ICz l 7 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CON- SISTING OF 396 ACRES OF LAND, WHICH SAID TERRITORY LIES AD- JACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABI- TANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chambers in the City Hall of Fort Worth, Texas, on the Bth day of December, 1975, which date is not more than twenty(20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 25th day of November, 1975, which date was not more than twenty (20) nor less than ten (10) days prior to the date of the public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, was, on January 1, 1975- and is now, in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 236.4 square miles on January 1, 1975; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory contains 396 acres of land; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. TEXAS: SECTION 1 That the following described land and territory lying adjacent to and ad- joining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall here- after be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit: Being that same area shown on a Preliminary Plat as Blocks 1 through 22, Singing Hills Addition; being all of the C. E. Burkham Survey, Abstract No. 246, all of the J. H. Bursey Survey, Abstract No. 241. and a portion of the J. Burle- son Survey, Abstract No. 78, situated in Tarrant County, Texas, about 11 miles westerly from the Tarrant County Courthouse, and being more particularly des- cribed by metes and bounds as follows: BEGINNING at an iron in the west line of said J. Burleson Survey, said iron being on the south right-of-way line of Interstate Highway 20 (U.S. Highway No. 80) and being the southwest corner of a tract of land in said J. Burleson Survey as conveyed to the State of Texas by deed recorded in Volume 3676, Page 290 of the Deed Records of said Tarrant County; THENCE North 89 Degrees-34 Minutes East with said south right-of-way line a distance of 2,175.4 feet to a 1-inch iron on the northwest corner of Lot 47 (47-R) El Rancho Estates Addition as recorded in Volume 388-0, Page 199, and Volume 388-3, Page 265 of the Plat Records of said Tarrant County, being in the east line of said J. Burleson Survey; THENCE South 0 Degrees-41 Minutes West with said east line a distance of 3,117.5 feet to a 1-inch pipe on the southwest corner of Lot 38, of said E1 Rancho Estates Addition, being in the north line of said J. H. Bursey Survey; THENCE South 89 Degrees-37 Minutes-15 Seconds East with said north line a distance of 2,415.3 feet to a 1-inch iron on the northeast corner of said J. H. Bursey Survey; THENCE South 0 Degrees-23 Minutes West a distance of 1,326.9 feet to a 7/8-inch iron on the southeast corner of said J.H. Bursey Survey; THENCE North 89 Degrees-41 Minutes West a distance of 1,857.1 feet to a 7/8-inch iron on the northeast corner of said C. E. Burkham Survey; THENCE South 0 Degrees-13 Minutes West a distance of 1,221.5 feet to a 7/8-inch iron on the southeast corner of said C.E. Burkham Survey; THENCE North 89 Degrees-38 Minutes West a distance of 3.114.9 feet to a 7/8-inch iron on the southwest corner of said C. E. Burkham Survey; THENCE North 0 Degrees-10 Minutes-15 Seconds East a distance of 2.796.7 feet to a 1-inch iron on the northwest corner of said C. E. Burkham Survey; THENCE North 89 Degrees-57 Minutes East a distance of 395.4 feet to a 1-inch iron for corner of said J. Burleson Survey; THENCE North 0 Degrees-34 Minutes-15 Seconds East a distance of 2,838.1 feet to the place of beginning, containing 396 acres of land, more or less. 2 SECTION 2 THAT the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regula- tions of the City of Fort Worth, Texas. SECTION 3 THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and the same is hereby made cumulative. SECTION 4 THAT it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such unconstitu- tionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5 THAT this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. BA�u� City" 0 ' Fort Worth, Texas Mayor and Council Communication DATE, REFERENCE SUBJECT: PAGE NUMBER Annexation - S 11/24/75 PZ-708 �tig Hills I of _L Addition The owners of 396 acres of land (0.619 square miles) in the western portion of Tarrant County have petitioned for annexation of the area to Fort Worth and furnishing of City services. The area, as shown on the attached map., fronts on Highway I-20 on the north and is bounded by El Rancho Estates on the east, Linkwood Estates on the west and unsubdivided land on the south. The area is within the exclusive extraterritorial jurisdiction. of Fort Worth for annexation purposes and not subject to annexation by any other munici- pality. A preliminary subdivision plat (S-75-21, Singing Hills Addition) has been submitted and was approved by the Plan Commission on August 7, 1975. Normal City services can be furnished the area without inordinate expense or undue difficulty. Water and sewer can be extended into the area under standard developer policies. When sufficient development occurs in this and adjacent areas to Warrant such action, provision for an additional fire station will be required. At its regular meeting on October 29, 1975, the Plan Commission voted to recommend to the City Council that the area be annexed as petitioned, subject to 'concurrent execution of community facilities contracts for water and sewer. The owner's engineer has confirmed that his client will be prepared 'to enter into such a contract with the City prior to the date of final annexation. A copy of the recommended City Council Annexation Time Table is also attached. Recommendation It is recommended that the City Council initiate annexation proceedings and authorize and direct publication of a Notice of Public Hearing on Contemplated Annexation for a public hearing to be held December 8, 1975.
