AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING
FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF
CERTAIN TERRITORY CONSISTING OF 0.007 SQUARE MILE
OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS
THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH,
TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR
ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABI-
TANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL
CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CON-
FLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL
BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT
CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING
AN EFFECTIVE DATE.
WHEREAS,a public hearing before the City Council of the City of
Fort Worth, Texas, wherein all interested persons were provided with an
opportunity to be heard on the proposed annexation of the territory herein-
after described, was held in the City Council Chamber in the City Hall of
Fort Worth, Texas, on the 19th day of April, 1971, which date is not more
than twenty (20) nor less than ten (10) days prior to the institution of
annexation proceedings; and
WHEREAS, notice of such public hearing was published prior thereto
in a newspaper having general circulation in the City of Fort Worth, Texas,
and in the hereinafter described territory on the 7th day of April, 1971,
which date was not more than twenty (20) and not less than ten (10) days
prior to the date of the opening of such public hearing; and
WHEREAS, the population of the City of Fort Worth, Texas, is in
excess of 393,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas, was
212.916 square miles on the 1st day of January, 1971; and
WHEREAS, the hereinafter described territory lies within the ex-
clusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory contains approximately
0.007 square mile of land; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH:
SECTION I
THAT the following described land and territory lying adjacent
to and adjoining the City of Fort Worth, Texas, is hereby added to and
annexed to the City of Fort Worth, Texas, and said territory hereinafter
described shall hereafter be included within the boundary limits of the
City of Fort Worth, Texas, and the boundary limits of said City, at the
various points contiguous to the area hereinafter described, are altered
and amended so as to include said area within the corporate limits of the
City of Fort Worth, Texas, to wit:
BEING a tract of land about 8 miles south from the courthouse of
Tarrant County, Texas, and including a portion of Block 27 of the
Shelby County School Land Survey (Abstract No. 1375), and being
described as follows:
BEGINNING at a point for corner at the southwest corner of Block 27,
Shelby County School Land Survey (Abstract No. 1375), said point also
being the southeast corner of Block 16, Shelby County School Land
Survey (Abstract No. 1375), the northeast corner of Block 17, Shelby
County Schoolland Survey (Abstract No. 1375) and the northwest
corner of Block 26, Shelby County School Land Survey (Abstract No.
1375), said point also being in the present city limit line of the
City of Fort Worth;
THENCE, North 0 degrees 03 minutes 30 seconds East along and with
the present city limit line of the City of Fort Worth, the same
being the west line of Block 27, Shelby County School Land Survey
(Abstract No. 1375) and the east line of Block 16, Shelby County
School Land Survey (Abstract No. 1375), a distance of 1057.32 feet
to a point for corner;
THENCE, South 89 degrees 50 minutes 45 seconds East 190.0 feet to
a point for corner in the west line of Heritage Heights Addition,
Section 2, said point also being in the present west city limit line
of the City of Forest Hill;
THENCE, South 0 degrees 03 minutes 30 seconds West along and with the
said west line of Heritage Heights Addition, Section 2, the same being
the present west city limit line of the City of Forest Hill, a distance
of 1057.0 feet to a point for corner at the southwest corner of said
Heritage Heights Addition, Section 2, the same being a southwest
corner in the present city limit line of the City of Forest Hill,
and said point being in the south line of Block 27, Shelby County
School Land Survey (Abstract No. 1375) and the north line of Block 26,
Shelby County School Land Survey (Abstract No. 1375);
THENCE, west along and with the south line of Block 27, Shelby County
School Land Survey (Abstract No. 1375), and the north line of Block 26,
Shelby County School Land Survey (Abstract No. 1375) a distance of
190.0 feet to the point of beginning and containing 0.007 square mile.

SECTION II
THAT the above described territory and the area annexed shall
be a part of the City of Fort Worth, Texas, and the property so added
hereby shall bear its pro rata part of the taxes levied by the City of
Fort Worth, Texas, and the inhabitants thereof shall be entitled to all
of the rights and privileges of all the citizens and shall be bound by
the acts, ordinances, resolutions and regulations of the City of Fort
Worth, Texas.
SECTION III
THAT this ordinance shall and does hereby amend every prior
ordinance in conflict herewith, but as to all other ordinances or sections
of ordinances not in conflict herewith this ordinance shall be and is
hereby made cumulative.
SECTION IV
THAT it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph
or section of this ordinance shall be declared void, ineffective, or
unconstitutional by the valid judgment or final decree of a court of
competent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs and sections
hereof, since the same would have been enacted by the City Council with-
out the incorporation herein of any such void, ineffective or unconstitu-
tional phrase, clause, sentence, paragraph or section.
SECTION V
THAT this ordinance shall be in full force and effect from and
after the date of its passage on first reading and publication and its

passage on second reading as provided for in Section 40 of Chapter
XXVIII of the Charter of the City of Fort Worth and it is so ordained,

The owner of a portion of Block 27, Shelby County School.Land Survey,
Abstract No. 1375, has petitioned to have his property annexed to the
City of Fort Worth. The subject area contains approximately 4.6 acres
and is located west of the City of Forest Hill as shown on the attached
map.
City Plan Commission Recommendation
The Plan Commission has approved a final plat of Alta Mesa Addition
(Sf-71-9) which includes the area petitioned for annexation. The
developer of this addition desires to have this subdivision, in its
entirety, located within the city limits of Fort Worth.
The Development Review Committee at its regular meeting on March 18,
1971, reviewed the request and had no-objection to the proposed annexa-
tion. Subsequently, on March 24, 1971, the subject area was recommended
for annexation by the City Plan Commission.
Boundary Conflict
The City Secretary of Forest Hill has confirmed by letter that the
subject property is not within the city limits of Forest Hill, and
that Forest Hill has no interest in the area.
Municipal Services
The City of Fort Worth can provide all municipal services to this pro-
perty under the terms of standard development policies.
Recommendation
tt is recommended that the City Council authorize the City staff to
initiate annexation proceedings on the subject area in accordance with
the attached timetable.
