and accompanied by appro-
priate plans of the proposed connection.
Water Department approval for such subsurface
drainage connections will not be granted unless:
(a) The sanitary sewer line to which the
connection is to be made has sufficient surplus
capacity under maximum service conditions to
accommodate the discharge rate from the subsur-
face drainge facilities; and
(b) All of the subsurface drainge discharge
into the sanitary sewer line through the proposed
connection passes through an approved pumping
system in which the rate of discharge is controlled
at the rate which has been approved by the Direc-
tor of the Water Department or his authorized
representative.
The owner or occupant of any building being
served by any such subsurface drainage connection
to the sanitary sewerage system shall pay monthly
charges to the City of Fort Worth for such connec-
tion determined upon the following basis: One
and 25/100 Dollars ($1.25) for each five gallons
per minute or fraction thereof pump discharge
rate to the sanitary sewer line, but in no event
shall any such monthly charge be less than One
and 25/100 Dollars ($1.25) . No charge shall be
assessed for any such subsurface drainage connec-
tion which has been made

The Director of the Water Department of the'
City of Fort Worth or his authorized representa-
tives shall at all times have the right to re-
move, plug, close up or disconnect from the sani-
tary sewerage system of the City of Fort Worth
any line or facility which has been connected
to the sanitary sewerage system in violation of
this chapter. The plumbing inspector shall
notify the Water Department in writing of the
location of any line or facility serving any
premises where such unauthorized plumbing has
been installed. Said line or facility shall
not be reconnected to the sanitary sewerage
system until a permit has been issued, an inspec-
tion has been made and approval given by the
plumbing inspector as required in this chapter."
SECTION 2.
That this ordinance shall repeal every prior ordinance
and provision of the Fort Worth City Code in conflict here-
with but only insofar as the portion of such prior ordinance
or provision shall be in conflict, and as to all other ordi-
nances or provisions of the Fort Worth City Code not in
direct conflict herewith, this ordinance shall be and is
hereby made cumulative.

SECTION 3.
That if any section, part of a section or provision
of any section of this ordinance shall be held to be void,
ineffective or unconstitutional by a court of competent
jurisdiction, the holding of such section, part of a sec-
tion or provision of any section to be void, ineffective
or unconstitutional for any cause whatsoever shall in no
way affect the validity of the remaining sections and
provisions of this ordinance, which shall remain in full
force and effect. The City Council would not have passed
any sections, parts of sections or provisions of any sec-
tion of this ordinance that were unconstitutional, void
or ineffective if it had known that they were unconstitu-
tional, void or ineffective at the time of adopting this
ordinance.
SECTION 4.
That the violation of any provision of this ordi-
nance or of any provision of the Fort Worth City Code
relating to the sanitary sewerage drainage system shall
be deemed an offense and shall be punishable by a fine
not exceeding Two Hundred Dollars ($200.00) , and each
violation thereof and each day that there is a failure to
comply with the terms of this ordinance shall be and is
hereby deemed to be a distinct and separate offense and
punishable as such.
SECTION 5.
That this ordinance shall be in full force and effect
from and after its passage and publication as required by
law.

NUMBER Permit Sump Pumps to be Connected to
10 30 67 G-1159 Sanitary Sewer 1 of
Ordinances of the City of Fort Worth prohibit the connection of subsurface
drains (basement sump pumps) to the sanitary sewer system. In some cases
where storm drains are not available the discharge from sump pumps has been
allowed to run down the gutter causing a nuisance to the neighborhood. The
Departments of Public Health, Water and Public Works with the cooperation of
the Supervising Board of Plumbers have suggested that the ordinance be amended
to permit the discharge of sump pumps into the sanitary sewer system where
storm drains are not available.
The proposed amendment provides that no subsurface drainage facility can be
discharged into the sanitary sewer without first obtaining a permit from the
Director of the Water Department and the Chief Plumbing Inspector, or their
authorized representatives. It further requires plans of the connection to
be submitted showing the construction of the sub-drainage and plumbing facili-
ties and establishes a monthly charge of $1.25 for each five gallons per minute
(the approximate flow of a single family residence) or fraction thereof of the
pump's rated discharge with a minimum charge of $1.25 per month.
Recommendation
It is the recommendation that the attached amendment to Section 29-70 of the
Fort Worth City Code be adopted.
