Provided, however, that any owner shall have the right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and accrued interest, and provided further that if default shall be made in the payment of principal or interest promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of Fort Worth,or its assigns,be and become immediately due and parable, and shall be collectable, together with reasonable attorneys fees and cost of collection, if incurred, PROVIDED, however, that acting through its duly authorized Director of Public Works the City of Fort Worth retains the right to authorize payment of the sums assesed against abutting property upon such completed and accepted unit in not more than forte-eight (18) equal regular monthly installments of not less than $9,00 each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit. VIIl. Although the aforementioned charges have been fixed, levied, and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where deemed appropriate.Notwithstanding the City Council has herein reserved the right to issue credits, it shall not be required to issue credits, and will not do so, if same would result in any equity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of Fort Worth, Texas,as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment hereinabove levied such amount or amounts,if any,as may hereafter be allowed by the City Council as a credit against the respective assessments. IX. For the purpose of evidencing the several, sums assessed against the respective parcels of abutting prop- erty and the owners thereof, and the time and terms of payment, and to aid in the enforcement and collection thereof, assignable certificates in the principal amount of the respective assessments less the amount of any re- spective credit allowed thereon, shall be issued by the City of Fort Worth, Texas, upon completion and accept- ance by the City of the improvements in each unit of improvement as the work in such unit is completed and accepted, which certificates shall be executed by the mayor in the name of the City and attested by the City Secretary, with the corporate seal of the City impressed thereon, and shall be payable to the City of Fort Worth, or its assigns, and shall declare the said amounts, time and terms of payment, rate of interest, and the date of the completion and acceptance of the improvements abutting upon such property for which the certificate is issued, and shall contain the name of the owner or owners,if known.description of the property by lot and block number, or front feet thereon, or such other desciption as may otherwise identify the same; and if the said property shall be owned by an estate, then the description of same as so owned shall be sufficient and no error or mistake in describing any property, or in giving the name of the owner, shall invalidate or in anywise impair such certificate, to the assessments levied. The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then thev shall be collectable, with reasonable attorney's fees and costs of collection, if incurred, and shall provide substantially that the amounts evidenced thereby shall be paid to the Assessor and Collector of Taxes of the City of Fort Worth,Texas, who shall issue his receipt therefor, which shall be evidence of such payment on any demand for the same, and the Assessor and Collector of Taxes shall deposit the sums so received by him forth- with with the City Treasurer to be kept and held by him in a separate fund, and when any payment shall be made in the City the Assessor and Collector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said payment thereof. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Treasurer's Warrant for making such payment. Such payments by the Treasurer shall be receipted for the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney's fees,if incurred, have been paid in full. Said certificates shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law,and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of Fort Worth, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. Said certificates shall further recite that the City of Fort Worth, Texas shall exercise all of its lawful powers, when requested so to do,to aid in the enforcement and collection thereof, and may contain recitals sub- stantially in accordance with the above and other additional recitals pertinent or appropriate thereof, and it shall not be necessary that the recitals be in the exact form above set forth, but the substance thereof shall be sufficient. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessments upon other premises. X. Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof,is,in accordance with the law in force in this City, vested in the City. XI. All assessments levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named,or may be incorrectly named. XII. The procedures concerning owner participation in the cost of paving, including methods and policies of determining assessments, street construction stand- ards, and method of payment were explained to the 37 persons in attendance. Mr. 0. D. Wyatt, 4444 Old Mansfield Road the developer of Wyatt's Subdivision, owner of Lot 1, Block 4, and part of Block B, expressed an opinion that the assessments were excessive. Mr. Wyatt also stated he was opposed to widening the street to 36 feet. In response to his comments and questions, Mr. Wyatt was provided information that properties already developed and sold in Wyatt Subdivision had been granted standard residential credits and that none were assessed for more than $5.40 per front foot. Other undeveloped lots, still owned by developer and including some owned by Mr. Wyatt, would be assessed without standard residential credits. It was also explained that the City Plan Commission, Traffic Engineering and Public Works Departments considered the proposed roadway width of Old Mansfield Road. Upon hearing the recommendations of ' the citizen board and various affected departments, it was reported that the City Council determined that a 36 foot wide street should be built to serve as a north-south collector in the neighborhood. A 36 foot wide roadway will permit two lanes of moving traffic and curb parking on both sides oL the street. A lesser width would restrict either t: parking or the through lanes of traffic. ,i ' The tern, f a community facilities contract for the Wyatt Subdivision provided that i the deve er be granted a reimbursement of $1,815 for excess excavation and for excava and paving of intersections upon completion of the paving of adjacent sections of Old Mansfield Road. Because the cost of paving is being assessed against property owners and not being paid by the developer, ' it is proposed that the reimbursement be used to reduc- the assessments on properties where the developer was obligated but failed to provide street paving. Standard policies granting credits to existing residences have reduced the assessments against eight affected property owners $1,189.68 from the gross cost which would have been paid by the developer. It is therefore proposed that further credits of $625.32, the remainder of the contrsrt refund amount, be applied on a prorata basis as follows: AMOUNT PRORATA NET OWNER LEGAL DESCRIPTION ASSESSED REIMBURSEMENT ASSESSMENT i a Marvin K. _lls Lot 5, Block 1 $30 .50 $48.60 $252.90 Horace T. Wyatt Lot 1, Block 4 $863.75 $268.60 $595.15 $625.32 Mr. J. T. Kenney, 2400 Fairway Drive, owner of Lot 1, Block 5, Glencrest Addition, said he thought the amount of the assessment was excessive. He questioned the extent of commercial frontage that should be assessed his legal non-conforming commercial use in an "A" One Family residential zone. Because the building housing a grocery store and beauty shop is 60 feet across the front, he asked to be assessed for only 60 feet of the 187.4 front feet at commercial rates. Information was provided that the use o = the - roperty for commercial purposes subjects the entire lot to assessment at commercial rates, and that no reduction could be made unless the property was subdivided and replatted. Mr. Kenney was advised that if the property is subdivided prior to completion of the project, the staff would recommend residential assessment credits :or the portion of the lot that is zoned and used for residential purposes. Mr. Ker. has applied for a change in zoning from "A" One-Family residential to "E" Caznerc-=_ for the entire lot. This request was reviewed by the Zoning Commission on November 10, 1965 (Docket No. Z-65-181) , with the recommendation that the request be ..,nied. Currently the request is awaiting Council action. Mr. Kermit V. Speeg, 3045 Timberline Drive, who does not own property on Old Mansfield Road but who is president of the Glen Crest Civic League, objected to widening the roadway to 36 feet. Mr. Speeg spoke in favor of 30-foot wide streets in residential areas. Mr. Horace T. Culp, 4316 Old Mansfield Road, owner of Lot 4, Block 1, Wyatt Subdivision read a statement expressing opposition to the widening of the street. The text of his statement is as follows: "We know of no other streets in the area that are over 30 feet wide other than the major thoroughfares. Those residing south of Timberline can use Timberline or other streets East to Wichita, which is a thoroughfare North, East, or West, via Poly Freeway, or E: Berry. This gives good access to the 5 major thoroughfares surrounding this street. You can readily see what has happened to residences along these 5 streets - Now you want to tear up the middle of what is left." " feel it should be better policed against speeders p g p especially between 5 • and 7:30 P.M.) and large trucks, although we know such is difficult on account of insufficient force." "The street in front of my house is as good as in some developed areas, this however is only about 2 blocks, and the balance does need correcting I'm sure and I would be required to spend money just to be cooperative - if that becomes' .necessary - I will cooperate, but do object to widening." "Since only 3 per cent of the streets in residential areas in the past 18 months have been widened, we want to know how you can justify this along with other facts stated." ATTACHMENT "A" Page 3 of 3 Mrs. Florence A. Bieber, 4909 Old Mansfield Road, owner of Lot 24, Henderson Sub- division, stated she had paid $250 to the builder, a Mr. Sanders, for street improve- ments adjacent to her property. Following investigation, the Public Works Department advised Mrs. Bieber that no record could be found of a contract with the developer of Henderson Subdivision providing for street improvements. Mrs. Bieber also stated that when the grade for her curb and gutter was established she was informed 'by City officials (names unknown) that she would not be assessed for future street paving. Investigation disclosed that when the curb grades were established at Mrs. Bieber's property, it was necessary that the roadway be lowered to fit the curb grade. The City, at no expense to the property owners, excavated and resurfaced a portion of Old Mansfield Road between Pioneer and Rodeo Streets so that curb and gutter could be constructed by private contractors. The misunderstanding apparently arose because she was not assessed for the paving and tie-in at the time the curb and gutter was built. The property is now being assessed for permanent paving, but credits are being granted for existing curb and gutter. Mrs. Henry A. Luebbert,, Lot 1, Block 5, Northglen Addition, stated she thought the developer of Northglen Addition had placed sufficient funds in escrow to pay the assessment. Investigation indicated that the developer of Northglen Addition, Mr. Robert Burns, had not placed money in escrow for the future paving of Old Mansfield Road. It was reported, however, that the lots were sold by Mr. Burns on the condition that the buyer would pay for the installation of curb and gutter only and that Mr. Burns would pay the paving costs. The Public Works Department has provided Mr. Burns and affec -d property owners with a description of the project and a schedule giving the`distr,.:.utic , of the various paving costs. Assessments have been levied against the property owners who can then request the developer to fulfill the contractual obligations regarding the paving. Mr. Heru. Tiarks, 4100 Old Mansfield Road, owner of Tract 2, S. B. Hopkins Survey and TracL 1C, James Huie Survey, asked if he would be given any residential credit because his resi"ence is located on Tract 2. It is proposed that Mr. Tiarks be granted residential credit for 205 feet out of Tract 2, based on a preliminary subdivision which sets out Mr. Tiarks' homestead tract. The remainder of Tract 2, which is undeveloped, is not allowed standard residential credits. r r ATTACHMENT "B" Page I of 1 OLD MANSFIELD ROAD FROM MANSFIELD HIGHWAY TO EAST BERRY STREET - 097-24000-134 PER CENT CONTRAOTPRICE......................................................................... ..r «.......... ...s 136,115.30 ENGINEERING. ..................................................... .............................».................... 13,611.53 ESTIMATEDCONSTRUCTION COST...............................................»..».......................»................................i 149,726.83 100.0 RESIDENTIAL FOOTAGE................................ 11,366.0 98.6 COMMERCIAL FOOTAGE.............................. 165.2 1.4 TOTAL FOOTAGE........................................- 119 531.2. 100.0 RESIDENTIAL.
